A RESOLUTION APPROVING THE DECLARATION OF RIGHT OF WAY FOR THE
RIVERWAY BOULEVARD IMPROVEMENTS PROJECT
WHEREAS, the Board of Aldermen finds it to be a public purpose and in the best
interest of the public to declare the right of way further described herein in connection
with construction of the Riverway Boulevard Improvements Project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
THAT the Board of Aldermen ("Board") hereby designates the Right of Way, in
substantially the form attached hereto, and further authorizes the Mayor to execute the
right of way on behalf of the City; and
FURTHER THAT the City Clerk, or her designee, is hereby authorized and
directed to file a fully executed copy of the declaration of right-of-way with the Recorder
of Deeds in Platte County; and
FURTHER THAT the Mayor, the City Administrator, the City Attorney and other
appropriate City officials are hereby authorized to take any and all actions as may be
deemed necessary or convenient to carry out and comply with the intent of this
Resolution and to execute and deliver for and on behalf of the City all certificates,
instruments, agreements and other documents, as may be necessary or convenient to
perform all matters herein authorized.
PASSED AND ADOPTED by the Board of Aldermen of the City of Riverside,
Missouri, the 6th day of January 2026.

DECLARATION OF RIGHT-OF-WAY
This Declaration is made this 6th day of January 2026, by the City of Riverside,
Missouri, a municipal corporation and political subdivision the State of Missouri ("City").
RECITALS
WHEREAS, the City is the fee simple owner of certain real property situated in Platte
County, Missouri, legally described in Exhibit A ("Parent Tract"); and
WHEREAS, the City is undertaking public improvements commonly known as the
Riverway Boulevard Improvement Project ("Project"); and
WHEREAS, a portion of the Parent Tract is required for public street, roadway, utility,
sidewalk, and drainage right-of-way purposes in connection with the Project; and
WHEREAS, the City desires to formally designate such area as public right-of-way and
record this instrument to provide public notice of such designation.
DESIGNATION OF RIGHT-OF-WAY
The City hereby designates and establishes the real property described in Exhibit B
("Right-of-Way Area") as public right-of-way for the construction, use, operation, maintenance,
and improvement of public streets, sidewalks, utilities, drainage facilities, and all other customary
municipal right-of-way purposes.
EFFECT OF DESIGNATION
The Right-of-Way Area shall:
a. Be held and used by the City for public street and related municipal purposes;
b. Be included in and considered part of the public right-of-way system of the City;
c. Remain so designated unless lawfully vacated by ordinance or otherwise
conveyed in accordance with Missouri law .

All that part of Block B, Renner Plaza No. 3, a subdivision lying in the West Half of the Southeast
Quarter of Section 4, Township 50 North, Range 33 West, Riverside, Platte County, Missouri,
more particularly described as follows:
Commencing at the northernmost comer of a tract of land described and recorded in Book 1021,
at Page 797, Platte County Recorder of Deeds, said point being on the northeasterly right of way
line of NW Gateway Drive; thence South 34 degrees 44 minutes 21 seconds East, 183 .31 feet;
thence South 38 degrees 26 minutes 37 seconds East, 125.86 feet; thence South 47 degrees 32
minutes 39 seconds East, 61.80 feetto the POINT OF BEGINNING of the tract ofland herein and

A variable width strip of land being a part of Block B, RENNER PLAZA NO. 3 a subdivision in
the City of Riverside, Platte County, Missouri, recorded June 28, 1950 in the Office of the
Recorder of Deeds for said County and State as Instrument No. 14169 in Plat Book 4 at Page 49
and being a part of that certain tract of land described as set forth in the Special Corporation
Warranty Deed recorded January 30, 2008 as Instrument No. 2008001294 in Book 1117 at Page
21. Said variable width strip of land being situated along the Northerly right-of-way line of NW
Platte Drive as now established in the Southwest Quarter of the Southeast Quarter of Section 4,
Township 50 North , Range 33 West and being now more particularly described as follows:
Commencing at the Northernmost comer of that certain tract of land described as set forth in the
General Warranty Deed recorded November 20, 2003 in the Office of the aforesaid Recorder of
Deeds as Instrument No.0031953 in Book 1021 at Page 797; thence Southeasterly along the
Southwesterly line of the tract of land described in said General Warranty Deed, being also
along the Northeasterly right-of-way line of aforesaid NW Platte Drive, the following courses
and distances; thence S34°44'21 "E (S34°54'06"E, Deed), a distance of 183.31; thence

described course, a distance of 31. 77 feet to a point on the Easterly line of the tract of land
described in the aforesaid Special Corporation Warranty Deed; thence N65°27'37"W, departing
from the Northeasterly right-of-way line of said NW Platte Drive and from the tract of land
described in said Special Corporation Warranty Deed, a distance of 126.28 feet; thence
N61 °46'51 "W, 86.23 feet; thence N59°57'07"W, a distance of 114.69 feet to the Point of
