HomeMy WebLinkAbout2155 Amending City Code Chapter 600 by Adding New Subsection 600.080.E to Delegate Authority to City Clerk for Certain Temporary Liquor PermitsBILL NO. 2026-021 ORDINANCE NO. 2155 AN ORDINANCE AMENDING CITY CODE CHAPTER 600 BY ADDING A NEW SUBSECTION 600.080.E TO DELEGATE AUTHORITY TO THE CITY CLERK TO ADMINISTRATIVELY REVIEW AND ISSUE CERTAIN TEMPORARY LIQUOR PERMITS WHEREAS, Chapter 600 of the Municipal Code regulates the sale and distribution of intoxicating liquor within the City; and WHEREAS, certain permits authorized under Chapter 600 are temporary in duration and administrative in nature; and WHEREAS, the Board of Aldermen finds that administrative efficiency will be improved by authorizing the City Clerk to review and issue qualifying temporary permits when all objective statutory and Code requirements are satisfied; and WHEREAS, the Board of Aldermen desires to retain its authority over general liquor licenses and all suspension and revocation proceedings. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1 -ADOPTION OF AMENDMENT. That City Code Section 600.080 of the Riverside Municipal Code is hereby amended by adding a new Subsection (E) to read as follows: E. Notwithstanding any other provision of this Chapter, the City Clerk is hereby authorized to review and administratively approve or deny applications for the following permits, provided the applicant demonstrates full compliance with the requirements of this Chapter and Chapter 311, RSMo.: 1. Temporary permits for sale by the drink, issued pursuant to Section 600.030(C); 2. Tasting permits, issued pursuant to Section 600.020(0); 3. Temporary catering permits, issued pursuant to Section 600.050; 4. Temporary licenses for not-for-profit sale, issued pursuant to Section 600.055; and 5. Temporary festival permits, issued pursuant to Section 600.057. The authority granted to the City Clerk under this Subsection shall be ministerial in nature and limited to determining compliance with the objective eligibility requirements established by this Chapter and applicable State law. The City Clerk may refer any application to the Board of Aldermen for consideration in her discretion. All permits issued pursuant to this Subsection shall remain subject to suspension or revocation by the Board of Aldermen in accordance with Sections BILL NO. 2026-021 ORDINANCE NO. 2155 600.100 and 600.160 of this Chapter. An applicant whose application has been denied under this Section may appeal the denial to the Board of Aldermen by filing a written notice of appeal within 10 days of the City Clerk 's denial, including a statement as to why the denial was in error. SECTION 2 -EFFECTIVE DATE. That this ordinance shall be in full force and effect from and after the date of its passage and approval.
