BILL NO.~~- ORDINANCE N0. 7`~'~_ / a AN ORDINANCE ENACTING AND ADOPTIPIG A TR.tiF:~'IC CODE I''OR THE CITY OF RIVERSIDE AND REGUI~ATIDIG THE OPE&.TION OF ivIOTOR VEHICLES IN THE CITY OF RIVERSIDE PROVIDING PENALITIES FOR THE VIOLATIONS THEREOF, AND R~EALING ALL ORDINAI~TCES IN CONFLICT OR INCONSIS~: TENT ^1HERE4VITH; BE IT ORDAINED BY THE BOARD OF ALDERr.~EIQ OF THE CITY OF RIVER- SIDL, IvIISSOURI AS FCILLOVIS ; SECTION 1: DEFINITIONS. For the purposes of this ordinance, the following words and phrases shall have the meanings respectively ascribed to them by this section: ALLEY. Any street writh a roadway of less than twenty feet. AU':PHORIZED E1~IERGEIQCY V1'.tiICLE. Vehicles of the fire depart- ment, police vehicles and such ambulances and emergency vehicles of municipal departments or public service corp- orations as are designated or authorized by the chief of police. BICYCLE. Every device propelled by human power upon which any person may ride, having trvo tandem wheels either of which is more than twenty inches in diameter. BUS. Every motor vehicle designed for carrying more than ten passengers and used for the transportation of persons; and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensation. BUSIIQESS DISTRICT. The territory contiguous to a street when fifty per cent or more of the frontage thereon for a distance of three hundred feet or more is occupied by buildings in use for business. CROSSWALK. That portion of a roadway ordinarily included within the prolongation or connection of curb and property lines at intersections or any other portion of a roadway clearly indicated for pedestrian crossings by lines or other ,J markings on the surface. CURB LOADING the exclusive of passengers ZONE. A space adjacent use of vehicles during or materials. to a curb reserved for the loadin? or unloading ~~~ ~ ~ DRIVER. Every person who drives or is in actual physical control of a vehicle. ~ FARIei TRACTOR. Every motor vehicle designed and used pri- marily as a farm implement, for drawing plows, mowing mach- ines and other implements of husbandry. FLAT:~~IAI3LE LIC~UID. Any liquid which has a flash point of seventy degrees fahrenheit, or less, as determined by a tagliabue or equivalent closed-cup test device. GROSS VJEIGIT. The weight of a vehicle without load plus the weight of any load thereon. HIGIiWAY. The entire width between the boundry lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. INTERSECTION. The area embraced within the prolongation or connection of the lateral curb lines; or, if none, than of the lateral boundary lines of two or more streets which join one another at an angle, whether or not one such street crosses tho other. LANID ROADWAY. A roadway which is divided into two or more clearly marked lanes for vehicular traffic. __ i!-:OTORCYCLE. Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding a tract- or. ~-- TvIOTOR-DRIVEN CYCLE. Every motorcycle, including every motor scootor, with a motor which produces not to exceed five horse- power, and every bicycle with motor attached. T:iOTOR VEHICLE. Every vehicle, as herein defined, which is self- propelled. OPb'ICIAL TITYiE STAI~TDARD. Whenever certain hours are named herein, they shall mean Standard Time or Daylight Saving Time as may be in current use in the City. OFFICIAL TRAFFIC-CONTROL DEVICES All signs, signals, markings and devices not inconsistent with this chapter placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic. ONE-1"JP.Y STREETS OR ALLEYS. A one-way street or alley is any street or alley upon vahich all vehicular traffic is restricted to movement in one direction only. - 2- ~6 - ~e-~ OPERATOR. Every person other than a chauffeur, viho drives or is in actual physical control of a motor voh3.cle upon a highway or street or vrho is exercising control over or steer- ing a vehicle being towed by a motor vehicle. Oi"1~<E'R. A person, other than a lienholder, having; the property in or title to a vehicle. The term includes a person entitled to the use and possession of a vehicle su'oject to a security interest in another person, 'out excludes a lessee under a lease not intended as security. Pr=f~ OR PF,Af~Ii~TG. Means t'ae standing of a vehicle, whether occu- pied or not, otherwise than temporarily for the purpose of and while actually enmaged in loading or unloading merchandise or passengers. PASS'~'T,,GER CURB LOI,DIi~IG ZONE. A place adjacent to a curb re- served for the exclusive use of vehicles during the loading or unloading of passengers. PE7ESTRIAi~i. Any person afoot. POLICE O,yFICF,R Every officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. PRIVATE ROAIx"d~.Y OR DRIVEti~JAY. Every way or place in private ownership and used for vehicular travel by the ovaner and those hav9_ng express or implied permission from the owner, but not by other persons. RAILROAD. A carrier or persons or property upon cars, other than streetcars, operated upon stationary rails. RAILROA~J SIGPT 0?R SIGNAL. Any sign, signal or device erected by authority of a public body