AN ORDINANCE AMENDING SECTION 6.15 OF THE RIVERSIDE CODE
AND PROVIDING THAT A SPECIAL PERMIT BE OBTAINED FROM THE
PLANNING COMMISSION BEFORE THE INSTALLATION OF ANY ANTENNA
WITHIN THE CITY LIMITS OF THE CITY OF RIVERSIDE, MISSOURI AND
PROVIDING PENALTIES FOR THE VIOLATION OF SAID ORDINANCE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE AS FOLLOWS:
SECTION 1. That Section 6.15 of the City Code of the City
of Riverside, Missouri is hereby amended to read as follows:
6.15 ANTENNA FACILITIES, INSTALLATION OF, PENALTIES FOR
VIOLATION.
Section 1. An antenna facility may be installed after the
property owner obtains a special permit from the Planning
Commission. Such special permit may be issued only if the
proposed installation meets the following requirements:
(1) The antenna is not located on the roof of a
residential building or accessory building.
(2) The antenna does not exceed eight (8) feet in height.
(3) The antenna is located in the rear yard provided that
on corner lots, the antenna cannot be closer to the
side street than the main building located on the lot.
(4) All parts of the antenna and supporting structure
shall be a minimum of thirty-five (35) feet in
distance of any rear or side property line.
(5) The antenna and its supporting structure shall meet
the applicable code requirements set forth in the
Uniform Building Code as adopted by the City of
Riverside, Missouri.
(6) The antenna and its supporting structure must be
constructed of a material and of a color to minimize
visibility.
Section 2. As used in this Ordinance, the term "antenna"
shall include but not be limited to satellite dish receive-only
antennas, signal transmission antennas, amateur radio antennas,
satellite master antenna systems, and any other antenna
facilities.
Section 3. Anyone who owns or maintains any building or
premises on which an antenna facility is located in violation
of the terms of this Ordinance shall be guilty of a misdemeanor
punishable by a fine of not less than Ten Dollars (10.00) nor
more than Five Hundred Dollars ($500.00) for each and every day
that such violation continues or by imprisonment for up to ten
(10) days for each and every day such violation shall continue
or by both such fine and imprisonment in the discretion of the
Court.
