ORDINANCE N0. 83-34
AN ORDINANCE ESTABLISHING A NEW ZONING DISTRICT DESIGNATED LIGHT
INDUSTRIAL, PROVIDING REGULATIONS FOR SAID DISTRICT, PROVIDING
PERMITTED AND SPECIAL USES FOR SAID DISTRICT, AND PROVIDING
CRIb4INAL PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE AS FOLLOWS:
SECTION 1. Section 13.200 shall be amended to add the following
language:

13.305 Light Industrial District
A. Intent - This District is intended for warehousing,
assembling and ~~.ervice industries which characteristically
produce a finished product from semi-finished materials,
but do not require outside storage. The effect of the
production process upon surrounding areas is limited to
traffic generated by customers, employees and the receipt
and delivery of goods and materials. Noise, smoke, odor,
dust, traffic and landscaping regulations shall be strictly
maintained.
B. Permitted Uses - The listing of permitted uses is set out
in Appen ix A" of these regulations.
C. Special Permit Uses - The listing of special permit uses
is set out in Appendix "A" of these regulations.
D. Intensity of Use Regulations
1. All operations shall be conducted within a fully
enclosed building.
2. D4inimum lot width: 75 feet.
3. All storage of materials, products or equipment
shall be within a full enclosed building or in an
open yard so screened that the materials or equipment
stored are not visible within 100 feet or from any
highway or interstate highway.
E. Height Limitations
1. Maximum height of structure: 35 feet or 3 stories
(whichever is smaller).
F. Yard Regulations
1. Minimum front yard: 30 feet measured from property
line.
2. P~linimum Side Yard: 20 feet for any building or
structure.
3. Minimum rear yard: 15 feet.
Exception: 50 feet when abutting any residential
district.
G. Parking and Loading Regulations - See Section M.
H. Landscaping and Screening Regulations - See Section 0,
Subsection 7.
I. Si ns - All signs must comply with the provisions of 13.306
t~gh 13.399.
J. Use Limitations
1. Smoke or particulate matter - No use shall be permitted
or shall be operated to permit smoke or particulate matter
to be discharged.
2. Dust, radiation, glare, etc. No use shall be permitted
or shall be operated which cause dust, fly ash, radiation,
or heat beyond the property line. In the event that dust
flash, radiation gas or heat is to be emitted then the
applicant shall submit a detailed plan describing in what
manner said dust, radiation, glare, etc. will be controlled.

No glare which is offensive or injurious shall be permitted
beyond the property line.
3. Vibration and concussions. No use shall be permitted
or shall be operated which shall cause vibration or con-
cussion perceptible without instruments beyond the property
line.
4. Noise level - No use shall be permitted or shall be
operated which shall exceed 75db beyond any building on
the property.
5. Industrial waste - No use shall be permitted which
shall cause industrial processes or waste which shall be
of such a quantity or nature as to cause damage to the
public sewer or the treatment facility or to overburden
the existing public or private sewage disposal facilities
or to cause odor or unsanitary effects beyond the property
line. No toxic or flammable or hazardous materials shall
be deposited in the sewer. The applicant shall submit a
sewer treatment plan together with the application.
6. Drainage - No use shall be permitted or shall be
operated which shall not provide for adequate and sufficient
drainage. The applicant shall at the time of his application
submit a drainage plan together with the application in
sufficient detail to determine that there is adequate
water drainage and storm sewers.
7. Toxic or Hazardous Waste or Explosives - No use
shall be permitted which manufactures or stores toxic,
hazardous or explosive products.
K. Additional Use Limitations
1. All outdoor trash containers and dumpsters shall be
properly screened within solid wall enclosure.
2. No building shall be used for residential purposes.
3. Industrial subdivisions shall meet any additional
requirements contained in the "Industrial Subdivisions"
of the Riverside, Missouri Subdivisions Regulations as
they now exist or may be hereinafter enacted.
L. Accessor Building - No accessory buildings shall be
permitte~.