or official or by a railroad and in- tended to give notice of the presence of railroad tracks of, the approach of a railroad train. R =ILRUAD TR~'~ITd. A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars. 3 REGISTRATION. The registration certificate or certificates and registration plates issued under the laws of this state pertain- ing to the registration of vehicles. RIGHT OF 'uJlzY. ^lhe privilege of the immediate use of the roadway. ROP.33~IVAY. That portion of a street improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a street includes tvvo or more separate roadway, the -3- ~/~ -~-/ term "roadway" as used herein shall refer to any such roadway separately, but not to all such roadways collectively. _ SrzFETY ZONE. The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is pro- tected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a saf ety zone. SCf300L BUS. Every motor vehicle owned by a public or govern- mental agency and operated for the transportation of children to or from school or privately ovrned and operated for compen- sation for the transportation of children to or from school. SIDEo~'ALK. That portion of a street between the curb lines, or the lateral lines of a road~~ay, and the adjacent property lines, intended for use of pedestrians. STAND OR STANDINCs. Means the halting; of a vehicle, vrhether occu- pied or not, othervrise than temporarily for the purpose of and while actually engaged in receiving or discharging passengers. STOP. When required, means complete cessation from movement. STOP OR STOPPING. When prohibited, means any halting even mo- mentarily of a vehicle, whether occupied or not, except when necessary to avoid confl9_et with other traffic or in compliance with the direction of a police officer or traffic-control sign or signal. STREET. The entire width between boundary lines of every way publicly maintained tivhen any part thereof is open to the use of the public for purposes of vehicular travel. THROUGH HIGH'frAY. Every highway or portion thereof on which vehicular traffic is given preferential right of way, and at the entrances to which vehicular traffic from intersecting highways or streets must stop or yield the right of way. THROUGH STREETS' Every street or portion thereof on which ve- hicular traffic is given preferential right of way, and at the entrances to which vehicular traffic from intersecting streets is required by law to yield right of way to vehicles on such through streets in o'oedience to either a stop sign or a yield sign, when such signs are erected as provided in this .sir&i'narLCe. TRAFFIC. Pedestrians, ridden or herded animals, vehicles, st- reetcars and other conveyances, either singly or together, while using any street for purposes of travel. ~~- TRAFFIC-COPJTROL SIGN. All signs, markings and devices, other than signals, not inconsistent with this chapter, placed or erected by the authority of the Board of Aldermen, for the purpose -4- ~~ "~ `~ of guiding, directing, ~raarning or regulating traffic. TRAFFIC-CONTROL SIGNAL. hny device, whether manually, electric- _ ally or mechanically operated, by which traffic is alternately directed to stop or to proceed. TRUCK; Every motor vehicle designed, used or maintained pri- marily for the transportation of property. VEHICLE; Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, excepting devices moved by human power or used exclusively upon stationary rails or tracks. SECTIOI~I 2: TRArFIC ADi;~INISTRATI0P1; (a) Duty of Traffic Division. It shall be the duty of the police department, to enforce the traffic regulations of this municipality and all of the state vehicle laws applicable to street traffic in this municipality to make arrests for traf- fic violations; to investigate accidents and to cooperate( ~e e~3= ear end-) other officers of the munici- pality in the administration of the traffic laws and in develop- ing ways and means to improve traffic conditions; and to carry out those duties specially imposed upon the division by this ordinance and other traffic ordinances of this city. (b) Records of Traffic Violations. The Police Depart- ment shall keep a record of all violations of the provisions of this ordinance and other traffic ordinances of this mun- icipality of vrhich any person has been charged, together with a record of the final disposition of all such alleged offenses. Such record shall be so maintained as to show all types of vio- lations and the total of each. Such record shall accumulate during al least a five-year period and from that time on the record shall be maintained complete for at least the most re- cent five-year period. All such records and reports shall be public records. (c) Traffic division to Investigate Accidents. It shall be the duty of the police department, to investigate traffic accidents, to arrest and to assist in the prosecution of those persons charged with violations of law causing or contribut- ing to such accidents. _ SECTION 3 ; EDtFORCEI4~ETdT APtD OBia"DIEIQCE TO TRAFF'TC REGULATIONS . (a) Authority of Police and Fire Department Officials. It shall be the duty of the officiers of tkie police department or such officers as are assigned by the chief of police to en- 5~ -5- force all street traffic laws of this municipality and all of the state vehicle laws applicable to street traffic in this municipality. Officers of the police department or such off- icers as are assigned by the chief of police are hereby author- ized to direct all traffic by voice, hand or signal in conform- ance vrith the traffic laws; provided, that in the event of afire or other emergency or to expedite traffic or to safeguard ped- estrians, officers of the police department may direct traffic as conditions may require, notwithstanding the provisions of the traf- fic laws. Officers of the fire department, when at the scene of afire, may direct or assist the police in directing traffic there- at or in the immediate vicinity. (b) Required obedience to ordinance. It shall be unlawful for any person to do any act forbidden or fail to perform any act required in this ordinance. (c) Obedience to police and fire department officials. No person shall wilfully fail or refuse to comply with any law- ful order or direction of a police officer or fire department official. (d) Persons Propelling Pushcarts or Riding Animals to Obey - Traffic Regulations. Every person propelling any pushcart or riding an animal upon a roadway, and every person driving arty animal-drawn vehicle, shall be subject to the provisions of this ordinance applicable to the driver of any vehicle, except those provisions of this chapter which by their very nature can have no application. (e) Coasters, roller skates and similar devices restricted. - - -- __ _ No person upo~~ n-ro1'~er skates, or r~~,g or by means of any coaster, toy vehicle or similar device shall go upon any road- way, except wahile crossing; a street on a crosswalk, and when so crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to ped- estrians. (f) _.~ublic employees _to obe~_traffic regulations. The provisions of this ordinance sha~I. apply -fo""the driver of any vehicle owned by or used in the service of the United States Government, this State, County or City and it shall be unlawful for any such driver to violate any of the provisions of this chapter, except as otherwise permitted in this ordinance or by state statute. (g) Exemptions to Authorized Emergency Vehicles. ------ The prow s ons o s o""rd3nance regulating "the `operation, parking and standing of vehicles shall apply to emergency vehicles, as defined in this ordinance, except as follows: - fi- ~~-~-~ rr A driver when operating any such vehicle in an emergency, ex~ ~ept when otherwise directed by n police officer, may; - (1) Park or stand notwithstanding the provisions of this ord- nance. (2) Proceed past a red light or stop signal or stop sign, but only after slowing down as may be necessary for safe operation. (3) Exceed the speed limits so long as he does not endanger life or property. (L) Disregard regulations governing directions of movement or turning in specified directions so long as he does not endanger life or property. Those exemptions hereinbefore granted in ref erence to the move- ment of an anthorized emergency vehicle shall apply only when the driver of such vehicle sounds a sirens bell or exhaust whistle, as may be reasonably necessary, and the vehicle displays a lighted red lamp visible from the front as a warning to others. The foregoing exemptions shall not, however, protect the driver of any such veh- icle from the consequences of his reckless disregard of the safe- ty of others. (h) Operation of Vehicles on Approach of Authorized loner en~cy. Vehicles. (i) Immediate report of accidents and duty to stop. SECTION 10; AUTTzORITY TO IT~?STALL TRAFFIC-COTZTROL DEVICES. The police Department shall have the authority to place and maintain traffic-control signs, signals and devices when and as required by the Board of Aldermen, under the provisions of this ordinance and other traffic ordinances of this municipality, to make effective such provisions. SECTIUIv 11: n4ATv`[.TAL ATv'D SPECIFICATIONS FOR TRAI'F1C-CONTROL DEVICES. Traffic signs and signals shall conform to the standards estab- lished by the Pdational Conference on Street and Highway Safety. All signs and signals designated for a particular purpose shall, so far as practicable, be uniform as to location throughout the municipality. All Traffic-control devices so erected and not in- consistent uaith the provisions of state law or this ordinance shall be official traffic-control devices. SECTIOTd 12: Erection prerequisite to enforcement. No provisions of the ordinance for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation, an official sign herein required. is_~ot in_proper position and sufficiently legible. ~'Pfienever a particular section does nbt state that signs are required, such action shall be eff ective without signs being erected to give notice thereof. SECTION 13: OBEDIEAICE TO