AN ORDINANCE REGULATING THE FEES TO BE CHARGED FOR A BUILDING
PERMIT, DEFINING WHEN A BUILDING PERMIT IS REQUIRED, REGULATING
THE FEES FOR A REZONING PERMIT, REGULATING THE FEES FOR RENEWAL
OF A BUILDING PERMIT, REGULATING THE FEES FOR A SPECIAL USE
PERMIT, REGULATING THE FEES FOR A FLOOD PLAIN PERMIT, PROVIDING
FOR SEVERABILITY OF EACH ARTICLE OF THE ORDINANCE.

BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE, MISSOURI, AS FOLLOWS:
Section 1. Section 13.703 of the Zoning Order of the City
of Riverside, Missouri, shall be changed to read as follows:
13.703 Issuance of a Building Permit
A. No commercial building or structure shall be erected,
or constructed unless a building permit has been issued
by the City. ,
B. No commercial building or structure shall have any
altering or repair to the exterior (except repainting)
unless a building permit has been issued by the City.
C. No single family dwelling house shall be erected or
constructed unless a building permit has been issued
by the City.
D. No dwelling house shall be altered or repaired when
there is a change in bulk exteriorly unless a building
permit has been issued by the City.
E. No other building or structure shall be erected,
constructed, altered or repaired unless a building
permit has been issued by the City.
F. No new uses of building or land, no change in bulk
not involving buildings, and no change, enlargement
or relocation of use shall take place without a
building permit or change of use permit.
G. Applicants for building permits shall tender the
following fees for their application to the City

Building or structure - $300.00 up to 2,000 square feet
EXCEPT single family of floor area plus 5¢ per square
dwelling house. foot in excess of 2 ,000 square
feet of floor area (minimum
fee for building or structure
shall be $300.00)
No fee shall be required for any church or other
charitable organization to .build a building which
is to be used exclusively for church or charitable
activities.
Single family dwelling--5¢ per square foot.
Residential garages - $25.00 irrespective of other
provisions of this ordinance.
Change of Use - Building permit required but
no charge unless in the dis-
cretion of the Board of Aldermen
change of use shall necessitate
expenses to the City in which
case the Board of Aldermen shall
set the fee.
For the purpose of this section, floor area shall be
defined as follows:
Floor Area. The sum of the gross horizontal areas
o t e several stories of the building measured from
the exterior faces of the exterior walls or from the
center line of the party walls. Included shall be
any basement floor, interior balconies and messanines,
elevator shafts, stair wells, enclosed porches and
basement area, provided however, in residential
construction the basement areas shall not be computed
unless the same is to be living space. The floor
area of accessory uses and of accessory building,
except residential garages on the same lot shall be
included.
For the purpose of this section, Repair shall be defined
as follows:
Repair. Any alterations, reconstruction or conversion.

J. A sign permit is required for the erection, maintenance,
alteration and display of any sign.
K. Any grading or excavation in excess of Five Hundred
Dollars ($500.00) shall require a permit. The fee for
said permit shall be 2% of estimated cost.
L. No person shall install, nor shall any person alter
any underground storage facility for the storage of
petroleum products without a permit.
Such a permit shall be issued by the city engineer or
in his absence the city street commissioner. All
installations shall conform to the National Fire
Protection Association (N.F.P.A.) and to the
ordinances of the City of Riverside and shall be
constructed in accordance with good construction
policies. All repairs shall be made in accordance
with good construction policies and shall be carried
out in such manner as the city engineer or city
street commissioner may require to assure the
safety of the citizens of Riverside. No permit
for installation or repair shall be issued unless
the applicant shall first tender to the city
engineer or city street commissioner a plot plan
showing the location of the proposed underground
storage in relation to existing buildings and
existing property lines. The city engineer or
city street commissioner may require that officials
of the city fire department be present during the
installation and may further require the posting of
an appropriate cash bond to reimburse the city for
the expense incurred and to pay the firemen reasonable
wages for their presence during installation or repair.
M. Any permit not involving construction of a building
not otherwise specifically listed herein shall be
charged at the rate of $300.00.
N. A lication. An application for a building or grading
permit s all be made to the City Clerk on forms pro-
vided by the City.
0. A site development plan shall be required prior to
consideration of an application for a building permit.
,~ P. For extension or renewal of a building permit, $250.00.
Q. Applicants for a rezoning permit shall tender the fee
of $250.00.

Section 2. Section 13.107 shall be changed to read as
follows:
13.107 Form of Application
A. Such application for amendment shall be in writing
and shall be accompanied by a fee of $250.00 except
those recommended by the Mayor and Board of Aldermen
or Planning Commission, and shall contain the pro-
posed language of the Zoning Ordinance to be inserted,
a legal description and map of the property affected,
if affecting a change in the zoning map, together
with a complete legal description of any zoning
districts changed (i.e. a legal description of the
Zoning district as it would be constituted if the
zoning amendment were granted and a legal description
of the Zoning district from which the land was taken
as the same would exist if the amendment was granted;
together with such other information as the Board of
Aldermen shall require). Such application shall
contain, as shown on the most recent county tax
statement, the names and addresses of all property
owners of the frontage within one hundred eighty-
five (185) feet of the boundaries of the tract
proposed to be changed.
Section 3. Section 13.804 shall be changed to read as
follows:
13.804 Fees - Every application to the Planning Commission
for a special use permit shall be subject to a filing
fee of $150.00 which shall be in addition to any other
fees required by the Planning Commission. A special
permit issued pursuant to Section 13.815, Flood Plain
and Drainage Control, shall not be charged a fee for
renewal and shall automatically renew itself for
successive 12 month periods unless the Board of Aldermen
shall, in their discretion, require renewal of any
specific special use permit in the flood hazard area.
Section 4. If any section, paragraph, sub-division, clause,
phrase, or provision of this ordinance shall be adjudged invalid
or held unconstitutional, the same shall not affect the validity
of any other part of the code of the City of Riverside, Missouri.
In the event that any fee in this ordinance shall be declared
unlawful or shall not be upheld by any court, the fee to be
charged shall be the same as would have been charged prior to
the passage of this ordinance.
Section 5. The City Clerk is directed to make the requisite
