HomeMy WebLinkAbout1969-253-R5 - Repeal Ordinance 253o~ ~3~~_ An ordinance repealing ordinance 25383, 25384 and 253A4 of the City of Riverside, tAi.ssouri, and enacting neco provisions in lieu thereof requiring that licenses be obtained by the operators of various classificata_ons of occupations, businesses, trades or advocations in the City and prescribing the fees to be charged and providing a penalty for violation thereof. BE IT OF.DAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI ~ AS FOLLO~`iS Section 1. SCOPE. No person shall carry on or operate, maintain or engage in any occupation, business, trade or advocation of any :kind enumerated herein without first obtaining a license, which said license shall be issued by the City to such person, firm,. partnership, corporation or legal entity upon proper applicaticn being made therefor and payment of the fee prescribed by the Board of Aldermen. No such license shall be transferrable or assignable. Each license that is issued to a designated address or location shall not be used for any other location within the City of River- side unless application for a different designated address shall first have been made to the Board of Aldermen and permission granted by the Board of Aldermen. Section 2. DEFINITION. Apartment Houses - Any building or group of buildings i.n which more than three rental units are maintained and where common services, enjoyments or facilities are provided. Avocation - All occasional or subordinate occupations. Business - The buying and selling of commodities, services or any activity intended to be productive of income. Inside Occu an on, Business, Trade or Avocation - F.ny occupation, trade, avocation or business that displays none of its merchandise out of a building and conducts any of its occupation, trade, business or avocation outside. Trade - All work and means of earning a living. Section 3. OUTSIDE BUSINESS, TRADE, OCCUPATION OR AVOCATIOT3. Notwithstanding the annual fee schedule listed herein any occupation, business, profession or avocation within the definition of that defined in Section 2, as an outside occupation, busines^, trade or avocation shall pay a minimum of $105.00 occupational lz.cense. The term of all licenses shall and expire on December 31st of each herein. All licenses not required under shall be prorated as of the date of .Section 6. LICENSE FOR GAKAGE BUSINESS. The license for the operation of a garage business shall be issued for no more than one quarter of a calendar year and shall be success- fully renewable for no more than one quarter of a calendar year at a time. The fee to be paid on such garage license shall be $26.25 per quarter of the calendar year with no proration of any portion of such quarter. All operators of licensed garages shall keep the premises on which such businesses are located in a neat and good orderly condition and shall not permit the accumulation of junk, trash, debris and wrecked vehicles. Any licensee holding a garage license, who shall have abided by the requirements of this ordinance and the other ordinances of the City of. Riverside shall be entitled to have his license renewed for such quarter license period to the next quarter license period upon making application therefor and paying the license fee herein prescribed. Any licensee ivho shall violate the terms of this ordinance or any other ordinances of the City of Riverside may in the discretion of the Board of Aldermen be denied the renewal of said license. Section 7. ISSUANCE AND FORM OF LICENSE. The shall issue all licenses prescribed in t a.s c apter an s all prescribe the form therefor. Section 8. COMPLIANCE OF ZONING REGULATIONS: The shall issue all licenses subject to the licensee s compliance with all zoning requirements and shall have-the power to revoke any license for failure to comply with the zoning requirements and upon application may refund the unused portions of the annual license fee paid for such revoked license. Section 9. MORE THAN ONE OCCUPATION AT THE SAME ADDRESS. Where more than one occupation, business, trade or avocation as enumberated herein is carried on at the same address the licensee shall make an application for each separate occupation, business, trade. or avocation. Section 10. SEPARATE LICENSE FOR EACH PLACE OF BUSINESS. Separate licenses shall be obtained for each location at which an occupation, business, avocation or trade is carried on. Section 11. DELAY IN PAYMENT - PENALTY. Should the licensee fail to make application for renelval, the fee to be charged for such license shall be increased 25% if the renewal license is applied for prior to February 1st of the succeeding calendar year. The fee of the license shall be increased 50o if such renewal license is not applied for prior to Diarch 1st of such succeeding calendar year. Section 12. DISPLAY OF LICENSE. All licenses granted by the -City shall be carefully preserved and shall be displayed in a conspicious place in the place of business by the licensee. Section 13. PENALTIES. Violation of this ordinance shall be punishable by fine not to exceed $100.00 or by imprisonment not to exceed 90 days or by both fine and imprisonment and each. days operation of an occupation or business without having obtained the necessary licenses as provided for herein shall constitute a separate violation. Nothing in this section shall be construed to prohibit the City from civil action to collect unpaid license fees. Section 14. INVALIDITY.
