ORDINANCE NO ~6 A
AN ORDINANCE AMENDING SECTION 17.1 OF THE CITY CODE DEALING WITH
OBTAINING A PERMIT TO BREAK THE SURFACE OF A STREET-PENALTY FOR
VIOLATION AND ENACTING A NEW CODE SECTION DEALING WITH OBTAINING
A PERMIT TO BREAK THE SURFACE OF A STREET-PENALTY FOR VIOLATION
OF SAID ORDINANCE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI, AS FOLLOWS:
Section 17.1 of the Code of Riverside, Missouri is hereby
repealed and a new ordinance denominating Section 17.1 enacted
in lieu thereof.
17.1 Obtaining a Permit to Break the Surface of a Street-
Penalty for Violation
SECTION 1. THE PERMIT NECESSARY TO BREAK SURFACE OF STREET.
It is hereby decreed that before any person shall for any reason
or purpose break any hole in the surface of any city streets, he
shall apply in writing to the City Clerk for a permit, on the ~~
form provided by the City for said purpose.
SECTION 2. FORM OF APPLICATION. The application shall set
forth the following facts:
a. Name of applicant.
b. The exact location.
c. The purpose for which the street is to be broken.
d. The size of the break and square feet of road
sur face involved.
e. The date of said proposed break.
f. The date on which the break will be repaired.
g. The covenant that the street will be repaired to
the satisfaction of the City Engineer.
h. An agreement that the applicant will adhere to all
spe cifications of the City Engineer.
SECTION 3. APPLICATION FEE. Each applicant shall pay a
$25.00 permit fee submitted with the application which shall not
be refundable.
SECTION 4. BOND. A performance bond shall be deposited
by the applicant in the amount of $200.00 covering holes up to
10 square feet and $20.00 per square feet additional for each
square foot in excess of 10 square feet. If said hole or break
is repaired by the applicant to the satisfaction of the City
Engineer, then the said bond will, upon request from the applicant,
be returned to him.
SECTION 5. PERMIT APPROVAL. The permit may be approved
by the City Clerk or in her discretion the same may be submitted
to the Board of Aldermen for approval. No break shall be made
in any City street until the application is approved.
SECTION 6. EMERGENCY PROCEDURE. The City Police Chief
is authorized to grant emergency permits under such terms as
he may deem appropriate, in the event of a necessity of an
emergency utility repair or other compelling reason, irrespective
of the provisions of Section 1 and 5.
SECTION 7. CITY'S REPAIR OF BREAKS COMPLETED WITHOUT
PERMISSION. The City may repair any breaks or holes placed in
the street, if the same has been completed with the City's
permission and bill the applicable contractor, utility or
person for said repair. The repair or payment for repair
of said street shall not relieve the person or corporation
from criminal prosecution because of the violation of this
ordinance.

8. PERSON INCLUDES CORPORATION. The word
sed in this ordinance shall include groups of
partnership or corporations.
SECTION 9. CRIMINAL PENALTY. Violation of the terms
of this ordinance shall be punishable by fine not to exceed
One Hundred Dollars ($100.00) or by imprisonment in the city
jail, not in excess of 30 days or by both fine and imprison-
ment and costs. ~
