AN ORDINANCE LICENSING AND REGULATING TRASH AND REFUSE HAULERS, tt PROVIDING FOR AN ANNUAL LICENSE FEE, PROVIDING FOR A METHOD ~J OF DISPOSAL OF TRASH, PROVIDING A CRIMINAL PENALTY FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1. Code Section 12.11 is hereby repealed and the clerk is directed to make the appropriate changes in the City Code and the following ordinance is enacted to be designated code Section 12.11. SECTION 2. COLLECTION AND DISPOSAL OF REFUSE - PERMIT REQUIRED. No person shall engage in t e usiness o co ecting re use or rubbish within the corporate limits of the City or of processing refuse or rubbish within said corporate limits without first obtaining a permit therefore from the Board of Aldermen. SECTION 3. ANNUAL LICENSE FEE. The annual license fee shall be in the amount of One Hundred Fifty Dollars ($150.00) for each person, firm, partnership or corporation or legal entity which shall be tendered at the time of application. No such license shall be transferrable or ._-- assignable. The license application shall be on the form designated by the Board of Aldermen and may be suspended or revoked at any time by an affirmative vote of the majority of the members of the Board of Aldermen. SECTION 4. INSURANCE REQUIREMENT. The Board of Aldermen may require each applicant, in addition to all the other requirements set forth, to file and maintain with the City, evidence of a satisfactory public liability insurance policy covering all operations of such applicant referring to such business and all vehicles to be operated and the conduct thereof in the amount of not less than Fifty Thousand Dollars ($50,000.00) for each person killed or injured or in the amount of not less than One Hundred Thousand Dollars ($100,000.00) in the event of injury or death to two or more persons in any single occurrence and in an amount of not less than Fifty Thousand Dollars ($50,000.00) for damage to property. Should any such policy be cancelled the City shall be notified of such cancellation by the insurance carrier in writing not less than ten (10) days prior to the effective date of such cancellation and provisions to that effect shall be incorporated in such policy which shall also place upon the company writing such policy the duty to give such notice. SECTION 5. APPLICATION REQUIREMENTS. Each applicant for any such permit shall state in his application therefore: (a) The nature of the permit desired as to collection transport process or disposal of solid waste or any combination thereof, (b) The characteristics of .the solid waste to be collected, transported, processed or. disposed, (c) The number of solid waste vehicles to be operated thereunder, (d) The precise location or locations of solid waste processing or disposal facilities to be used., (e) The boundaries of the collection area, (f) Any other such information as may be required by the City (g) An agreement that the applicant will not dispose of waste in any site not approved by the Pdissouri Division of Health in the municipality. (h) An agreement that the applicant will upon request provide for the city the full name and addresses of all persons to-whom refuse collection is being furnished. (i) That the applicant will make such provisions for the heap } and safety of the collectors of solid waste as the City may req~e 7~ , jo ,4. SECTION 6. VEHICLES OF TRASH COLLECTION All vehicles to be used in the collection of refuse shall be kept and maintained in a clean and sanitary condition and shall be so constructed, maintained and operated as to prevent spillage of the type of refuse to be collected therein. .All said vehicles shall be constructed with water tight bodies and with covers of metallic or other rigid impervious material or in the alternative the entire body thereof shall be enclosed with only loading hoppers exposed. SECTION 7. DUMPING PROHIBITED. No person shall dump any trash, refuse or solid waste of any kind on any private property within the city limits of the City of Riverside, Missouri, without a permit from the City. SECTION 8. EXCEPTIONS FOR EARTH AND ROCK HAULING. Permits shall not be required for t e remova or hauling or disposition of earth and rock material from grading or excavation activities, provided all such material shall be conveyed in a type of vehicle, trucks or reciprocals so constructed and maintained so that none of the material being transferred shall spill upon the public right-of-way. SECTION 9. NO PERMIT FOR COLLECTOR WfiO DOES NOT USE APPROVED DISPOSAL AREA. The City shall not issue any permit for the collection of solid waste unless the collector is to dispose of solid waste at a facility or location which is approved by the City and which holds a permit issued by the Missouri Division of Health for said disposition. SECTION 10. PENALTY. Any person violating any of the provisions of this ordinance upon conviction shall be punished by a fine of not less than Five Dollars ($5.00) nor more than Five Hundred Dollars ($500.00) or confinment in the city jail for not more than ninety (90) days or by both such fine and confinment, provided however, each day's violation shall be a separate offense for the purpose hereof. SECTION 11. SEVERABILITY. The provisions of this orrdinance are severable and if any provision or part thereof shall be held invalid or unconstitutional or inapplicable to any person or circumstances such invalidity or unconstitutionality or inapplicability shall not effect or impair the remaining portions of this ordinance.
