HomeMy WebLinkAbout1952-66 Finding and Declaring It Will Benefit City to Extend City Limits over Adjacent Territory Calling Special Election Submitting Proposal Extension be Consented ToBILL NO. 66 ORDINANCE NO. 66 AN ORDINANCE FINDING AND DECLARING THAT IT WILL REDOUND TO THE BENEFIT OF THE CITY OF RIVERSIDE TO EXTEND ITS CITY LIMITS OVER TERRITORY ADJACENT THERETO; PROVIDING FOR THE CALLING OF A SPECIAL ELECTION AUTHORIZING AND DIRECTING THE SUBMISSION THEREAT OF A PROPOSAL THAT SUCH sxTENSION BE CONSENTED TO. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF TEE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS: SECTION 1. The Board of Aldermen of the City of Riverside, Missouri finds and declares that it will redound to the benefit of the city to extend its city limits to include all lands lying within the following described boundaries situate in platte County, Missouri: Beginning at the Southeast corner of platte County, Missouri, being on the boundary line of the State of Missouri as it proceeds along the Missouri River and being also the outhwest corner of Section 10, Town- ship 50N, Range 33; Thence North along the East line of said platte County to the center line of U. S. Highways 69 and 169; thence Southwesterly along the center line of said U.S. Highways 69 and 169 to the intersection of the center line of Line Creek with said center line of said U. S. Highways No. 69 and 169; thence in a Northerly direction following along the center line of said Line Creek (said center line • of Line Creek being also the Westerly boundary line of the Town of Northmoor, Missouri) to the North line of the Southwest quarter of Section 33,Township 51N, Range 33, (said North line of said quarter section being also the center line of said Section 33); thence West along the center line of said Section 33 to the West line of Said Section 33 and continuing thence West along the center line of Section 32, Township 51N, Range 33 to the center of said Section 32, Town- ship 51N, Range 33; thence South along the center lihe of said Section 32 to the South line of Said Section 32 and continuing thence South along th or n g of Section 5, Township SON, Range 33to flh8 ex cti l Northot of said center line of Section 5 with he north right- of-way line of State Highway No. 45; thence West along a line parallels to and 300 feet distant from the north right-of-way line of said State Highway No. 45 to the intersection of said north right-of-way line of State Highway No. 45 with the present East boundary line of the City of parkville, platte County, Missouri; thence souhh along the East boundary line of the City of Parkville, Mo. and a prolongation thereof to the boundary line of the State of Missouri, being in the Missouri River; thence Easterly along the boundary line of the State of Missouri, said line being in the Missouri River, to the point of beginning. SECTION 2. Since the Constitution and laws of the State of Missouri do not confer power and authority upon the Board of Aldermen of this City to extend its city limits without the consent of a majority of the legal voters of the city Voting at an election therefor, 4 special elec- tion is hereby ordered to be held at the voting places in said city,used as voting places in the last general city election,on the 7th day of October, 1952, between BILL NO. 66 CONT'D- p-2 ORDINANCE NO. 66 the hours of six o'clock A. M. and seven o'clock p:M. or sundown of said day whichever may occur. later, at which election it is hereby ordered to be submitted a proposal in proper form to determine the consent of the voters voting thereat to the extension of the City limits to the limits stated in Section 1. of this ordinance. SECTION 3. The extension set forth herein, if consented to by a majority of the legal voters of this city toting at said election, shall become effective _____. SECTION 4. The City Clerk is herby ordered and directed to give notice in there successive issues of the platte County Gazette, a weekly newspaper printed and published in the County of platte and of general circulation in the City of Riverside, the first notice to appear in the September 11, 1952 issue of said paper. The said notice shall in substance set forth that there will be held under the order of the Board of Aldermen a special election on the 7th day of October, 1952, between the hours of six o'clock A.M. and &;00 P.M. or sundown of that day whicherver maybe later, to determine whether a majority of the legal voters voting at the election consent to the extension of the city limits to the following named boundaries situate in Platte County, Missouri: Beginning at the Southeast corner of Platte Coutny, Missouri, being on the boundary ling of the State of Missouri as it proceeds along the M ssouri River and being also the Southwest corner of Section 10, Town- ship 50N, Range 33; Thence North along the East line of said platte County to the center line of U.S. Highways 69 and 169; thence Southwesterly along the center line of said. U.S. Highways 69 and 169 to the intersection of the center line of Line Creek with said center line of said U.S. Highways No. 69 and 169; thence in a Northerly direction following along the center line of said Line Creek (said center line of Line Creek being also the Westerly boundary line of the Town of Northmoor, Missouri) to the North line of the Southwest quarter of Section 33, Township 51N, Range 33, (said North line of said quarter section being also the center line of said Section 33); thence West along the center line of said Section 33 to the West line of said Section 33 and continuing thence West along the center line of Section 32. Townshp 51N. Range 33 to the center of said Section 32, Town- ship 51N, Range 33; thence South along the center line of said Section 32 to the South line of said Section 32 and continuing thence South along the center line of Section 5, Township 50N, Range 33 to a point 300 feet North of the intersection of said center line of Section 5 with the north right-of-way line of State Highway No. 45; thence West along a line parallel to and 300 feet distant from the north right-of-way line of said State Highway No. 45 to the intersection of said north right-of-way line of State Highway No. 45 with the present East bounday line of the City of parkville, platte County, Missouri; thence South along the East bounds® line of the City of parkville, Mo. and a prolongation thereof to the boundary line of hhe State of Missouri, being in the Missouri River; thence Easterly along the boundary line of the State of Missouri, said line being in the Missouri River, to the point of beginning. Poll book, tally sheets and ballots to be used by the voters in said special election are herby ordered printed and delivered by the proper officials in due time for the use of the judges and clerks of the election and the voters thereat.
