AN ORDINANCE AUTHORIZING THE CITY OF RIVERSIDE, MISSOURI TO ENTER
INTO A CONDUIT/EQUIPMENT INSTALLATION AGREEMENT WITH BLACK &
MCDONALD, LLC
WHEREAS, the City of Riverside, Missouri a duly organized and existing fourth-class city
under the laws of the State of Missouri ("City" or "Owner"), and Black & McDonald LLC
desire to enter into an agreement for the installation of certain conduit/equipment for
streetlights ("Agreement") by and between them regarding the street entryway(s) to that
certain real property consisting of approximately one hundred thirty (130) acres,
commonly known and numbered as 6150 NW Music Boulevard, Riverside, MO 64150
("Premises"); and
WHEREAS, before Evergy can complete the installation of the streetlights leading to the
Premises, certain conduit and other equipment (collectively, "Equipment") needs to be
installed; and
WHEREAS, the City desires to expedite the installation of equipment by Evergy along
Horizons Parkway/Music Blvd/41 st & Helena, 39 th & Helena as the timely completion of
said installation is in the best interest of the City and the mutual interest of both Parties;
and
WHEREAS, Evergy has informed the Mayor, the Community Development Director and
the City Engineer that they approve the City retaining the services of Black & McDonald,
an approved subcontractor of Evergy, to install the conduit and other equipment needed
to be installed prior to Evergy's installation of the streetlights; and
WHEREAS, Black & McDonald has proposed the City enter into an agreement to install
conduit and electrical feed for streetlights serving the street entryway(s) of Horizons
Parkway/Music Blvd./41 st & Helena, 39 th & Helena [collectively "Street Entryway(s)"] to
the Amphitheater; and
WHEREAS, City Staff recommends that the Board of Aldermen, pursuant to and in
compliance with Section 135.080.D of the City Code of the City of Riverside, Missouri
("Code"), find it is in the best interest of the City to accept and execute the Proposal and
to approve and authorize the City to accept and execute the Proposal and enter the
agreement for the installation of the Equipment with Black & McDonald ("Agreement")
attached hereto as Exhibit A, and incorporated herein without utilizing the City's bidding
procedures; and
WHEREAS, the Board of Aldermen pursuant to Section 135.080.D of the City Code finds
and determines that it is in the best interest of the City to authorize the City to enter into
the Agreement and to do so without requiring City bidding procedures otherwise provided
for in Section 135.080 of the City Code; and
WHEREAS, the Board of Aldermen find that authorization of the Agreement fulfills a
public purpose and will provide an opportunity to further the growth of the City, facilitate
the development of Riverside, improve the environment of the City, increase the assessed
valuation of the real estate situated within the City, increase the sales tax revenues

realized by the City, foster increased economic activity within the City, increase
employment opportunities within the City, and otherwise be in the best interests of the
City by furthering the health, safety, and welfare of its residents and taxpayers.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
SECTION 1 -BEST INTEREST OF THE CITY TO AUTHORIZE THE CITY TO ENTER
INTO A RIGHT OF ENTRY AGREEMENT. It is in the best interest of the City, in order
to provide an opportunity to further the growth of the City, improve the environment of the
City, foster increased economic activity within the City, increase employment
opportunities within the City, further the objectives of the TIF Plan, further build out the
public infrastructure and otherwise is in the best interests of the City by furthering the
health, safety, and welfare of its residents and taxpayers, to authorize the City to enter
into the agreement for the installation of conduit & electrical feed for streetlights ("the
Equipment") with Black & McDonald ("Agreement") attached hereto as Exhibit A, and
incorporated herein.
SECTION 2 -AUTHORITY GRANTED. The Mayor, City Administrator, Special Counsel
to the City-Spencer Fane LLP, and other appropriate officials and employees of the City
are hereby authorized and directed to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Ordinance and to
execute and deliver for and on behalf of the City all agreements and other documents as
may be necessary or convenient to perform all matters herein authorized.
SECTION 3 -EFFECTIVE DATE. This Ordinance shall be in full force and effect from
and after its passage and approval.
BE IT REMEMBERED that the above was read two times by heading only,
PASSED AND APPROVED by a majority of the Board of Aldermen and APPROVED by
the Mayor of the City of Riverside, Missouri, this 19th day of May 2026.

SCOPE OF WORK TO BE PERFORMED: Supply and install 1,000' of2" conduit with string, set one transformer pad ,
set one sectionalizer cabinet (supplied by Evergy), and set one secondary pedestal (supplied by Evergy). Install
approximately 7,000' of cable in conduit for streetlight feed (Evergy to supply cable in conduit). Evergy also to supply
grounding materials and 36" elbows .
Exclusions and clarifications:
1. Quote does not include sales tax. Taxes will be applied unless project is tax exempt and project tax exemption
certificate is provided .
2 . Any permits or fees are excluded .
3. Any major traffic control is excluded.
4. Surface Restoration (patching only) is included. Mill and overlay not included .
5 . Rock Clause : Prices are for good to fair ground. Boring of rock is not included and will be priced separately per foot.
6 . Quote is valid for 45 days .
7. Excessive delays beyond our control will be billed at T&E rates.
We propose to complete the project according to the plans for the sum of: One hundred thirty-one thousand , two
hundred forty-eight dollars and seventy-two cents ..................................... $131 ,248.72
