HomeMy WebLinkAbout1984-31 - Alcohol Related Traffic OffenseBILL NO. 84-31 ORDINANCE NO. 84-31 AN ORDINANCE REQUIRING THE MUNICIPAL COURT TO ENTER JUDGMENT OF TWENTY SIX DOLLARS ($26.00) AGAIN A DEFENDANT WHO IS CONVICTED OF AN ALCOHOL RELATED TRAFFIC OFFENSE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. The Municipal Court of Riverside, Missouri, shall enter a judgment of Twenty-Six Dollars ($26.00) against a defendant who is convicted of an alcohol related traffic offense, whether upon a plea of guilty or after trial. The judgment against the defendant will be in favor of the State of Missouri, and the clerk of the Court processing such funds shall pay the Missouri State Treasury the sum of Twenty-Five Dollars ($25.00) to the Crime Victim's Compensation Fund and shall withhold One Dollar ($1.00) to defray expenses incurred in handling such funds. Section 2. As used in Section 1 of this Ordinance, the term "alcohol related traffic offense" means those offenses hereinafter enumerated: a. The offense of driving while intoxicated, consisting of a person operating a motor vehicle in the City of Riverside, Missouri, under the influence of alcohol, a controlled substance or drug, or any combination thereof. b. The offense of driving with excessive blood alcohol content as defined in Ordinance No. 75-37 of the City of Riverside, Missouri. PASSED THIS 4th DAY OF 19 4.
