HomeMy WebLinkAboutR-2025-172 Executing a Quit Claim Deed Conveying Certain City-Owned PropertyRESOLUTION NO. 2025-172 A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A QUIT CLAIM DEED CONVEYING CERTAIN CITY-OWNED PROPERTY WHEREAS, during the course of the Missouri Department of Transportation's (MoDOT) improvements to the intersection of Route 9 Highway and NW Mattox Road, MoDOT reconstructed the former Burlington Creek bridge to provide a new access route serving the Aylett property, thereby eliminating Aylett's prior entrance directly onto Route 9;and WHEREAS, upon completion of the project, MoDOT transferred to the City certain portions of former right-of-way adjacent to the new intersection and bridge crossing, including the segment now designated as West Platte Drive; and WHEREAS, the area outlined in pink on the attached Exhibit A represents a remnant portion of that right-of-way that now functions solely as a private access drive serving the adjoining Aylett property and no longer serves any transportation or circulation purpose for the public; and WHEREAS, the property has no independent public utility or value to the City and its retention would impose ongoing maintenance obligations upon the City for pavement, vegetation, and drainage features without providing any municipal benefit; and WHEREAS, conveyance of this property to the adjoining landowner will eliminate unnecessary maintenance responsibilities, return the property to private ownership and taxation, and clarify access and title consistent with the intent of the MoDOT improvement project; and WHEREAS, the Board of Aldermen finds and determines that the property is surplus to the needs of the City, that it serves no continuing municipal purpose, and that conveyance of the property at nominal consideration is in the best interests of the City and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: THAT the Board of Aldermen hereby approves the Quit Claim Deed to Sam A. Aylett and Diana J. Aylett, a copy of which is attached hereto and incorporated herein as Exhibit B, and further authorizes the Mayor to sign the Quit Claim Deed on behalf of the City; and FURTHER THAT the Mayor, the City Administrator, and other appropriate City officials are hereby authorized to take any and all actions as may be deemed necessary or convenient to carry out and comply with the intent of this Resolution and to execute and deliver for and on behalf of the City all certificates, instruments, agreements, and other documents, as may be necessary or convenient to perform all matters herein authorized.
