R-2026-030 A RESOLUTION APPROVING CHANGE ORDER NO. 4 TO THE AGREEMENT WITH JULIUS KAAZ CONSTRUCTION COMPANY, INC. FOR VIVION ROAD TRAIL SEGMENT 1 RESULTING IN A REVISED CONTRACT AMOUNT OF $1,376,724.18 FOR SUCH PURPOSES WHEREAS, the City of Riverside ("City") issued an Invitation to Bid for the Vivion Rd Trail Segment 1 (Project No. TAP 3454[401]) ("Project") which was awarded to Julius Kaaz Construction Company, Inc. ("Julius Kaaz") pursuant to Resolution R-2025- 003; and WHEREAS, the Board of Aldermen finds that it is in the best interest of the City to approve Change Order 4 to the agreement with Julius Kaaz, resulting in a total revised contract amount not to exceed $1,376,724.18. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: THAT Change Order 4 to the Agreement between the City and Julius Kaaz, a copy of which is attached hereto and incorporated herein, is approved and the Mayor is authorized to execute the same on behalf of the City. The resulting revised total contract amount shall not exceed $1,376,724 .18. FURTHER THAT the Mayor, City Administrator and all other required city officials are authorized to take such other actions and/or execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents as may be deemed necessary or convenient to carry out and comply with the intent of this Resolution. This change order addresses overruns and underruns to complete the project as well as some drainage concerns that were found on the site walk- through. Included are the following items: Line 8: - More pavement marking quantity than needed was included by the design engineer. This reduces the quantity to the pavement marking installed. Line 9: This is the actual measured quantity of concrete trail installed. Line 10: This is the actual measured quantity of concrete driveway installed to ensure trail driveway crossings meet ADA. Line 12 & 13: Installation of sod was removed from the project in favor of using seed only. This accounts for the sod quantity being removed and that same area being added to the seed quantity. Line 18: It was determined that form liner would not be an effective treatment for the small wall so this deducts the remaining formliner from the project. Line 19: This is the actual measured quantity of the Type S curb. Curb not needed has been deducted. Line 20: This is the actual measured quantity of the Type CG-1 curb. Curb needed has been added. Line 21: Five of the anticipated utility adjustments were not needed and are being deducted. Line 32: Crosswalk striping is being added to account for the plans and bid form not clearly stating how crosswalk striping was to be measured. The crosswalk quantity on the bid form only accounted for the two horizontal lines without providing quantity for the piano bars. Since the plans show piano bars and did not state that they were subsidiary to the crosswalk measurement, this adjustment includes quantity for the piano bars. Line 33: This sign was not utilized for this project. Line 35: One of these signs was not used. Line 36: Some of the temporary fencing was not needed. Line 39: This is the actual asphalt quantity installed based on material tickets. Line 47: This extends the existing traffic control for to account for additional time needed that was not accounted for in CO2 (7 weeks). Additionally the time not covered from CO3 to the start date of the road repairs and the transition to new traffic control is included (5.5 weeks from 01/19-01/24). Lines 51-53 and Line 56 are all related to the damage to the north shoulder due to traffic running on the shoulder for the period of time that the south shoulder was closed. Line 51 - Demolition and removal of existing pavement and other items to prepare for concrete patch. Demoltion includes saw cut joints per MoDOT specification. Line 52 - Installation of MoDOT Type 5 road base. Line 53 - Installation of concrete pavement road patch, including dowel bars to match MoDOT specifications. Concrete mix to match MoDOT specifications and mix design was submitted and approved. Line 54 - Grinding of pavement to ensure smooth vehicle travel. Line 55 - Replacement of all disturbed pavement markings in the area. Line 56 - Joint sealant to meet MoDOT specifications. Line 57: This is the Contractor's request for remobilization to rework drainage concerns that were found on the site walk-through. Line 58: This removes the riprap shown on the drawings temporarily to add drainage pipe and the cast in place inlet. The rip rap will be replaced where it is needed. Line 59: This is to remove the previously existing end section on the west side of the driveway and the end section on the newly placed pipe by the retaining wall. This will allow the new pipe to fully connect the two existing pipes, creating positive for the area and AASHTO compliant slopes off the trail edge. Line 60: This new inlet will be installed on the east side of the driveway to assist with creating AASHTO compliant slopes off the side of the trail. Line 61: Installing this pipe between the driveway and the pipe by the retaining wall will allow for positive drainage, easier maintenance as compared to the existing