ORDINANCE N0. 7`~ ~ ~o
AN ORDINANCE PROHIBITING THE OPERATION OF A MOTOR VEHICLE
WHILE INTOXICATED, REPEALING ALL ORDINANCES IN CONFLICT THEREWITH
AND FIXING A PENALTY FOR THE VIOLATION OF SAID ORDINANCE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
RIVERSIDE, MISSOURI, AS FOLLOWS:
Section 1: Driving Motor Vehicle While Intoxicated.
No person shall operate or be in actual physical control of any
motor vehicle while in an intoxicated condition.
Section 2: Evidence of Intoxication.
Upon the trial of any action or proceeding arising out of the
acts alleged to have been committed by any person while
driving or in actual control of a motor vehicle while in an
intoxicated condition, evidenced by the amount of the alcohol
in the persons blood at the time alleged to have been shown
by a medical or chemical analysis of his breath, blood, urine,
saliva or other bodily substance is admissible.
Section 3: Penalties for Violation.
a. First Violation. Every person who is convicted of a
violation of this ordinance shall be punished by imprisonment
in a place designated by law for not less than 30 days nor
more than 1 year or by fine of not less than $10.00 nor more
than $500.00 or by both fine and imprisonment.
b. Penalty for Subsequent Violation. If the person found
guilty of driving while in an intoxication condition shall
have previously been convicted of driving while in an intoxicated
condition, he may be punished by imprisonment in the place
designated by law for not less than 30 days nor more than 1
year or fine not less than $200.00 nor more than $500.00 or
punishment of both fine and imprisonment.
c. Evidence of Conviction. For the purpose of this
section t e record ept by the Clerk of the Court in which
the person was convicted or certified copies of said record
shall be admissible as prima facie evidence of such conviction.
Section 4: Repeal of Previous Ordinances.
All ordinances in conflict with this ordinance are hereby
expressly repealed.
