HomeMy WebLinkAbout1985-35 - Amendments to Sections 3.13 and 3.36 of the Municipal CodeBILL NO. 85-35 ORDINANCE NO. 85-35 AN ORDINANCE AMENDING SECTION 3.13 OF THE CODE OF THE CITY OF RIVERSIDE RELATIVE TO EMPLOYEE PERMITS FOR THE SALE OF ALCOHOLIC BEVERAGES AND SECTION 3.36 OF THE CODE OF THE CITY OF RIVERSIDE RELATIVE TO POSSESSION OF ALCOHOLIC BEVERAGES BY A MINOR. WHEREAS, there has been a change in Missouri statute allowing persons 18 year of age and older to serve alcoholic beverages under certain conditions, and WHEREAS, the City desires to have its ordinances remain consistent with the state statute. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. Section 3.13 is amended to read as follows: EMPLOYEE PERMIT. All persons employed in the establishment having an all inclusive or beer license shall be 21 years of age or older and must obtain a permit to do so from the Liquor Commission or the Director of Public Safety if such authority be delegated to him. Provided however, in those establishments having an all inclusive or beer license and which sell food for consumption on the premises and which the percentage of all sales of food on the premises consist of at least 50~ of all sales then in that event persons 18 years of age or older may act in the capacity of a waiter or waitress, accept payment for or serve intoxicating liquor or non-intoxicating beer, provided however, nothing in this section shall authorize persons under 21 years of age to mix or serve across the bar intoxicating beverages or non-intoxicating beer. Provided further, in all businesses where at least 50~ of the gross sales consist of goods, merchandise or commodities other than intoxicating liquor or non-intoxicating beer in the original package, persons at least 18 years of age or older may stock, arrange displays, accept payment for, and sack for carryout intoxicating liquor or non-intoxicating beer. All applicants to procure such a permit shall be fingerprinted by the police department and furnish to said police department an identifying photograph in duplicate of the person to be employed. Such applicant shall pay the sum of $7.00 for such permit. If such permit card becomes lost before the date of expiration, another card will be issued upon application and the sum of $1.00 is paid. Section 2. Section 3.36 shall be amended to read as follows: PURCHASE OR POSSESSION BY MINOR. No person under the age of 21 years shall purchase, attempt to purchase or have in his possession, any intoxicating beverage as defined under this ordinance. Provided however, a person 18 years of age or older employed in a business where at least 50$ of the gross sales made consist of goods, merchandise, or commodities other than intoxicating liquor or non-intoxicating beer in the original package, may possess intoxicating liquor or non-intoxicating beer to the extent that it is necessary to possess the same to stock, arrange displays, accept payment for, and sack for carryout intoxicating liquor or non-intoxicating beer and provided further, persons 18 years of age or older may be in possession of intoxicating liquor or non-intoxicating beer to the extent that it may be necessary when acting as a waiter or waitress to serve intoxicating liquor or non-intoxicating beer only in those places which sell food for consumption on the premises in which at least 50~ of all sales consist of food. Section 3. The City Clerk is directed to make the necessary changes in the Code book. PASSED THIS 6th. day of August , 1985.
