HomeMy WebLinkAbout1986-51 - Amendments to Section 17.4 of the Municipal CodeBILL NO. ~'6'S1 ORDINANCE NO. 8E-51 AN ORDINANCE AMENDED CODE SECTION 17.4 WITH REGARD TO THE BOND REQUIRED FOR HAULING PERMIT AND FURTHER AMENDING CODE SECTION 17.4 TO INCREASE THE PENALTIES FOR VIOLATION OF SAID ORDINANCE. WHEREAS, extensive damage has resulted to the City's streets recently be vehicles hauling for the purpose of filling within the City, and WHEREAS, the existing bond in Code Section 17.4 does not begin to cover the damages to the City's streets, and WHEREAS, improvements on the City's streets are threatened by the hauling activities. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1. Code Section 17.4 G shall be amended to read as follows: "BOND REQUIRED. A bond shall be required of every person securing said permit in the amount shown herein by a cashier's check: a. 1 to 5 round trips in a 30 day period with a licensed weight of 48,000 pounds, the bond shall be $1,500.00. r b. More than 5 round trips in a 30 day period with. a licensed weight of 73,000 pounds, the bond shall be $50,000.00. It shall be the responsiblity of the applicant to satisfy the City as to the licensed weight of the vehicles that will be using the streets and the number of trips that will be required. In the event vehicles of different licensed weights are used then the rate applied shall be the maximum rate of the largest licensed vehicle that is used. In the event damage shall occur or deposit of any substance on the streets, the applicant shall be given 2 notice, certified mail, at the address shown on the application of the same damage. In the event he shall, within five (5) days, notify the City that he desires a hearing before the Board of Aldermen, the City will have a hearing to determine the responsibility for the damage. The cost of repair of any damage or the cost of removal of any deposits or substance placed on the streets shall be deducted from the bond.- All permits shall be issued by the Board of Aldermen.." SECTION, 2. Code Section 17.4 H shah. be amended to read as follows: "PENALTIES FOR VIOLATION. Any violation of this ordinance shall be punishable by fine not in excess of $500.00 or by jail sentence not in excess of three months or by both fine and jail sentence."
