HomeMy WebLinkAbout1978-22 - Addition of Section 23.006 of the Criminal CodeBILL NO . ~,Z,Z ORDINANCE NO. 7~~ Z AN ORDINANCE REPEALING ALL PRIOR ORDINANCES ON THE TOPIC OF PROSTITUTION, ENACTING A NEW SECTION OF THE CRIMINAL CODE DEALING WITH PROSTITUTION AND THE PENALTIES THEREFORE TO BE ' KNOWN AS SECTION 23.006 OF THE CRIMINAL CODE OF RIVERSIDE, MISSOURI. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1. Section X3.006 of the Criminal Code of the City of Riverside, Missouri, is hereby repeal as of October, -2rrd 1978. SECTION 2. Section 23.006-A is hereby adopted as an amended part of the Criminal Code of Riverside, Missouri, to-wit: 23.006-A PROSTITUTION 1. A person commits the crime of prostitution if he engages or offers or agrees to engage in sexual conduct with another person in return for something of value to be received by the person or by a third person. 2. "Sexual conduct" occurs when there is (a) "Sexual intercourse" which means any penetration, however slight, of the female sex organ by the male sex organ, whether or not an emission results; or (b) "Deviate sexual intercourse" which means any sexual act involving the genitals of one person and the mouth, tongue or anus of another person; or (c) "Sexual contact" means any touching, manual or otherwise, of the anus or genitals of one person by another, done for the purpose of arousing or gratifying sexual desire of either party. 3. "Something of value" means any money or property, or any token, object or article exchangeable for money or property. SECTION 3. Section 23.006-B is hereby adopted as an amended part of the Criminal Code of Riverside, Missouri, to-wit: 23.006-B PATRONIZING PROSTITUTION 1. A person commits the crime of patronizing prostitution if he patronizes prostitution. 2. "Patronizing prostitution" is committed by a person if (a) Pursuant to a prior understanding he gives something of value to another person as compensation for that person or a third person having engaged in sexual conduct with him or with another; or (b) He gives or agrees to give something of value to another person on an understanding that in return therefor that person or a third person will engage in sexual conduct with him or with another; or (c) He solicits or requests another person to engage in sexual conduct with him or with another, or to secure a third person to engage in sexual conduct with him or with another, in return for some- thing of value. 3. "Something of value" means any money or property, or any token, object or article exchangeable for money or property. SECTION 4. Section 23.006-C is hereby adopted as an amended part of the Criminal Code of Riverside, Missouri, to-wit: ~ 23.006-C PROSTITUTION AND PATRONIZING PROSTITUTION-SEX OF PARTIES NO DEFENSE, WHEN In any prosecution for prostitution or patronizing a prostitute, the sex of the two parties or prospective parties to the sexual conduct engage in, contemplated or solicited is immaterial, and it is no defense that (a) Both persons were of the same sex; or (b) The person who received, agreed to receive or solicited something of value was a male and the person who gave or agreed or offered to give something of value was a female. SECTION 5. Any violation of this section shall 'constitute a misdemeanor punishable by fine or incarceration as provided in Section 25.003 of this Criminal Code. f% SECTION 6. If any section or portion of this criminal ordinance shall be declared unconstitutional or in violation of any statute or in conflict therewith, for any reason and by any competent Court, then all other ordinances, Criminal ;J- Code, sections or portions thereof, shall remain in full force and effect, each such ordinance or portion thereof are hereby declared to be separate and severable.
