ORDINANCE N0. 157
AN ORDINANCE PROVIDING RULES AND CONDITIONS FOR THE RENEWAL OF THE
NON-ASSIGNABLE NON-INTOXICATING BEER LICENSES ANDTHE ISSUANCE OF NEW
NON-INTOXICATING BEER LICENSES IN THE CITY OF RIVERSIDE, MISSOURI.
BE IT ORDAINID BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS:
SECTION L. Due to the fact that the annual non-intoxicating
beer licenses of the City of Riverside, Mo. are non-assignable and
limited in number, and recognizing that a substantial investment is
usually made by the owner of the building in which such a business
is operated and also by the operators of such businesses, the Board
of Aldermen of the City of Riverside, Mo. deem it to the best
interests of the City that the following rules be laid down and
observed in the issuance of new licenses or renewal licenses from
year to year, and also in order that the owners of such businesses and
of the buildings in which they are operated as well as }prospective pur-
chasers thereof may be guided as to the possibility of obtaining
such a license or a renewal of such.Hcense.
SECTION 2. Hereafter in the issuance of new licenses or the
renewal of licenses for the sale of non-intoxicating beer the
Board of Aldermen will follow the following rules as they may be
amended from time to time:
(a) All licenses applying for renewal of licenses for
the same location, who have consistently abided by all the
ordinances of the City and paid all taxes, fees and licenses
due to the City, and are of good moral character shall be
issued such renewal license upon the payment of the
requisite fee therefor.
(b) The owner of any building in which such a business has
lawfully been operated in the license year then expiring
or during the current license year, or any tenant leasing
or renting from such an owner, and such owner or tenant
shall be in compliance with the requirements of sub-
paragraph (a) above, shall be issued a new non-intoxicating
beer license for such location, pprovided, that application
for such license shall be made wiFiirty days after
the close of operation of a non-intoxicating beer business
at such location by the former licensee at such location.
(c) Any licensee who shall move from one location to
another location in the City, which second location is
properly zoned for such a business, and which licensee shall
meet the requirements of sub-paragraph (a) above, shall be
issued a new license for the sale of non-intoxicating beer
at the new location only if the owner of the building, in
which suchlicensee formerly operated such business, or a
tenant leasing or renting from such owner, shall have failed
to make application for a non-intoxicating beer license for
such former location within thirty days after the former
licensee at such location shall have ceased the operation
of such business at such former location and shall have
surrendered to the City Clerk his license to sell non-intox-
icating beer at such former location, or if there are
sufficient licenses available without exceeding the limitation
thereon as set by the ordinances of the City, and such licensee
shall be given preference over other applicants for a non-
intoxicating beer license who have never befor® been is&ued
a license by the City, except as provided above.
(d) All other applicants for such a license shall be
•issued a license in the chronological order of their
applications upon compliance with sub-paragraph (a) above
and as such licenses shall become available under the limita-
--- tion set by the City and after all qualified former licensees
have been issued licenses.

(e) No owner of a building or tenant under him or
licensee shall be denied a license merely because such a
use of the building wherein such business has heretofore
been operated constitutes a non-conforming use under the
Zoning law of the City of Riverside, Mo. as it now exists
or as it may hereafter be amended.
SECTION 3. No person shall be deemed to have gained any
vested rights by virtue of the terms of this ordinance and the same
shall be subject to amendment by'tYi'~ Board of Aldermen from time
to time as in their discretion meets the best interests of the
City of Riverside, Missouri.
SECTION 4. This ordinance shall be effective fnnediately
upon its passage and approval by. the Mayor.