TRAT'FIC SIGTdS I~IdD SIGNALS . Operators of all vehicles are reguired to observe the in- structions of all official traffic signs placed under the pro- - visions of this ordinance. Such signs shall include all letter- ed signs, all buttons, all curbings, all mechanical traffic sig- nals, and all paint marks, placed upon the surface of the road- way. SECTIOTd l~_: 'PRAFFTC-COTdTROL SIGNAL LEGEDTD. Whenever traffic is controlled by traffic-control signals ex- hibiting the words "GO", "CAUTION", or "STOP", or exhibiting dif- ferent colored lights successively one at a time, or with arrows, -9- ~ ~~~ -~ the following colors only s'nall be used and such terms and lights shall designate and apply to drivers of vehicles and pedestrians as follows: (a) green alone or "GU" 1. Vehicular traffic facing the signal may proceed straight through or turn right or left unless a sign at such place pro- hibits either such turn. Eut vehicular traffic, including veh_icles_ turning right or ~eft,~-fiart-y~Td the right of way to other vehicles and to pedestrians lawfully within the in- tersection or an adjacent crosswalk at t'.ne time such signal i~..exhib`ited. 2. Pedestrians facing the signal may proceed across the road- way within any marked or unmarked crosswalk. ('o ) STEADY YELLObV ALONE. 1. Vehicular traffic facing the signal is thereby ti^rarned that the red or "STOP" signal will be exhibited immediately there- after and suc'a vehict~].a~_traff_c shall not .enter _or,,be_ cxoss- _,- in,~, the intersection vahen the red or "-STOP" signal is exhibt- _ __ - --~ _-- e . 2. Pedestrians facing such signal are thereby advised that there is insufficient time to cross the roadway, and any ped- estrian then starting to cross shall yield right of vray to all vehicles. (c ) STEADY R~ ALUivE, OR "STOP't . 1. Vehicular traffic facing the signal shall stop before enter- ing t'ne crosswalk on the near side of the intersection; or, if none, then before entering the intersection and shall remain standing until green or "GO" is shown alone. 2. DIo pedestrian facin~ such signal shall enter the roadwray unless he can do so safely and without interferring with any vehicular traffic. (d ) S TEARY RED '.v' ITH GRT~;E~Pi ARROV~ 1. Vehicular traffic facing such signal may cautiously enter the intersection only to mare the movement indicated by such arrow, but s'nall yield the right of way to pedestrians lavr- fully within a crosswalk and to other traffic lawfully using the intersection. 2. IQo pedestrian facing such signal shall enter the roadway unless he can do so safely and vrithout interferring with any vehicular traffic. /Z -10- '~~ - f~ -/ fie) In the event an official traffic-control signal is er- ected and maintained at a place other than an intersection, the provisions of this section shall be applicable except as to those provisions which by their nature cam have no app- lication. Any stop required shall be made at a sign or mask- ing on the roadway indicating where the stop shall be made, but in the absence of any such. sign or marking the stop shall be-made at the signal. The driver of any vehicle shall yield the right of way to ped- estrians crossing the roadway within any marked crosswalk or with- in any unmarked crosswalk at the end of a block, except at inter- sections where the movement of traffic is being regulated by a police ~afficer of traffic-control signals. All turning movement shall be made with due caution and circumspection at a speed or in a manner so as not to endanger any person or property. Upon x.11 streets, except upon one-vaay streets, the driver of a vehicle shall drive the same upon the right half of tine road- vray except vrhen overtaking and passing another vehicle, subject to the limitations set forth in this article. The driver of a vehicle overtaking another ve'nicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right until safely clear of such overtaken vehicle. The driver of an overtaken vehicle shall rive way to the right in favor of the overtaking vehicle on suitable and audible signal and shall not increase the speed of his vehicle until completely passed by the overtaken; vehccle. Every person parking a motor vehicle on any public street or alley in this municipality shall remove and take with him tine key to the ignition thereof, and it shall be unlawful for any person to fail to remove such key. The police department is hereby authorized in it discretion, in addition to any -_~enalty that may be provided therefor, to remove a.ny unidentified, stolen, wrecked or abandoned motor vehicle or other personal ~oroperty found upon any ,public street or other ~~ublic =property of this municipality and shall keep the same in it custody and control at such place as may be designated 'oy the police department until rodeemed by the owner thereof, as hereinafter provided; and all such unidentified, stolen, wrecked or abandoned motor vehicles or other personal property vrhich nor is in the possession and custody of the police -3or ~~ ~-I~-1 department or v~hich may hereafter come into its possission sn.all be subject to the actual cost of removal or tow-in from the public place and a reasonable storage charge for as lone as the s~_me is in possession and custody of the department of t'ne City. 