A RESOLUTION APPROVING THE GRANT OF A TEMPORARY CONSTRUCTION
EASEMENT FOR A WASTE WATER MAIN AND APPURTENANCES FROM THE CITY OF
RIVERSIDE TO THE CITY OF KANSAS CITY.
WHEREAS, the Board of Aldermen finds it to be a public purpose and in the best interest
of the public to grant access to certain property further described herein in connection with the
construction of a sanitary sewer main and appurtenances pertaining to Platte County Parcel 23-
3.0-06-100-006-002.000, otherwise known as 5654 NW River Park Drive, LLC or CK Supply;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
THAT the Board of Aldermen ("Board") hereby approves the grant of a Temporary
Construction Easement, in substantially the form attached hereto, to The City of Kansas City, and
the Mayor is authorized to execute the conveyance on behalf of the City; and
FURTHER THAT the Mayor, the City Administrator, the Finance Director and other
appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Resolution and to execute
and deliver for and on behalf of the City all certificates, instruments, agreements and other
documents, as may be necessary or convenient to perform all matters herein authorized.

TEMPORARY EASEMENT
FOR
WASTE WATER MAIN AND APPURTENANCES
Let it be known that City of 1�iverside, Missouri, owner of the subject property, hereafter called
the GRANTOR, on this aday of 20Qk5, for and in consideration of $1.00, the
receipt of which is acknowledged, does grant, remise, release and unto The City of Kansas
City, a Missouri Municipal Corporation, acting through its Water Services Department, whose
mailing address is:

and hereafter called the GRANTEE, a TEMPORARY EASEMENT for the operation and
movement of equipment, and the movement of a working force, in connection with the location,
construction, reconstruction, maintenance, operation and repair of a Sewer main and any
appurtenances thereto, over under and through the following described tract of land situated in
Riverside, Platte County, Missouri, to -wit:
LEGAL DESCRIPTION ATTACHED AS EXHIBIT A
The GRANTEE, its agents, employees or independent contractors shall have the right to go upon
the above described tracts of land, for the purpose of constructing, maintaining, and repairing the
Sewer main improvements and appurtenances thereto, and shall upon completion of such
construction, maintenance or repair, cause the land of the GRANTOR to be restored to
substantially the same condition that existed prior to the GRANTEE'S entry upon it.
These easements shall not be construed to prohibit the GRANTOR from developing any adjoining
property or from the laying out, establishing and constructing of pavement, surfacing of roadways,
curbing and gutters along, upon, over or across said easement or any portion thereof.
GRANTOR further states that it is lawfully seized of title to the land through which said easement
is granted, and it has good and lawful right to convey said easement to the GRANTEE herein.
This temporary easement expires December 28, 2027.

REQUEST AND CONSENT OF LESSEE
The undersigned, as lessee (the "Lessee") under the Lease Agreement dated as of November 1,
2024 (the "Lease"), affecting the property described in Exhibit A, between the City of Riverside,
Missouri (the "City") and Lessee, hereby requests the City to grant and deliver the foregoing
Temporary Easement for Waste Water Main and Appurtenances (the "Easement") and represents
to the City that the Financing Parry and/or leasehold mortgagee, if any, under the Lease has been
notified of the Easement and has provided its consent to the Easement,
