AN ORDINANCE AMENDING CHAPTER 500 OF THE CITY CODE REGARDING
ISSUANCE OF CERTIFICATES OF OCCUPANCY
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI, AS FOLLOWS:
SECTION 1 -A DOPTION OF AMENDMENT. That Title V, Chapter 500 of the City Code
is hereby amended by adding a new Section 500.071, to read as follows:
Section 500.071. Determination of Storm Drainage Compliance
A Notwithstanding any other provision of the City Code or adopted Building or
Residential Code under this Chapter, no temporary or permanent Certificate of
Occupancy shall be issued for any new structure unless and until the Public Works
Director/City Engineer has inspected the subject lot and determined that:
1. Final grading conforms to the approved grading and drainage plans;
2. No drainage swales, watercourses, overland flow paths, storm-water
facilities, or drainage easements have been filled, obstructed, altered, or
impaired;
3. The lot is in compliance with all applicable City storm-water management,
grading, and drainage regulations, including but not limited to City Code
Chapter 705.
B. The Building Official shall not issue a temporary or permanent Certificate of
Occupancy until written confirmation of compliance has been received from the
Public Works Director/City Engineer.
C. The requirements of this Section are limited to verification of grading and storm
drainage compliance. Nothing herein shall be construed to require completion of
landscaping, sod installation, seeding, or other aesthetic site improvements as a
condition of issuance of a temporary or permanent Certificate of Occupancy,
provided that the lot drains in accordance with the approved grading and drainage
plans and no drainage feature has been altered or impaired.
D. In the event that seasonal weather conditions prevent minor grading stabilization
work from being completed, the Public Works Director/City Engineer may authorize
issuance of a temporary Certificate of Occupancy, provided that:
1. The lot substantially conforms to the approved grading and drainage plans;
2. All drainage swales, storm-water facilities, and overland flow paths are fully
constructed and functional;
3. Temporary erosion control measures are installed as necessary to prevent
sediment migration; and

4. The property owner provides a written acknowledgment that any remaining
stabilization work shall be completed within a specified time period once
weather conditions reasonably permit.
SECTION 2 -EFFECTIVE DATE. That This ordinance shall be in full force and effect
from and after the date of its passage and approval.
BE IT REMEMBERED that the above was read two times by heading only, PASSED
AND APPROVED by a majority of the Board of Aldermen and APPROVED by the Mayor
of the City of Riverside this 3 rd day of March 2026.