'Unidentified motor vehicle or other personal property", as used in this section, is hereby defined to be such motor vehicle or other personal property v,here oi~rnership therof cannot be as- certained. "Abandoned motor vehicle or other personal property", is here- by defined to be an automobile or personal property vaiiich remains upon the streets or other public property for a period ]_onger than forty-eight hours, the oti~rner of v~rhich cannot be located or the owner refuses to remove the same. Vdhenever the clerk or chief of police shall decide to offer impounded properties for sal©, he shall publish such sale at least once in a nevrspaper published in the county, at least five (~,} days before such sale. Such publications shall briefly des- cribe the property, and, where motor vehicles are to be sold, shall give the manufacturers name, model,a~d motor num'oer. SrCTIOT~T 101: SAisiE --- PROOF OP OIYIIErtSHIP; RE3~ETuP^lI0'iv. Any person claiming to be the owner of any impounded oro- perty as in this article provided shall make written appli- cation therefor to the police department and shall furnish to such department such additional proof as may be required to establish. such ownership. If he shall present to the pol- ice department such proof of his ownership of such impounded property prior to the date of actual sale thereof pursuant to the provisions of sections 99 and 100 , then the property it- self shall be delivered to the ov4~ner under the conditions here- in provided; but, if such property has been sold, then the pol- ice department shall endorse its findings of ownership with a copy of the written application addressed to the clerk, and the owner may present such applications and findings to the clerk and if presented within one (1) year after such sale, then such 'oalance of the proceeds of the sale, after deductions as in this article provided, shall be paid to the owner. The bureau shall be under the charge of the clerk of the police court a.nd shall be open at such hours as the clerk may designate. (a) Any person charged with an offense listed in section 103-(c) shall have the option of paying the minimum fine listed in said subsection (c) hereof within the time speci- fied in the notice of arrest at the traffic violations bureau upon entering a plan of Guilty and upon v^~aiving appearance in court; or may have the option of deposit- ing required bail, and upon a plea of Not rsuilty shall be entitled to a trial as authorized by law. -32- ~6-~~~. SECTIOT~? lOl~_; DUTIES OF TRAF14'IC VIOLATIONS BUREAU (1) It shall accept designated fines, issue receipts, and represent in court such violators as are premitted and desire to plead guilty, waive court appearance, and rive power of attorney; (2) It s'na.ll receive and issue receipts for cash bail from the persons who must or wish to be heard in court, enter the time of their appearance on the court docket, and notify the arresting officer and witnesses, if any, to be present. ~~ -~ -33- '~ 11 SECTION 105: TRAFFIC VIOLATIONS BUREAU TO KEEP RECORDS. The traffic violations bureau shall keep records and submit summarized monthly reports to the municipal court of all notices issued and arrests mdde for violations of the traffic laws and ordinances in the City and of all the fines collected by the traffic violations bureau or the court, and of the final disposi- tion or present status of every case of violation of the provi- sions of said laws and ordinances. Such records shall be so maintained as to show all types of violations and the totals of each. Said records shall be public records. SECTION 106: TRAFFIC TICKETS -- GENERALLY. Whenever any person is arrested for violating any provision of this ordinance, the arresting officer may take the violator's name, address and registration number of the motor vehicle in- volved, and issue to him, in writing, upon a form provided by the clerk of the police court, a notice to answer the charge against him within ten (10) working days from the date of the violation excepting Sundays and legal holidays, at the office of the Clerk of the police court. The offices shall thereupon, and on the giving of the violator of his written promise to answer as specified in the notice, release him from custody. The arresting officer shall send his copy of such notice to the clerk of the police court. AnY~erson_who wilfully violates, --- _.. .his written promise to appear, given in accordance with this section, shall be guilty of a misdemeanor regardless of the dis- position of the charge upon-which he was originally arrested. SECTION 107: PENALTIES Any person violating any provisions of this ordinance shall, upon conviction be subject to a fine of not more than $100.00 or 9d days in the city jail or both such fine and imprisonment.
