HomeMy WebLinkAbout1957-270 - Vacation of Warren RoadBILL N0. 271 ORDINANCE N0. 270 AN ORDINANCE VACATING WAKREN ROAD IN BRENNER RIDGE, AN ADDITION IN THE CITY OF RIVERSIDE, PLATTE COUNTY, MISSOURI. BE IT ORDAINED BY THE BOARD OF ALDERMEN ~F THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. The Board finds that a petition has been filed with the City Clerk by Rose Brenner Filger and Brenner Rentals, Inc., praying for the vacation of all of Warren Road, more particularly described as follows: "A forty foot street known as "tajarren Road", bounded on the West by lands belonging to one Rose Brenner Filger, one of the petitioners; on the South by Lots 16 to 23 inclusive and Lot 3; on the East by Highway 71; and on the North by Lots 24 to 31 inclusive and Lot 2 of said subdivision, the same being 40 feet in width and approximately 429.5 feet in length." Section 2. The Board further finds that said petition was verified. Section 3. and Ferdinand F. Filg are the owners of all said Warren Road, and vacation have been by each of such consents The Board finds that Rose Brenner Filger ~r, her husband, and Brenner Rentals, Inc., of the property fronting or abutting on that their consents to such proposed them filed with the city CerK and that has been acknowledged by affidavit. Section 4. The Board further finds that notice of the pendency of such petition and a public hearing to be held thereon by the Board of Aldermen on January 8, 1957, was published in the Platte County Gazette, Parkville, Missouri, the nearest weekly newspaper printed and published in Platte County, Missouri, for two consecutive insertions in such newspaper, the last insertion being not more than one week nor less than two days prior to the date of such public hearing. Section 5. Said public hearing having been held, the Board of Aldermen find and decree that said Warren Road has never been opened and used as a public street and said Board finds and decrees that it is necessary and expedient that said Warren Road be and it hereby is vacated and discontinued, and that any and all easements or right of the public to the use of said street is forever terminated by this ordinance. To the Honorable, the Board of Aldermen of the City of Riverside, Platte County, Missouri; We, the undersigned, being all of the owners of the land fronting or abutting a certain street known and described as "Warren Road", said street located in the City of Riverside, Missouri, hereby respectfully petition the City of Riverside for an ordinance vacating said street designated as "Warren Road", which street is a part of a subdivision known and designated as Brenner Ridge, an addition to Platte County, Missouri, being located in the city limits of Riverside, Missouri, more particularly described as follows: A forty foot street known as "Warren Road", bounded on the West by lands~elonging to one Rose Brenner Filger, one of the petitioners here; on the South by Lots 16 to 23 inclusive and Lot 3; on the East by Highway 71; and on the North by Lots 24 to 31 inclusive and Lot 2 of said subdivision, the same being forty feet in width and approximately 429. 5 feet in length. Your petitioners further state that it is their desire aryl wish to have the Board of Aldermen by ordinance vacate all of said "Warren Road" in its entirety and as hereinabove described. Your petitioners further state that Rose Brenner Filger and Brenner Rentals, Inc. , a Missouri corporation, are the owners of the land and lots adjoining, fronting or abutting said described "Warren Road". Your petitioners further state that this, their petition for vacation, shall be, and they request the same to be, considered as their written consent to such proposed vacation, all as provided by Ordinance No. 133 of the City of Riverside.
