ORDINANCE N0. 85-4
AN ORDINANCE REGULATING AND PROHIBITING THE PARKING AND
STORAGE OF TRACTORS, TRUCK-TRACTORS AND TRAILERS WITHIN THE
CITY OF RIVERSIDE, MISSOURI.
WHEREAS, within the City of Riverside there are parked and
stored tractors, truck-tractors, and trailers on the public
streets and on private property near public streets and in
areas within the City zoned residential and,
WHEREAS, the parking and storage of trucks, truck-tractors,
and trailers creates traffic congestion and constitutes a
traffic hazard in that the vision of persons operating other
motor vehicles is obstructed at intersections of the streets
within the City and the shoulders of the highways within the
City are unavailable for emergency use because of the parking
and storage of trucks, truck-tractors, and trailers within the
City, and
WHEREAS, the parking and storage of trucks, truck-tractors,
and trailers creates traffic congestion and constitutes a
traffic hazard within the residential areas of the City and
further depreciates the property values and the aesthetics of
the residential areas, therefore,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE AS FOLLOWS:
Section I. DEFINITIONS: For the purpose of this
Ordinance, the following definitions apply:
Tractor and Truck-Tractor are defined as a self-propelled
motor vehicle designed for drawing other vehicles, but not for
the carriage of any load when operating independently. When
attached to a semi-trailer, it supports a part of the weight
thereof;
Trailer is defined as any vehicle without motive power
designed for carrying property or passengers on its own
structure and for being drawn by self-propelled vehicle, except
those running exclusively on tracks, including a semi-trailer
or vehicle of the trailer type so designed and used in
conjunction with a self-propelled vehicle that a considerable
part of its own weight rests upon and is carried by the towing
vehicle.

Section II. PARKING PROHIBITED IN COMMERCIAL OR INDUSTRIAL
AREA: No owner or operator of any truck, truck-tractor, or
trailer shall store or park his truck, truck-tractor or trailer
for a period exceeding twenty-four (24) hours.
Section III. APPLICATION OF THE ORDINANCE TO BUSINESSES:
Notwithstanding any other provision of this ordinance, the
owner or operator of any business with a valid business license
may park his own trucks or trucks under his control on his
property or on property leased for said business in connection
with the operation of that business for a period longer than
twenty-four (24) hours.
Section IV. PARKING PROHIBITED IN RESIDENTIAL AREA: It
shall be unlawful to store or park for a period exceeding
twenty-four (24) hours a truck, truck-tractor, or trailer upon
any street or parts of streets in an area of the City zoned
residential except that such vehicles may be stored or parked
thereon for the purpose of delivering or picking up materials
or merchandise and then only by entering such street at the
intersection nearest the destination of the vehicle and
proceeding thereon no farther then the nearest intersection
thereafter.
Section IV. PENALTY: Any person violating any of the
provisions of this Ordinance shall on conviction be subject to
a fine not exceeding Five Hundred Dollars ($500.00) or by
imprisonment in the City Jail or Platte County Jail for a
period not exceeding Ninety (90) days or by both such fine and
imprisonment in the discretion of the Court.
Section V. EXISTING ORDINANCE NOT REPEALED: Nothing in
this Ordinance shall be construed to amend, modify, or repeal
Ordinance 19.1203.
Section VI. SEVERABILITY: If any section, subsection,
provision, paragraph, sentence, clause, or phrase of this
ordinance shall be declared invalid for any reason whatsoever,
such decision shall not affect the remaining portions of this
ordinance which shall remain in full force and effect; and to
this end the provisions of this ordinance are hereby declared
to be severable.
