HomeMy WebLinkAbout1972-08 - Amendments to Sections 12.7 and 12.8 of the Municipal CodeBTLL N0.7~_~ ORDINANCE N0,7oZ ~~ AN ORDINANCE AMENDING SECTION 12.7 AND 12.8 OF THE CITY CODE ' DEALING WTTH THE SALE OF FIREWORKS AND THE FEE FOR OCCUPATIONAL LICENSE FOR SAID SALE AND ENACTING A NEW CODE SECTION DEALING WITH THE SALE OF FIREWORKS AND CREATING CRIMINAL PENALTIES FOR THE VIOLATION OF SAID ORDINANCE. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Sections 12.7 and 12.8 of the Code of Riverside, Missouri are hereby repealed and a new ordinance denominating Section 12.7 enacted in lieu thereof. 12.7 Sale of Fireworks and Fireworks Occupational License, Section 1. It shall be unlawful fox any person, firm ox corporation to sell or offer for sale within the city limits of Riverside any fireworks unless such person, firm or cor- poration shall have first obtained from the City Collector an occupation license for the sale of such fireworks and shall have paid to the City Collector the fee prescribed herein, Section 2. It shall be unlawful for any person, firm or corporation to sell any fireworks at any location which is not zoned for retail business by the zoning ordinance of the City of Riverside. Section 3. It shall be unlawful for any person, firm or corporation to sell fireworks from a car or truck or in any other manner than from either an existing building or from a temporary or permanent stand. Section 4. Any temporary stands erected for the purpose of the sale of fireworks must be removed following the end of the period for which the license fox the sale of such fireworks is issued. Section 5. The license for fireworks for any year shall cover a period from June 20 till midnight July 5 and any retail sales of fireworks during any other time of the year is hereby prohibited. Section 6. The fee for occupational license for the retail sale of fireworks shall be determined as follows: Two Hundred Fifty Dollars ($250.00) for a place of business with less than 901 square feet total of sales and storage area. Five Hundred Dollars ($500.00) for a place of business with more than 900 square feet of total sales and storage area. Seven Hundred Fifty Dollars ($750.00) for a place of business with more than 2,000 square feet of total sales and storage area, In calculating the total square footage of sales and storage area, all square footage enclosed within the walls of the building or tent for which a license is sought shall be included. ~ Section 7. Provided, however, the retail sales of fireworks by non-profit or charitable organization shall be in the amount of $50.00 provided, however, said business shall not be more than 300 square feet total of sales and storage area, In the 7.~ -8 event that a non-profit or charitable organization exceeds in space 300 square feet of sales and storage area then the fee for said sale shall be determined pursuant to Section 6. _ Non-profit licenses shall be limited to five (5) organizations not situated within the City. ~- Section 8. A bond of One Hundred Dollars ($100,00) (payable by separate check or bank draft) shall be posted by any applicant for an occupation license for the retail sale of fireworks which shall be refunded if and when any temporary stand or building has been removed and the premises cleared of debris or refuse accumulated as a result of such busit~.ess within five (5) days; if such stand or building debris or refuse shall not be removed within such period, the bond shall be forfeited. Section 9. The fee for an occupational license for the sale of wholesale fireworks is Two Hundred Fifty Dollars ($250.00). Section 10. For the purpose of this ordinance, the retail sale of fireworks shall be deemed to be the sale to consumers and not for resale, wholesale sale of fireworks shall be deemed to be the sale of fireworks to dealers, retailers or other for resale in or out of the city limits. A license for retail sales does not authorize sale for wholesale nor does a license for wholesale sales authorize any sales at retail. Any person desiring to sell both at retail and at wholesale must obtain both a retail license and a wholesale license as above provided. Section 11. Violations of the terms of any section of this ordinance shall be punishable by fine not to exceed $100.00 or by imprisonment in the city jail not to exceed 90 days or by both such fine and imprisonment and costs and each day on which said offense shall occur shall constitute a separate offense.
