ORDINANCE NO. 7~ ~J
AN ORDINANCE ENACTING SECTION 19.923 OF THE CITY CODE OF THE
CITY OF RIVERSIDE,. MISSOURI, AND PROVIDING THAT IT IS UNLAWFUL
TO EQUIP A MOTOR VEHICLE WITH ANY APPLIANCE OR EQUIPMENT WHICfi
TRANSMITS OR RECEIVES MESSAGES ON ANY POLICE RADIO FREQUENCY
OR TO USE SUCH APPLIANCE OR EQUIPMENT IN ANY MOTOR VEHICLE WITHIN
THE CITY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE, MISSOURI, AS FOLLOWS:
Section 1. Section 19.923 is hereby added to the
Criminal Code of the City of Riverside, Missouri, under Chapter
19, dealing with motor vehicles and traffic and shall read as
follows:
19.923 Communication Equipment in Motor Vehicles.
No persons shall equip any motor vehicle with any
appliance or equipment which may be operated on
an ultra-high frequency radio receiving set or
with a communications device tuned or fixed to
receive or transmit messages on any frequency
used by the Police Department or have or use
such appliance or equipment in any motor vehicle
within the City; unless such motor vehicle is
used or owned by a police officer, fireman or
other city employee or such other person whose
bona fide duty is to execute .process, make
arrest or aid in conserving the public peace,
without first securing approval so to do from
the Board of Aldermen.
Section 2. Any person violating the above provision
shall, upon conviction be subject to a fine not exceeding Five
Hundred Dollars ($500.00) or by imprisonment in the P4unicipal
Jail for a period not exceeding Ninety (90) days or by both
such fine and imprisonment in the discretion of the Court.
Section 3. Should any clause, sentence or paragraph
of the above provision be declared illegal or unconstitutional
by a Court of competent jurisdiction, it is the intent of the
Board of Aldermen that the holding of_ the Court shall in no way
effect the legality of the remaining provisions of this ordinance.
Section 4. The City Clerk is instructed to insert
the above provision in the Criminal Code of the City of Riverside,
Missouri, as Section 19.923 under Chapter 19 dealing with motor
vehicles and traffic.
