HomeMy WebLinkAbout2117 Amending City Code pertaining to Noise DisturbanceBILL NO. 2025-079 oRDINANcE No. 2117 AN ORDINANCE AMENDING THE CITY CODE PERTAINING TO NOISE DISTURBANCE BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION I -AMENDMENT. That City Code Section 210.770 is hereby amended to read as follows ( deletions contain a strikethFough; additions are underlined): Section 210. 770. Noise Disturbance. A. A person commits the offense of noise disturbance if such person shall make, continue, cause or permit to be made or continued any of the following: 1. arking dogs or other noisy animals which disturb the comfort and repose of any person in the vicinity. 2. Use of sound-producing or reproducing equipment between the hours of 10:00 P .M. and 7:00 A.M. that is plainly audible within a dwelling unit that is not the source of the sound, or use of such equipment on public property or on a public right-of-way so as to be plainly audible fifty (50) feet or more from the source of the sound. The Board of Aldermen may grant an exemption from this Subsection to allow a person reasonable use of public property or the right-of-way to broadcast music or speech. 3. Outdoor Concert Venue Operations. a. Notwithstanding subsection (A)(2) of this Section, the provisions of this subsection shall apply only to an Outdoor Concert Venue situated on a tract of land comprising more than ten (10) acres , and expressly approved for such use pursuant to the Citv's zoning regulations. b. Outdoor concert or show operations conducted at such an Outdoor Concert Venue shall comply with the following curfews: Sundav through Thursday: All amplified sound associated with concert operations shall cease no later than 11:00 P.M. after which the provisions of Subsection (A)(2) shall a pply . Friday and Saturday: All amplified sound associated with concert operations shall cease no later than 11:30 P.M., after which the provisions of Subsection (A )(2) shall apply. c. In the event concert or show operations are tem porarily sus pended due to inclement weather .such operations may resume beyond the curfew established above :provided, however, that in no case shall operations continue later than 1 00 A.M., and only upon review and approval of the Chief of Police or his/her designee. d. For purposes of this subsection. "inclement weather" shall mean any of the following: 1. Conditions during which the National Weather Service has issued a Severe Thunderstorm Warning, Tornado Warning. or other Severe Weather Warning impacting the Cite; or 2. Conditions in which lightning or other hazardous weather conditions are present in the vicinity that i) in the reasonable iudgment of the venue operator, subject to confirmation by the Chief of Police or his/her designee, or ii) in the independent judgment of the Chief of Police or his/her designee. pose a threat to the safety ofpgrformers. staff, or attendees. B. Notwithstanding any other provision of this Code, the Director of Community Development may grant a temporary permit waiver to Subsection (A)(2) of this Section for after-hours construction activity if the Director determines that the impact to the public health, safety, and welfare is not outweighed by the public benefits resulting from the construction activity. If approved by the Director, the applicant is required to provide written notice to any residential areas within one thousand (1,000) feet no less than twenty- four (24) hours prior to the beginning of the construction activity. The Director may revoke any issued temporary permit waiver if the Director subsequently determines that the impact to the public health, safety, and welfare outweighs the public benefits resulting from the construction activity. SECTION 2— EFFECTIVE DATE. This ordinance shall be in full force and effect from and after the date of its passage and, approval.