b4. Off-Street Parking Regulations
1. Number of provided spaces - Each establishment shall
provide parking space of a finished hard surface material
(concrete or asphalt) equal to one space for each two
employees or one space for each 1,000 square feet whichever
is greater. In addition, each establishment shall provide
sufficient off-street parking space for all employees,
customers, visitors and others who spend time at the
establishment.
2. Allotted space - In addition to the provided space for
parking, there shall be allotted space for each establishment
equal to one parking space for each 300 square feet of
floor area or one parking space for each employee, which-
ever is greater.
Exception: Where more than one (1) working shift is
anticipated then there shall be one (1)
allotted parking space for each 300
square feet of floor area or one (1)
parking space for each employee based
on the largest working shift in any
24 hour period.
This allotted space may be used as a green area and
landscaped pending the requirement of its use as provided
parking space. Not to be included in the 15o minimum parking.
3. Utilization - Required accessory off-street parking
facilities provided for the uses hereinafter listed shall
be solely for the parking of motor vehicles in operating
condition of patrons, occupants, or employees of such uses.
4. Accessory Use - Off-street parking shall be considered
accessory to the use for which the parking is provided.
Parking not located on the same tract on which the main
use is located must be located within the zoning district
in which parking or storage lots are permitted as a main
use; or be located in accordance with the provisions of
this article relating to off-street parking special
uses.
In no instance shall off-street parking required by this
article be located more than 300 feet from the use which

it serves and must be on the same plot as the building
or establishment.
Exception: Shopping centers containing 30,000 square
feet or more gross leasable floor area
where joint parking is provided.
5. Repair and Service - No motor vehicle repair work
or service of any kind shall be permitted in association
with any off-street parking facility.
6. Determination of required number of spaces
a. Fractional spaces - When determination of the
number of off-street parking spaces required by
this regulation results in a requirement of a
fractional space, the fraction of 1/2 or less may
be disregarded, and a fraction in excess of 1/2
shall be counted as one parking space.
b. Floor area - Floor area, when used as a measure-
ment for determining the number of parking spaces
for office, merchandising or services used, shall
mean the gross floor area used, or intended to be
used for service to the public as patrons or
patients, including areas occupied by fixtures
and equipment used for display or sale of merchandise.
7. Voluntary provision - Any off-street parking lot not
required by the provisions of this articles but which is
voluntarily provided shall observe all requirements of
this article in the development of such parking area.
8. Screening - Any off-street parking lot of five or
more spaces shall be screened when abutting a residential
lot or institutional use as required in Section 0-subsection
7 "Landscaping and Screening Regulations" of this ordinance.
9. Parking structures - Parking space provided in an
enclosed or semi-enclosed structure shall not project
beyond any required building line.

10. Expansion or change in use requires parking adjust-
ment - tiVhere there is an enlargement to any building to
an extent of excess of twenty-five percent (25%) of the
floor area of the existing building or structure or
there is a change in use of the lot, building or
structure, the off-street parking requirements shall
meet the requirements of the expanded or new use. In
no case shall such a change or expansion of use be
permitted that cannot provide the number of off-street
parking or loading spaces required in this Article.
N. Front Yard Parking Setbacks
1. No parking shall be permitted within ten (10) feet
of a public street right of way.
2. Residential buffer required - Off-street parking
space in a business or industrial district shall not
be located nearer than the building line setback
requirements to any residential district and shall
be screened in accordance with Section 0-subsection 7
"Landscaping and Screening Regulations" of this ordinance.
3. Parking facilities for handicapped - Parking
facilities shall be provided for the physically
handicapped for all industrial establishments used
by the general public, employees or visitors.
a. Spaces required - One (1) handicapped parking
space shall be required for each business identified
by above grade signs as reserved for physically
handicapped persons. Each reserved space shall
be at least twelve (12) feet wide.
b. Location - Parking spaces for the physically
handicapped shall be located as close as possible
to elevators, ramps, walk-ways, and entrances.
Parking spaces should be located so that the
physically handicapped persons are not compelled
to wheel or walk behind parked cars to reach
entrances, ramps, walk-ways and elevators.

