ORDINANCE NO./7~~~s AN ORDINANCE AMENDING SUBSECTION D-4 OF SECTION 13.306 OF THE CITY'S ZONING CODE; PROVIDING REGULATIONS AS TO THE LOCATIONS OF OUTDOOR ADVERTISING SIGNS; FIXING THE CHARGE FOR THE ISSUANCE OF PERMITS; REGULATING THE SIZE AND SPACING, HEIGHT, LIGHTING, CONSTRUCTION AND BRACING OF OUTDOOR ADVERTISING SIGNS; PRO- VIDING FOR A PERFORMANCE BOND AND INSURANCE COVERAGE PRIOR TO THE ISSUANCE OF A PERMIT FOR AN OUTDOOR ADVERTISING SIGN. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, as follows: Section 1. Section D-4 of Section 13.306 shall read as follows: Sub-subsection A. Permit recruired. No outdoor advertising sign as the same is defined in this zoning order shall be erected, moved, enlarged, re-constructed, owned, altered used or allowed to exist without a special use permit which may be granted by the Board of Aldermen after recommendation from the Planning Commission., B. Application. Application for special use permits for outdoor advertising signs shall be on a form provided by the City with the requisite permit fee attached together with plans drafted to scale and in sufficient detail to allow the Planning Commission and Board of Aldermen to determine whether the requirements of this ordinance have been fully complied with in all respects. In no way shall failure of the City to note any engineering or structural deficiencies waive any rights of the City to enforce compliance with this ordinance. The application shall be presented to the Planning Commission. If the application for a special use per mit is approved by a majority of the Planning Commission then the application for a special use permit shall be referred to the Board of Aldermen. If the application is approved by a majority of the Board of Aldermen the special use permit shall be issued subject to such conditions as are contained in this ordinance or such additional conditions as may be made by the Board of Aldermen. C. Outdoor Advertisin Districts. Outdoor Advertising signs are permitted on y in District 5 and in this district only when a special use permit has been granted. Such special use permits may be recommended by the Planning Commission and may be granted by the Board of Aldermen. D. Fee For S ecial Use Permit For Outdoor Advertisin Si ns. The ee or a specia use permit or out oor a vertising signs shall be Five Hundred Fifty Dollars ($550.00) per year in advance for each side of the sign containing advertising copy. Nothing contained in the above subparagraphs shall exempt the applicant from obtaining the permit required in subsection b of Section 13.306 of this zoning order. In addition to all other fees a building permit shall be obtained and a fee of Twenty Five Dollars ($25.00) paid. The Planning Commission or Board of Aldermen may make special requirements they deem necessary or appropriate including but not limited to the charging of additional fees for engineering and legal consultation. In the event that the Planning Commission or Board of Aldermen shall require additional fees for engineering and legal consultation for the City then the application shall not be further considerec by either the Planning Commission or Board of Aldermen until the applicant has placed in escrow with the City the _ E. Size Restrictions. No sign shall be permitted in which the copy area is larger than three hundred square feet ' (300 sq. ft.) (per side). No sign shall have more than one copy area facing the same line of traffic. F. Spacing. No outdoor advertising sign shall be less than Twenty Two Hundred Fifty feet (2250') from any existing outdoor advertising sign surface in any direction (including on either side of any street or highway). Copy Area may be required and permitted on both signs of a structure. A maximum distance of four feet (4') may be allowed between the two copy areas on the structure. In addition to the above, no outdoor advertising signs shall be located closer to a street or highway than one and one-fourth times (1-1/4) the total height of the structure. No outdoor advertising sign shall be located closer to the boundary line of the realty upon which the outdoor advertising sign is placed than a distance equal to one and one-fourth times the height of the structure. G. Height of Structure. No outdoor advertising sign shal a erecte w ose total height is greater than fifty five (55) feet above ground level or twenty- _ five (25) feet from the pavement surface of the closest adjacent roadway. H. Lighting. The application for special permit shall clearly detail any lighting to be used on the sign. All said lighting shall be so designed as to concentrate the illumination upon the copy area of the sign and so designed so as to prevent glare upon the street or adjacent property and no spot light or flood light shall project or extend over public property. Any lighting which after erection shall become a hazard to traffic or which shall disturb or annoy other persons may be removed by the City at the owner's expense. Iu the event that said lighting shall disturb or annoy other persons or in the event the electrical devices shall malfunction or become defective and such sign after the said devices become defective or malfunction shall not be removed or repaired within ninety (90) days may be removed by the City unless the City for good cause extends this time. I. Desi n and Construction. All outdoor advertising signs _ shall be esigne and constructed in accordance with Chapter 4 of the "Uniform Sign Code" (1973 edition) which is adopted herein by reference as though fully set out in this ordinance. In the event that the provisions of Chapter 4 of the Uniform Sign Code shall conflict with any other section of this ordinance then the Ordinance Section shall prevail over the provisions of this subsection. References in Chapter 4 of the Uniform Building Code shall be applicable to the 1973 edition of said Code. J. Surrounding premises to be kept in Sanitary Condition. All premises surrounding t e outdoor advertising sign shall be maintained by the owner of the sign in a clean and sanitary and inoffensive condition and free and clear of all nauseous substances, structures and weeds. K. Obscene or Indecent Advertisement. No person shall display upon any outdoor advertising sign any obscene, indecent or immoral matter. L. Performance Bond. At the time the application is approved by the Planning Commission and prior to the issuance of the special permit for an outdoor advertising sign the applicant shall post a performance bond to secure that all of the requirements of the zoning order of the City of Riverside and the other ordinances of the City of Riverside have been and will be fully complied with and said performance bond shall be in an amount equal to five times the annual permit fee. The form of said performance bond shall be approved ~ by the City Council. M. Insurance. After the approval of the special permit and prior r to the issuance of the special permit the applicant shall provide satisfactory insurance to the City of liability insurance coverage of at least 100,000/300,000/50,000 and shall endorse the City as an additional insured on the policy. Sign Company to prove that liability insurance is in force when permit is renewed. N. Outdoor Advertisin Siggns Exceptions. The Planning Commission and Board~ldermen may issue one outdoor advertising sign permit without fee or spacing requirements provided, however, said outdoor advertising sign may only be issued to a private not for profit corporation which advertises exclusively Riverside merchants or businesses. Section 2. This ordinance shall be effective immediately. __ Section 3. If any section, subsection, paragraph, -~ sentence, clause, or phrase of this ordinance shall be declared invalid for any reason whatsoever, such decision shall not effect the remaining portions of this ordinance, which shall remain in full force and effect; and to this end the provisions of this ordinance are hereby declared to be severable.
