HomeMy WebLinkAbout2017-04-20 Planning & Zoning Commission Packet 1 MINUTES REGULAR MEETING PLANNING AND ZONING COMMISSION RIVERSIDE, MISSOURI Thursday, March 9, 2017 6:30 p.m. The Planning and Zoning Commission for the City of Riverside, Missouri, met in regular session at Riverside City Hall, 2950 NW Vivion Road, Riverside, Missouri. The meeting was called to order at 6:30 p.m. Answering roll call were Stephen King, Ray Uhl, Harold Snoderley, Mike Lombardo, Nathan Cretsinger, Al Bowman, Steven Kaspar and Mike Soler. Also present: City Planner Sarah Wagner, Community Development Assistant Rhonda Smith and Roger Schlotzhauer, Welds Supply. Members absent were Mayor Kathy Rose. Approval of Minutes of January 26, 2017. Commissioner Bowman moved to approve the minutes of January 26, 2017, seconded by Commissioner Uhl. Motion passed 8-0. Public Hearing – Special Use Permit 4110 NW Helena Chair Stephen King opened the public hearing at 6:30 pm. City Planner Sarah Wagner gave a brief report stating that Yanfeng USA, located at 4110 NW Helena, had applied for a special use permit for outdoor storage. The special use permit was requested since the stored items would not be adjacent to the building. The stored items would be located in the back employee parking lot that abuts the levee. Commissioner Kaspar asked if the diagram on the represented slide indicated that amount of space request by the company. City Planner Wagner replied that the company had only requested 5,000 square feet for storage but were allowed up to 24,000 square feet. Commissioner Kretsinger asked if the area near the levee for the storage was part of the trail system. City Planner Wagner said that part of the levee was not part of the trail system. Commissioner Soler wanted to know if the dumpsters were included in the amount of square footage requested by Yanfeng. City Planner Wagner said the dumpsters were included in the 5,000 square footage requested. Commissioner Kretsinger asked if Yanfeng would provide screenings to the south of the storage area so the storage would be hidden from potential property owners. City Planner Wagner said currently there was no road access for the public in that area but the Commission could request screenings to the south of the storage area. Commissioner Frakes asked how long Yanfeng had been utilizing 2 outdoor storage and dumpsters without a permit. City Planner Wagner said the City was waiting until new Planned Development regulations for outdoor storage were approved before giving companies notice of violations. Assistant Fire Chief Payne noted that that he had recently met with Yanfeng officials and the plant was changing the manufacturing process which would result in the need for fewer dumpsters. Commissioner Kretsinger asked why the storage was not adjacent to the building. City Planner Wagner said that Yanfeng said it was the best business practice for the storage to be away from the building. Commissioner King asked if the storage would be stacked only as high as four containers and would it be secure. Assistant Fire Chief Payne replied the containers would only be stacked four high and were secured with steel spindles. Commissioner Soler asked if the Special Use Permit would be formally reviewed in one year. City Planner Wagner said the Commission could set any stipulations for the Special Use Permit and that it can be revoked at any time. Commissioner King asked if a one year review could be applied to all applicants. City Planner Wagner said a one year review could be part of the special use permit with the ability to extend at the end of one year. Commissioner Soler said he felt strongly about including the one year review to cut help cut down on abuse of the outdoor storage regulations. Commissioner Bowman asked that the special use permit be issued to the applicant and the land owner so the permit would be terminated if the applicant vacated the building. Chair Stephen King closed the public hearing at 6:51 pm. Commissioner Uhl moved to recommend approval of the Special Use Permit for 4110 NW Helena with the condition that the permit be reviewed in one year and only be pertinent for the applicant, seconded by Commissioner Soler. Motion passed 6-0, with Commissioners Bowman and Cretsinger abstaining from the vote. Public Hearing – Special Use Permit Welds Supply 5654 NW River Park Drive Chair Stephen King opened the public hearing at 6:52 pm. City Planner Sarah Wagner gave a brief report. She explained that the requested area is out of Planned Development area and is zoned as an industrial zone. The applicant has requested storage for equipment from Capital Electric that is currently being displaced by their modular office buildings and from other offices being consolidated regionally. Capital Electric does not plan to have new offices completed until 2019 and they currently have two special use permits for the equipment storage 3 General Discussion area and the modular buildings. Commissioner Bowman asked if the storage area would be for equipment only. Roger Schlotzhauer from Welds supply said the area would be for equipment only. Commissioner King asked about the height of the equipment and the size of the screening. Schlotzhauer replied that the equipment was less than 15 feet high