conditions, and AASHTO compliant slopes. Line 62: This is the finish grading of the areas on the east and west side of the driveway where the drainage is going to be installed. Line 63: Hydroseeding for the area where the drainage is going to be installed. Line 64: The slope just east of the large retaining wall does not meet AASHTO standards. This will extend the fence to create a barrier between the trail and the slope that is steeper than 6:1. Time extension: The Contractor is requesting a time extension of 36 calendar days. The City affirms that this is a reasonable extension to account for the drainage improvements needed. From 2/19/26 (previous extension was through 2/18/26) through 3/26/26 time extension to allow for CO3 road repair work to start and additional drainage work. This is an extension of 36 days. After further discussion on-site, it was determined that it was not possible to slope the ditch at 3:1 with the existing conditions, without covering up the existing storm sewer under drive 3. The City of Riverside has requested a proposal with 3 options to remove the rip rap from the ditches, grading to ensure proper drainage and ADA compliance, add storm sewer pipe, as well as a 4’x4’ cast in place storm sewer structure. Pipe Requirements N-12 ST IB pipe (per AASHTO) shall have a smooth interior and annular exterior corrugations. • 4- through 10-inch (100 to 250 mm) pipe shall meet AASHTO M252, Type S or SP. • 12- through 30-inch (300 to 750 mm) pipe shall meet AASHTO M294, Type S or SP, or ASTM F2306. • Manning’s “n” value for use in design shall be 0.012. Joint Performance Pipe shall be joined using a bell & spigot joint meeting the requirements of AASHTO M252, AASHTO M294, or ASTM F2306. The joint shall be soil-tight and gaskets for diameters 12- through 30-inch (300- 750 mm), shall meet the requirements of ASTM F477. For diameters 4- through 10-inch, the joint shall be soil-tight using an engaging dimple connection. Gaskets shall be installed by the pipe manufacturer and covered with a removable, protective wrap to ensure the gasket is free from debris. A joint lubricant available from the manufacturer shall be used on the gasket and bell during assembly. Fittings Fittings shall conform to AASHTO M252, AASHTO M294, or ASTM F2306. Bell and spigot connections shall utilize a welded bell and valley or saddle gasket meeting the soil-tight joint performance requirements of AASHTO M252, AASHTO M294, or ASTM F2306. Material Properties Material for pipe and fitting production shall be high density polyethylene conforming with the minimum requirements of cell classification 424420C for 4- through 10-inch (100 to 250 mm) diameters, and 435400C for 12- through 30-inch (300 to 750 mm) diameters, as defined and described in the latest version of ASTM D3350, except that carbon black content should not exceed 4%. The 12- through 30- inch (300 to 750 mm) pipe material shall comply with the notched constant ligament-stress (NCLS) test as specified in Sections 9.5 and 5.1 of AASHTO M294 and ASTM F2306, respectively. Installation Installation shall be in accordance with ASTM D2321 and ADS recommended installation guidelines, with the exception that minimum cover in trafficked areas for 4- through 30-inch (100 to 750 mm) diameters shall be one foot (0.3 m) in single run applications. Backfill for minimum cover situations shall consist of Class 1 (compacted), Class 2 (minimum 90% SPD) or Class 3 (minimum 9 5% SPD) material. Waste CO2 can be put to a beneficial use as a feedstock in the production of concrete. The retrofit CarbonCureÔ Ready Mix Technology adds CO2 to concrete during mixing. The CO2 reacts with the cement and is mineralized to produce nanoscale calcium carbonate. The carbonate formation can impart positive impacts on the concrete. The CO2 addition (hereafter, CarbonCure) can improve hydration and increase compressive strength without affecting the fresh concrete properties. Uses CarbonCure is used to produce concrete mixes with higher compressive strength. CarbonCure is suitable for normal weight and light weight concrete in ready-mix applications. Concrete shall be designed in accordance with Standard Recommended Practice for Selecting Proportions for Concrete, ACI 211. Benefits The addition of CarbonCure to concrete mixes can realize benefits including: •Ability to improve both-early and late-age compressive strengths •Reduced variability of compressive strengths •Optimized binder designs •Concrete produced with reduced carbon footprint Guidelines for Use Dosage Rates: CarbonCure has a recommended dosage rate of 0.8 – 4.0 fl oz/cwt (50 – 250 g/100 kg) of cement (as distinct from total cementitious) for most applications. Dosages outside this range may be used if local testing shows acceptable performance. Pretesting is required to determine the appropriate addition rate for desired performance. The optimum addition rate may be influenced by other concrete mixture components, cement types, ambient temperature, mineral additives, quality and gradations of aggregates, slump of concrete, mixing equipment, job conditions, and desired performance characteristics Mixing: The optimum performance of the CarbonCure is generally obtained with a delayed addition following the start of mixing. Packaging and handling CO2 is available in bulk and delivered by tanker truck to an on-site pressurized storage tank for dispensing by means of the CO2 metering equipment. CO2 must have a certified purity of 99% or above for use in this application – certification of CO2 purity compliance shall be made available upon request. Dispensing Equipment CarbonCure is dispensed from a storage tank of liquid CO2 in communication with the dispensing control system. The tank and CO2 are sourced from a local industrial gas supplier. The dispensing control system is connected to the batching system and the CO2 addition is fully integrated into the batch sequencing of materials that are added to the mix. Producer data for production on a single mix design is presented for slump (Figure 1) and air content (Figure 2). The CarbonCure production data is presented against control limits for the mix when made without CO2. The average metric and variability of the fresh properties of the concrete made with CarbonCure was comparable to and consistent with the reference production. Compressive Strength An optimal dose of CarbonCure can improve the compressive strength of the concrete at both early and late ages. Industrial strength data of concrete produced with two different CarbonCure dosages is presented in Figure 3. Testing of the pore solution of concrete produced with CarbonCure was conducted at 28 days (Figure 4). The extracted pore solution was not affected by the CO2 addition. The action of CO2 in the earliest stages of hydration neither prevents nor impairs the later development of pore solution alkalinity. Since all cements and other concrete-making materials differ from source to source, and can vary over time, ongoing testing by the concrete producer is recommended for optimum CO2 system performance, especially when changes are made to the materials or batch sequencing. Materials shall be stored in such a manner to ensure proper ventilation and drainage, and to protect against damage, weather, vandalism and theft. 1.08 PRODUCT WARRANTY A. All structural fence components (i.e. rails, pickets, and posts) shall be warranted within specified limitations, by the manufacturer for a period of 20 years from date of original purchase. Warranty shall cover any defects in material finish, including cracking, peeling, chipping, blistering or corroding. B. Steel material for fence panels and posts shall conform to the requirements of ASTM A653/A653M, with a minimum yield strength of 45,000 psi (310 MPa) and a minimum zinc (hot-dip galvanized) coating weight of 0.60 oz/ft2 (184 g/m2), Coating Designation G-60. B. Material for pickets shall be .75" square x 18 Ga. tubing. The rails shall be steel channel, 1.5" x 1.4375" x 14 Ga. Picket holes in the rail shall be spaced (specify 4.675" o.c. for standard picket space or 3.500" o.c. for 3" air space). D. The manufactured fence system shall be capable of meeting the vertical load, horizontal load, and infill performance requirements for Industrial weight fences under ASTM F2408. E. Gates with an out to out leaf dimension less than and including 72 inches shall be fabricated using Montage Plus ornamental panel material and 1.75" sq. x 14ga. gate ends. Gate leafs greater than 72" shall be fabricated using ForeRunner rails, 17 gauge pickets, intermediate uprights, gussets and 1.75" sq. x 14ga. gate ends. All rail and upright intersections shall be joined by welding. All picket and rail intersections shall also be joined by welding. PART 3 - EXECUTION 3.01 PREPARATION All new installation shall be laid out by the contractor in accordance with the construction plans. 3.02 INSTALLATION Fence post shall be spaced according to Table 3, plus or minus .25". For installations that must be raked to follow sloping grades, the post spacing dimension must be measured along the grade. Fence panels shall be attached to posts with brackets supplied by the manufacturer. Posts shall be set in concrete footers having a minimum depth of 36" (Note: In some cases, local restrictions of freezing weather conditions may require a greater depth). The “Earthwork” and “Concrete” sections of this specification shall govern material requirements for the concrete footer. Posts setting by other methods such as plated posts or grouted core-drilled footers are permissible only if shown by engineering analysis to be sufficient in strength for the intended application. 3.03 FENCE INSTALLATION MAINTENANCE When cutting/drilling rails or posts adhere to the following steps to seal the exposed steel surfaces; 1) Remove all metal shavings from cut area. 2) Apply zinc-rich primer to thoroughly cover cut edge and/or drilled hole; let dry. 3) Apply 2 coats of custom finish paint matching fence color. Failure to seal exposed surfaces per steps 1-3 above will negate warranty. Ameristar spray cans or paint pens shall be used to prime and finish exposed surfaces; it is recommended that paint pens be used to prevent overspray. Use of non-Ameristar parts or components will negate the manufactures’ warranty. 