BILL NO. 80-34 ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 12.7 OF THE CODE OF THE CITY OF
RIVERSIDE, MISSOURI AND SECTION 12.1 RELATIVE TO SALE OF FIRE-
WORKS AND FIREWORKS OCCUPATIONAL LICENSE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE, MISSOURI, AS FOLLOWS:
ARTICLE I. Section 12.7 of the Code of Riverside, D4issouri,
shall read as follows:
12.7 SALE OF FIREWORKS AND FIREWORKS OCCUPATIONAL LICENSE
Section 1. It shall be unlawful for any person, firm or
corporation to sell or offer for sale within the City limits
of Riverside, any fireworks unless such person, firm or corp-
oration shall have first obtained from the City Collector an
occupational license for the sale of such fireworks and shall
have paid to the City Collector the fee prescribed herein.
Section 2. It shall be unlawful for any person, firm or
corporation to sell any fireworks at any location which is not
zoned for retail business by the zoning ordinance of the City
of Riverside. It shall be unlawful for any person, firm or
corporation to sell fireworks without a valid sales tax number
or valid not-for-profit exemption.
Section 3. It shall be unlawful for any person, firm or
corporation to sell fireworks from a car or truck or in any
other manner than from either an existing building or from a
temporary or permanent stand.
Section 4. Any temporary stands erected for the purpose
of the sale of fireworks must be renewed following the end of
the period for which the license for the sale of such fireworks
is issued.
Section 5. The license for fireworks for any year shall
cover a period from June 20 until midnight July 5 and any retail
sales of fireworks during any other time of the year is hereby
prohibited.
Section 6. The fee for occupational license for the whole-
sale or retail sale of fireworks shall be determined as follows:
Five Hundred Dollars ($500.00) for a place of
business with less than 2,000 square feet total
of sales and storage area.
One Thousand Dollars ($1,000..00) for a place of
business with more than 2,000 square feet of
total sales and storage area.
In calculating the total square footage of sales and storage
area, all square footage enclosed within the walls of the
building or tent for which a license is sought shall be
included.
Section 7. Provided, however, the retail sale of fire-
works by non-profit or charitable organization shall be in
the amount of One Hundred Dollars ($100.00), provided, however,
said business shall not be more than 300 square feet total of
sales and storage area. In the event that a non-profit or
charitable organization exceeds in space 300 square feet of
sales and storage area then the fee for said sale shall be
determined pursuant to Section 6. There shall be no more
than five (5) non-profit licenses for charitable organizations
not situated within the City. There shall be no limit as to
the number of non-profit licenses for charitable organizations
situated within the City.
Section 8. A bond for One Hundred Dolla
(payable by separate check or bank draft) shall be100.00)
any applicant for an occupational license for the retaildsale
of fireworks which shall be refunded if and when any temporary
stand or building has been removed and the premises cleared
of debris or refuse accumulated as a result of such business
within five (5) days; if such stand or building debris or refuse
shall not be removed within such period, the bond shall be
forfeited.
Section 9. Violations of the terms of any section of
this ordinance shall be punishable by fine not to exceed One
Hundred Dollars ($100.00) or by imprisonment in the City jail
not to exceed 90 days or by both such fine and imprisonment
and costs and each day on which said offense shall occur shall
constitute a separate offense.
ARTICLE II. Section 12.1 with regard to fees for fireworks
stand shall be amended to read as follows:
Fireworks Stand - $500.00 with less than 2,000 sq. ft.
$1000.00 with more than 2,000 sq. ft.

ARTICLE III. The City Clerk is directed to make the
