HomeMy WebLinkAbout1983-09 - Submission to Voters of Fireworks Sales FeesBILL N0. 83-9 ORDINANCE N0. 83-9 AN ORDINANCE AUTHORIZING SUBMISSION TO THE VOTERS OF THE CITY OF RIVERSIDE, MISSOURI, THE QUESTION OF WHETHER THE OCCUPATIONAL LICENSE FEE FOR SALES OF FIREWORKS SHALL BE RAISED, AND MAKING SUCH RAISE EFFECTIVE UPON APPROVAL OF A MAJORITY OF THE VOTERS. WHEREAS, the City of Riverside, Missouri (hereinafter "City"), for the purpose of promoting the general welfare of the City's citizens, finds it desirable to raise the occupational license fee for certain sales of fireworks; and WHEREAS, the Missouri Constitution requires that a majority of qualified voters of the City, voting upon the questions, approve any increase of the current levy of an existing license fee above the current fee authorized by ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1: In consideration of the premises hereof, the question of whether the occupational license fee for all sales of fireworks within the City shall be submitted to the voters of the City for their approval at a municipal election to be held in the City on Tuesday, the 5th day of April, 1983. Section 2: The question to be submitted at said election shall appear on the ballet in the following form: "Shall the City of Riverside, Missouri, raise the occupational license fee for all sales of fireworks within the City to $1,000.00 per year? YES NO" Section 3: Notice of the municipal election and submission of the aforementioned question shall be sent to the County Clerk of Platte County, Missouri, for publication in accordance with law, and shall be in substantially the following form: NOTICE OF MUNICIPAL ELECTION City of Riverside, Missouri Notice is hereby given to the qualified voters r of the City of Riverside, Missouri, that a municipal election will be held on Tuesday, the 5th day of April, 1983, commencing at 6 o'clock a.m. on said day and continuing until 7 o'clock p.m. on said day. At this election the question of whether the City of Riverside, Missouri, shall raise the occupational license fee for all sales of fireworks within the City of Riverside shall be submitted for approval of the voters, the ballot for which shall be in substantially the follow- ing form: "Shall the City of Riverside, Missouri, raise the occupational license fee for all sales of fireworks within the City to $1,000.00 per year? YES NO Said election shall be held at the following polling places within the City: Riverside City Hall 4500 High Drive Riverside, Missouri By order of the Board of Aldermen of the City of Riverside, Missouri, this lst day of Feb 1983. s/ Bett Burch city C er City of Riverside, Missouri Section 4: The City Clerk of the City is hereby directed to cause a certified copy of the aforementioned Notice to be received by the County Clerk of Platte County, Missouri, no later than 5:00 p.m. on February 15, 1983, and to perform such further acts as may be required by law to submit the afore- mentioned question to the voters of the City for their approval at the municipal election. Section 5: If a majority of the qualified voters of the City voting at said election on said question shall vote in favor of raising the occupational license fee for sales of fireworks within the City to $1,000.00 per year, then such license fee shall, upon certification of the election returns on said question, shall immediately become binding and be in full force and effect as same is provided for in Ordinance No. g3_9 of the City.
