ORDINANCE NO. 39 ~ 1
AN ORDINANCE REGULATING THE SALE AND STORAGE OF FIREWORKS WITHIN
THE CITY OF RIVERSIDE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE,
MISSOURI AS FOLLOWS;
Section 1. The term "fireworks" means and includes any combustible
or explosive composition, or any substance or combination of substances, or
article prepared for the purpose of producing a visible or an audible effect by
combustion, explosion, deflagration or detonation, and includes blank cartridges,
toy pistols, toy cannons, toy canes, or toy guns in which explosives are used,`
the type of baloons which require fire underneath to propel the same, firecrackers,
torpedoes, skyrockets, Roman candles, Dago bombs, sparklers or other fire-,
works or other fireworks of like construction and any fireworks containing any
explosive or flammable compound, or any tablets or other device containing any
explosive substance. The term "fireworkS~" shall not include toy pistols, toy
canes, toy guns, or other devices in which paper caps containing twenty-five
hundredths grains or less of explosive compound are used, providing they are so
constructed that the hand cannot come in contact with the cap when in place: for
use, and toy pistol paper caps which contain less than twenty-five hundredths
grains of explosive mixture, the sale and use of which shall be permitted at all
times .
Section 2. It shall be unlawful for any person, firm or corporation to
sell any fireworks at any location which is not zoned for retail business by the
zoning ordinance of,the City of Riverside and unless such person shall have
obtained from the City Collector an occupation license for the sale of such
fireworks .
Section 3. It shall be unlawful for any person to sell any fireworks other
than those classified as "Common Fireworks" and labeled with the Interstate
Commerce Commission Class C label.
Section 4. It shall be unlawful for any person, firm or corporation to
sell fireworks from a car or truck or in any other manner than from either an
`~ existing building or from a temporary or permanent stand.
Section 5. Any temporary stands erected for the purpose of the sale of
fireworks must be removed following the end of the period for which the license
for the sale of such fireworks is issued.
Section 6. The license for fireworks for any year shall cover a period
from June 20th until midnight July 5th and any retail sales of fireworks during
any other time of the year is hereby prohibited.
Section 7. All licensees shall adhere to the laws of the State of Missouri
regulating the sale of fireworks. Each sale or day of storage of illegal fire-
works under state law shall be deemed a separate offense. Upon conviction
of violation of the terms of this ordinance any person shall be subject to a
fine of not more than ,One Hundred Dollars ($.100.00) or imprisonment in the ,
city jail for not more than thirty (30) days or,both such fine and imprisonment
and costs.
Section 8. All ordinances or parts; of ordinances in conflict herewith are
