IN ORDINANCE TO AUTHORIZE THE MAYOR TO INACT CURFEWS, REGULATE THE CLOSING
OF BUSINESS, STREETS, AND CLUBS, AND TO ORDER THE DISCONTINUANCE OF SALES OF
HAZARD6DS P9ATERIALS, IN TIME OF CIVAL EM.:RGEIdCY.
BE IT ~tDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RIVERSIDE, MISSOtTRI,
AS FOLLOWS:
SECTION L. Whenever, ;in the judgement of the mayor, or in event of his
inabih y o ac the mayor pro-tempore, a sta~.e of civil emergency exists as a
result of mob action, riots, general civil disobedience or disorder, or the threat
of any of the same shall exist, the mayor shall, in addition to all other powers
granted him by the laws of this state and ordinances of the city, be empowered~in
order to protect its citi2ens and their property~to issue a
proclamation declaring a state of civil emergency to exist and may thereby
exercise the powers grant d in the following subsections:
(a) To impose a cur~ew upon all or any portion of the cif as designated
therein as he may deem advisable during such hours of the day or night as
he determines necessary in ih a interest of the public safety and welfare, and
during which all persons shall remove themselves to their places of resi-
dence and remain off and away from the public streets, sidewalks, parkways,
parks and all other public or open places, and no persons shall assemble,
gather, ~,oiter or otherwise eongre~ate in any manner in groups, assem-
blies or meetings in anp place for arty purpose whatsoever; provided,
however, th at persons perfor~rd.ng medical services, essential public
utility services, public officials, policemen, firemen, add all other
persons explicitjy enumerated ixi such proclamation may be exempted from
curfew;
(b) To order the closing of any and all business establishments throughout the
city or az~y portion therof during the period for which the state of
emergency exists or during the curfew hours;
(c}- To order discontinuance of selling, distributing, dispensing or giving away
of any fire arms or ether weapons of arty character whatsoever;
(d) To order the cb sing of env or all establishments or portions theroof,
the chief activity of which is the sale, distribution, dispensing or
giving away of fire arms or arrnnunition or other weapons of any character
whatsoever;
(e) To order the closing of all retail and wholesale liquor stores, taverns
and other places dispensing, serving or permitting the consumption of
intoxicating liquor or non-intoxicating beer;
if) To order the discontinuance of the sale, distribution, or giviing away
of intoxicating or non-intoxicating liquors;
(g) To order the closing of all private clubs or portions thereof wherein the
consumption of intoxicating liquor or non-intoxicating beer is permitted;
{h) To order the discontinuance of selling, distributing or giving away
gasoline or other liquid flammable or combustible products i.n any con-
tainer other than a gasoline tank properly affixed to a motor vehicle;
(i) To order the closing of gasoline stations and other establishments, the
chief activity of which is the sale, diatribution or dispensing of gasoline
or other liquid f~nnable or combustible products;
(j) To designated any public place, public street, thoroughfare, boulevard,
parking area and any other place closed to motor vehicles, persons and
pedestrian traffic;
(k) To order all regular, special and auxiliary policemen, firemen, and other
conservators of the peace to report for duty assignment, such reporting to be in
accerdar_ce with prearranged plans or under the direction of lawful suthoxity.
SECTION 2. Az~Y;-such proclamation of a state of emergency shall become
imme i.a e a active upon its execution and issuance by the mayor, and the original
thereof shall. be filed and remain in the office of the city clerk.
SECTI~I 3. The proclamation issued in accordance with the provisions of this
ordinance a _ remain in effect continuously from the date and time of the issuance
thereof for sucFi period of time as specifically prescribed therein or upon th e
iseuarce of t proclamation determining a civil emergency no Longer exists,
whichever occurs first.
SECTICh~i 4. It shal] be urlawful for any persor, to fail, neglect or refuse
to C0.'71p ,`471 the orders made or prohibitions instituted by a proclamation
issued under the provisions of this ordinance, or for any persor_ to otherwise
violate or in ar~p manner did, assist, encourage or countenance the commission or
per~letrz.tion of a violation of said proclamation, commission or perpetration of a vio-
lation. of said proclamation, and upon, conviction thereof, any such person shall
re punished and upon conviction thereof, a~ such person shall be punished I€~C
by a fine of not less than X25.00 and not more than ~~00.00, or by imprisonment in~~~'-
the municipal penal correctional insti tior. for a period of time not less than ~~~
one (1) day and not more than ~-(~.' For the purpose of the prosecution of
any person for the violation of this ordinance, a copy of the proclamation of the
mayor r_.ertified by ttae city clerk to be a true and correct copy thereof shall
be deemed to constitute prima facie evidence that such proclamation was c;uly issued by
the mayor on the date and at the time set forth therein pursuant to the authority
contained in this ordinance.