c. Curbs - Where a curb exists between a parking
lot surface and a sidewalk surface, an inclined
curb approach or a curb cut with a gradient of
not more than four (4) feet shall be provided
for wheelchair access.
0. D4inimum Requirements for Layout and Design
1. Design Standards
a. Off-street parking spaces for passenger cars
shall comply with the design standards relating
to curb length, stall depth, driveway width,
island width, barriers, and ingress and egress
as contained in the Off-Street Parking Standards
of this Article.
b. Twenty-five percent (25%) of the required off-
street parking spaces may be designed for compact
cars. Such spaces shall be grouped in one location,
identified by signs as reserved for compact cars
only and located reasonably close to building
entrances in order to encourage utilization.
When parking spaces for compact cars are utilized
then the square feet of required parking may be
reduced by 10%.
Compact off-street parking spaces shall comply
with the design standards contained in the
off-street parking standards of this article.
2. Surfacing - All open off-street parking and loading
areas shall be graded and paved with an approved concrete
or asphalt surface.
3. Lighting - Any off-street parking area providing
space for five (5) or more vehicles which are normally
used during the hours of darkness after 6:00 p.m.
shall be provided with lights that provide at least
an average of one-fourth (0.25) footcandle over the
entire parking area, measured on the ground surface
and arranged to minimize glare to motorists on public
streets and to residents of adjoining property.

4. Driveways - Ingress and egress for parking areas
providing space .for five (5) or more vehicles shall
be by means of driveways not exceeding thirty-five
(35) feet in width. Head-in parking from any public
right of way shall not be permitted.
5. Curbing - Curbing shall be provided for all streets
and in addition, curbing shall be provided around each
provided space for off-street parking.
6. Parking space - A parking space is defined as a
parking space of not less than 200 feet exclusive of
driveway, alley, street with temporary storage of one
automobile and connected with a street or alley by a
surface driveway which affords satisfactory ingress
or egress for automobiles.
A required off-street parking space shall be at least
8 feet 6 inches in width and at least 19 feet in length.
Each required off-street parking space shall open directly
upon an aisle or driveway of such width and design as
to provide safe and efficient means of vehicular access
to such parking space.
7. Landscaping and screening regulations - Each applicant
shall provide for 15 % of green area to include
sufficient landscaping to assure the aesthetic develop-
ment of the area. Each applicant shall file with his
application a detailed landscaping and screening plan
which shall be sufficiently definitive to describe the
type of landscaping and screening to be employed.
8. Building Profile Required - In addition to the above,
any applicant shall provide a detailed profile and plans
of the outside and inside of the building or structure
which shall be sufficiently definitive to assure the
aesthetic development of the area.
All buildings exterior shall be painted so that no un-
finished, uncolored, undecorated concrete wall that are
part of the building structure are visible from any road,
highway or interstate highway. Except unless this require-
ment be waived by the Board of Aldermen or Planning Commission.
No metal buildings shall be permitted.

