AN ORDINANCE ESTABLISHING INSURANCE REQUIREMENTS AND A PERMIT
AND FIRE STANDBY FEE FOR FIREWORKS, PYROTECHNICS, FLAME EFFECTS,
AND SIMILAR SPECIAL EFFECTS
WHEREAS, the City of Riverside, Missouri has adopted the International Fire
Code, which requires operational permits for the use, handling, storage, discharge, or
presentation of explosives, fireworks, and pyrotechnic special effects material; and
WHEREAS, the City desires to establish insurance requirements and an up-front
permit and Fire Department standby fee for applicable events.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
Section 1. Fireworks/Pyrotechnics Permit Requirements. For any event held that
includes fireworks, pyrotechnic special effects material, flame effects, flame-producing
devices, spark-producing devices, displays before a proximate audience, or similar
special effects, the event sponsor, event coordinator, venue operator, or
fireworks/pyrotechnics operator, as the case may be, shall obtain all operational permits
required by the City's adopted Fire Code before any setup, installation, discharge,
ignition, operation, or presentation of such materials or effects.
Section 2. Insurance Requirement. As a condition of issuance of the operational
permit, the applicant shall provide proof of commercial general liability insurance, or other
financial responsibility approved by the City, in an amount not less than four million dollars
($4,000,000.00) per occurrence.
Section 3. Permit and Fire Standby Fee. For each event requiring an operational
permit for fireworks, pyrotechnic special effects material, flame effects, flame-producing
devices, spark-producing devices, displays before a proximate audience, or similar
special effects, the applicant shall pay, before issuance of the permit, a permit and Fire
Department standby fee in the amount of $800.00. The fee includes the City's costs for
application review, inspection, standby personnel, fire watch, pyro watch, equipment, and
related Fire Department services for the permitted activity. No setup, installation,
discharge, ignition, operation, or presentation shall begin until the permit has been issued,
all required fees have been paid, and the Riverside Fire Department has approved any
required inspection.
Section 4. No Waiver of Other Requirements. This Ordinance does not waive,
modify, or limit any requirement of the City's adopted Fire Code, any City permit
requirement, Missouri law, federal law, NFPA standard, ATF requirement, or any
condition imposed by the Fire Chief or designee. Issuance of a permit does not relieve
the applicant, operator, property owner, event organizer, venue operator, or any other
responsible party from obtaining any other license, permit, approval, or authorization
required by law.
Section 5. Effective Date. This Ordinance shall be in full force and effect from and
after its passage and approval.