3.04 GATE INSTALLATION Gate posts shall be spaced according to the manufacturers’ gate drawings, dependent on standard out-to-out gate leaf dimensions and gate hardware selected. Type and quantity of gate hinges shall be based on the application; weight, height, and number of gate cycles. The manufacturers’ gate drawings shall identify the necessary gate hardware required for the application. Gate hardware shall be provided by the manufacture of the gate and shall be installed per manufacturer’s recommendations. 3.05 CLEANING The contractor shall clean the jobsite of excess materials; post- hole excavations shall be scattered uniformly away from posts. Galvanized steel framework is subjected to a multi-stage pretreatment/wash (with zinc phosphate), followed by a duplex cathodic electro-coat system consisting of an epoxy primer, which significantly increases corrosion protection, and an acrylic liquid topcoat, which provides the protection necessary to withstand adverse weathering effects. The electro-coated surface on all Montage Plus welded ornamental panels and posts are guaranteed under normal and intended usage, against cracking, peeling, chipping, blistering or corroding commencing with the original purchase date and extending according to the applications defined in the table below. Normal and intended usage does not include physical damage, abrasion, or heavy salt spray exposure to the protective coating. THE FOLLOWING ACTS AND/OR OMISSIONS WILL VOID THE SUBJECT WARRANTY: • Damage to the product caused by the property owner by use of landscape, gardening equipment, chemicals that may cause damage, and/or water sprinklers with high mineral content; • Damage caused by adhesion of chicken wire, chain link mesh, welded wire, or other similar substance to the product; • Damage caused by allowing plant life of any sort to grow directly upon or in contact with any portion of the product or sap from trees; • Any alteration to the product itself by the property owner including any on-site cutting or welding; and/or, failure to follow any and all maintenance instructions provided by Ameristar® at the time of sale to the original purchaser even if these instructions are not forwarded to the ultimate claimant under this warranty. • When cutting Montage Plus immediately seal the exposed surfaces by 1) Removing all metal shavings from the cut area 2) Apply ing zinc-rich primer to thoroughly cover cut edge and drilled hole and, after letting dry, 3) Applying two (2) coats of custom finish spray paint matching fence color. Failure to seal exposed surfaces per steps 1-3 above will negate warranty. • If contractor uses non-Ameristar parts/components, this will negate the warranty. Ameristar Montage Plus welded ornamental fences are also guaranteed for the same period of time against defects in workmanship or materials. Should any Montage Plus welded ornamental panel or post manufactured by Ameristar fail in accordance with any of the above conditions, Ameristar warrants to the original purchaser their redemption through replacement, renewal or issuance of a pro-rated credit. The choice of redemption method is solely at the discretion of Ameristar. If the pro-rated alternative is chosen, the amount will be based on the original cost of materials at the date of purchase multiplied by the appropriate time and exposure factor from the table below: Notice of failure under the conditions of this warranty shall be sent to Ameristar or its authorized representative, in writing, together with proof of purchase and shall specify the nature of the defect and when it was first observed as well as photographs of current site conditions. Should the fence be improperly installed, Ameristar shall not be responsible for guaranteed performance or appearance of the material. Neither does this guarantee apply when failure or damage is due to improper use or application, abuse or misuse, salt spray exposure (see Table and Note above), vandalism, or acts of God. Ameristar reserves the right to inspect the material to determine validity of the claim. Upon acceptance of the claim by Ameristar or its authorized representative, redemption by replacement, renewal or issuance of a pro-rated credit shall be made by Ameristar. Reimbursement for labor necessary to restore and/or replace components that have been found defective under the terms of this warranty is guaranteed to the original purchaser for a period of five (5) years from the original purchase date. Ameristar reserves the right to select the qualified company or individual to perform the labor to repair or replace the components that are deemed to be defective under the terms of this warranty. This is due to the heavy traffic that was shifted on to the west bound shoulder during the period of the east bound lane shift. Per Elliot Ligtenberg’s email, we are to move forward with this repair in sequence with the repairs for the east bound lane and shoulder, while using the same unit prices that have already been established in CO3. Below is a price to repair to the damaged shoulder and the additional 6" cut at the centerline of the road.
