BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI, AS FOLLOWS:
Section 1. That the Board of Aldermen of the City of Riverside
does in an determine that in order to promote the health, safety
and general welfare, comfort and convenience of the City of Riverside,
its inhabitants and public generally, it is beneficial to enter into
a reciprocal agreement between the City of Claycomo, Missouri, and
the City of Riverside, Missouri, respecting the mutual exchange of
fire fighting personnel and equipment for the mutual protection of the
property and lives of persons in the two municipalities; that a copy
of said agreement is attached hereto, marked exhibit "A" and is
incorporated herein by reference.
Section 2. That the provisions of the agreement referred to in
Section ereof are hereby approved and adopted by the Boardof
Aldermen of the City of Riverside and the Mayor and the City Clerk
are hereby authorized and directed to execute said agreement on
behalf of the City.
Section 3. That the provisions of this ordinance shall be in
full ore an3 effect immediately upon its passage by the Board of
Aldermen and approval thereof by the Mayor.

Claycomo and the Chairman of the Board and the Clerk are hereby authorised and
directed to execute said agreement on behalf of the Village,

AGIiI~EMENT
I' TI I S AGREEMENT made by and between the CITY Ot' RIV1~:1;5IUI;, ,,
municipal corporation, and the VILLAGE OF CLAYCOMO, a municipal corporation,
WITNI~SSETH:
THAT WHEREAS, the City of Riverside and the Viliage of Claycomo arc
neighboring political subdivisions; and
WH1~11iP:AS, it is necessary under the law to enter into a wriltc•n ~•~,nt ~~,rct f~>r
such services to protect the members of the fire departments of said political
subdivisions in the matter of pensions and personal injuries and insurance services
and to relieve the department heads from personal liability,
NOW, THEREFORE, for and in consideration of the mutual. cc~vt+nants between
said political subdivisions, it is agreed by and between the ;,ar•t.ier; hcri•1u that:
T. The fire department of either of said political subdivision;: tnu~; rrspund
to calls fur help received from the fire chief or the subordinate o1•ficer in charge ~,f
the fire department of the other party to this agreement; provided, however, that
response is to be given only when the fire department called on or aid is not othcrwi <~
occupied, and only when the services of the responding company can be spared with
a margin of safety; and provided, further, that the political subdivisions agree n~~t
to call for help unless fire in the area is out of control and spreading, or unless its
fire department is engaged in fighting another fire simultaneously, or unless another
fire has broken out and cannot be handled by the City. ,
2. The heads of the fire departments in the respective political. subdivisions
shall. be sole judge of how much assistance is needed or can be furnished under the
cir•r.umstances of each particular case; and it is agreed that. neit.her• shall b~~ liahlt• in
an,y way to the other or its inhabitants or any other person, firm or curpc~rati~~n for any
failure to give the assistance asked.
3, The political subdivision which calls for aid shall not be liable for anv
personal injury, death, or property damage occurring to the answering political
subdivision, or any officer or employee thereof.

4. It is recognized that the interests herein are mutual and the contract.
is entered into for the common good of the general public of both political
•~ sulxJivisions, and for a strictly governmental purpose.