P. Plans and A roval Re uired - Plans showing the layout
an esign o all require off-street parking and loading
areas shall be submitted to the Planning Commission and
approved by the Board of Aldermen prior to issuance of a
building permit. Before approving any parking layout,
the Planning Commission and Board of Aldermen shall
satisfy itself that the spaces provided are usable and
meet standard design criteria contained herein. In the
case of a use for which off-street parking requirements
are not specifically enumerated or mentioned, the require-
ments for off-street parking for a use which is similar
shall apply. Similarity is to be determined by the
Zoning Enforcement Officer. All required off-street
parking spaces shall be clearly marked on the plan.
Q. Occupancy=Certificate - All required parking spaces,
cT-`riving aisles, an access streets shall be constructed
prior to the issuance of any occupancy certificate. No
building shall be occupied prior to issuance of an
occupancy permit.
R. Special Permit Use
1. Districts permitter - In order to provide off-street
parking areas, the Board of Aldermen, after receiving
recommendations by the Planning Commission may grant
when there is a change of use of any existing building
or structure a special permit use.
2. Permit revocable - The Zoning Enforcement Officer shall
be responsible for the enforcement of the conditions and
requirements made by the Planning Commission or Board of
Aldermen in the approval of any off-street parking special
use. The Zoning Enforcement Officer, upon discovery of
any violation of this regulation or the conditions and
requirements established by the Commission, may notify
the Planning Commission and Board of Aldermen of violations.
The Zoning Enforcement Officer is hereby authorized to
revoke any and all permits for the following reasons:
a. Abandonment of the area for parking purposes for
six months.
b. Failure to comply with the requirements contained
in this section, or imposed by the Planning Commission
or Board of Aldermen.

3. Appeal - Appeals for a permit revoked for off-street
parking special use shall be made to the Zoning Board of
Adjustment in accordance with Article 13.710 of this ordinance
S. Additional Special Permit Uses - In the event a special
permit is require y any other provision of this ordinance
then no provision of this ordinance relative to light
industrial Section 13.305, Subsection A through Z shall
operate to prevent the requirement of such special permit.
Any special permit use in the light industrial zoning
area may require additional regulations which may be
enacted at the time of application.
T. Off-Street Loadin Re ulations - For every building,
structure or part t ereo intended or used for man-
ufacturing, warehousing, retailing, wholesaling or other
uses involving receipt or distribution of vehicles,
materials, supplies or merchandise, there shall be
provided and maintained on the lot adequate space for
standing, loading and unloading services.

No use permute in Districts 1 through 5 shall be a use
permitted in this district unless it is specifically included
within the permitted uses hereinafter set forth.
X. Other Provisions of the Zonin Order - All other provisions

met and complied with by the applicants. In the event that
there is a conflict between any portion of the Zoning Order
then the provision that are most strict, restrictive or
which imposes the highest standard shall be applicable.
Y. Criminal Penalt - Provisions of Section 13.715 shall be
applica le to t is ordinance and are hereby enacted.
"A. It shall be unlawful for any owner, lessee or tenant
of land to construct, reconstruct, alter, relocate or
maintain any building or other structure or use such
land in violation of any of the provisions of this Zoning
ordinance.
B. It shall be unlawful for any owner, lessee, or tenant
of land, having been served with an order in writing
signed by the Enforcement Officer to correct or remove
any violation, who shall fail to comply with such
order within 10 days after such service, or who shall
continue to violate any of the provisions of this
Zoning Ordinance named in such order or who shall
construct, alter or use and occupy any plot, building
or structure or part thereof in a manner not permitted
by an approved building permit or certificate of occupancy.
C. It shall be unlawful for the owner or general agent
of any land, building, structure or premises where a
violation of the provisions of this Zoning Ordinance
or order of the Enforcement Officer has been commuted

or shall exist, or the lessee or tenant of any entire
building or entire premises where such violation has
been committed or shall exist or the owner, general
agent, lessee or tenant of any part of the building,
or premises in which such violation has been committed
or shall exist, or the owner, general agent, architect,
builder, or contractor or any other person to knowingly
commit, take part or assist in such violation or to
maintain any building or premises in which any such
violation shall exist.
D. Each day that a violation continues shall be
deemed a separate offense."

existing Zoning Order the City of Riverside remain
in full force and effect and compliance is required
with Section 13.305 as well as all other provisions
of the Zoning Order. Provided, however, notwithstanding
the above, no use shall be permitted in District 6
except that specifically listed in Section 13.305 as
Appendix A which contain the permitted uses in light
industrial districts.
SECTION 2. The City Clerk is directed to make the applicable
change in the Code Book.