and the screening would be 12 – 15 feet high Commissioner Kaspar noted that when Capital Electric first approached the Commission about the first special use permit for equipment storage, the superintendent said that it was his goal for the equipment to be gone eventually. With the regional consolidation, the equipment has become and eyesore. Commissioner Cretsinger asked what would happen if the additional storage was not allowed at Welds Supply. Schlotzhauer noted that storage at nearby facility is more cost effective for Capital Electric. Commissioner Kaspar noted that if the special use permit was not allowed that Capital Electric would have to relocate the equipment to a off-site area and it would be harder for the company to do business in Riverside. Schlotzhauer noted that convenience is a factor for Capital Electric to utilize his property. Commissioner Snoderley asked if the equipment storage area was a hard surface and wanted to know if the screening would higher than the equipment. Schlotzhauer noted that the area was a hard surface and the screening would be a 9 foot painted galvanized material Commissioner Soler requested a one year review to be consistent with other special use permits. Commissioner Snoderley requested that the review coincide with the Capital Electric modular building special use permit review. Vice Chair King closed the public hearing at 7:12 pm. Commissioner Frakes moved to recommend approval of the Special Use Permit Capital Electric 440 NW Mattox Road with the condition that the permit be reviewed in one year and again to coincide with the Capital Electric modular office special use permit, Seconded by Commission Snoderly. Motion passed 6-1, with Commissioner Bowman abstaining from the vote. City Planner Wagner presented a picture of US Farathane which is out of compliance with their special use permit conditions. Wagner asked for clarification of the amount of pallets allowed. The permit currently states two rows not more than 10 feet tall. The Commission clarified their intent of the special use permit. Commissioner Kaspar asked if the language can be amended on the special use permit to clarify the exact amount of pallets allowed if US Farathane disagrees. Wagner said the 4 Adjourn language could be amended. Commissioner Bowman moved to adjourn at 7:14 p.m. Commissioner Uhl seconded and the meeting was adjourned 8-0. ____________________ Rhonda Smith Community Development Page 1 of 1 City of Riverside Staff Analysis Report Case Number PC17-04, Special Use Permit 2703 NW Platte Road (Funeral Home) General Information Applicant: Royal Funeral & Cremation of KC, LLC. Location: 2703 NW Platte Road Requested Action: To consider a Special Use Permit (SUP) to allow a funeral home Zoning: C-1 Commercial Previous Use: Insurance Office Proposed Use: Funeral Home Procedure: In accordance with Section 400.410 of the Unified Development Ordinance (UDO) a special use permit is required for a funeral home in the C-1 Commercial Zoning District. Therefore, the procedure for a special use permit is a public hearing before the Planning Commission and the Board of Aldermen after notification has been given in a paper of general circulation at least 15 days before the hearing date and property owners within 185’ of the subject property have been notified of such hearing. These requirements have been fulfilled on this application. Project Description The applicant is requesting a Special Use Permit pursuant to Chapter 400.410 of the Riverside Municipal Code regulations to allow a funeral home at 2703 NW Platte Road. The applicant currently has a business license for an office at this location. However, the Missouri State Board of Embalmers and Funeral Directors does not license just an office. They have four license classifications. The applicant is applying for a Function D establishment license from the state that gives the authority to conduct visitations and funeral ceremonies only. A Function D license is dependent upon and shall be operated under the supervision and ownership of a Function C establishment. A Function C establishment shall have the authority for the care a preparation of dead human bodies, other than by embalming or cremating, authority to transport dead human bodies to and from the funeral establishment, make funeral arrangements, and furnish any funeral services in connection with the disposition of dead human bodies or the sale of funeral merchandise. Therefore, the applicant is requesting a SUP for a funeral home for the purpose of obtaining their State of Missouri Function D license. Analysis The State requires that each Function D establishment have restrooms, available drinking water, and an area where funeral ceremonies or visitations may be conducted. The current space is has a 50 person occupancy load which would require the establishment to have a minimum of 13 parking spaces. The location is in a strip mall with shared parking which is adequate for this request. If the Planning Commission recommends approval of this SUP to the Board of Aldermen staff requests it be contingent upon state of Missouri approval and that the holder of the Function C establishment license be listed as a co-applicant on the special use permit and business license application.
