HomeMy WebLinkAbout1982-09-28MINUTES OF REGULAR MEEING OF BOARD OF ALDERMEN OF CITY OF RIVERSIDE, MISSOURI SEPTEMBER 28, 1982 A regular meeting of the Board of Aldermen of the City of River- side, Missouri was held in the City Hal in Riverside, on September 28, 1982. On a roll call, aldermen West, Scudder, Rodeberg, Peeler Karr and Gordy were present, Mayor Holmes calling said meeting to order. It was decided to dispense with the reading of the minutes of September 21, 1982. Mayor Holmes announced that the reason for this meeting was the fact that over the past several months there have been various parties at the meetings to discuss the pros and cons of fire works and it has caused a little confusion. This Board wants to obtain an input as to what the general consensus is as far as the sub7'ect of f i reworks i s concerned. The basic concern is bottle rockets and thought the Board could handle this portion of the fire works. The Adyor and Board wants to find out about the display of fire works in general. If the discus- sion goes into fire works in general, there may be a possibility of putting it to a vote of the people. The Mayor advised the people that there was an ordinance passed sever- al years ago regulating the usage and area in rnthich fire works could be had in the City of Riverside. Chief Jerry Wingo spoke concerning enforcing the ordinances and making arrests. He said the officers have to witness the incident before making an arrest. Also in the cases of juveniles being involved, they cannot be arrested by our police, they can be held for a little while and their parents be notified. The juveni les are referrerd to Platte County Court. Chief Wingo said according to the records, since 1976 the have been called 14 times to extinguish fires lvich may have been started from fire works, but they have no way of proving this and the figures could not be relied upon. because sorrie fires may not have been reported. Dan Czam ansky, 4804 Hillside Road, spoke, saying that he is here in two capacities, one as a resident speaking in favor of fireworks in gener- al, including bottle rockets and he is also here to represent John Blogin, Jr. and Blogin Sales and also sp ea k in g on b eh a if of M ik e Koska relating to sale of fire works. Mr. Czamansky spoke concerning cities of fourth class does not have the p ower to pass laws to not allow the sale of fireworks within the city ~ however they do have the power a s to th e u se in th e city . T his of course pertains to Class C rated fire works. He advised that on behalf of Koska, Blogin and Young concerning the sale of fire works, any action that the Board would take against the sale of fire works would be taken to court. R©se Selleck, 4737 Platte Purchase Dr. presented a petition with 115 - signatures for banning sale and shooting bottle rockets in the City of River- side. Cora Sallee, 4737 Platte P urchase Dr., said the viynl top of her car was damaged by a bottle rocket. The viynl top of her car had to be replaced. a Reg. Meeting ___ Page 2, Sept. 28, 1982 E. H. Young, 401 N.W. Woodland, said he did not propose to take any stand on the fire works, one way or ther other, he just wanted to get someting in perspective: he said ther is an ordinance in existence being violated regarding fire works; that various land owners receive approximately $4,000 a year for rented fire work area, the City received approximately $7,000 in license fees; sales tax, approximately in excess of $2,000; approximately $20,000 is spent on advertising, which also helps other businesses out in Riverside; he felt the City, and the businesses did gain from the sale of fire works; that at the last meeting he attended someone remarked the City didn't need that money and in that case he suggested they cut the utilities tax. ~ Y. Bob Hardwick, 1903 N.W. 45 Riverside said he thinks the discus- sion is the danger of fire to homes and with no bottle rockets there is no danger, with bottle rockets there is the danger. Mike Koska, 2421 W. Vivion Road spoke concerning the testing of bottle rockets and that result showed there was no danger of the bottle rockets starting fires to roofs; he brought up the matter that lots of their business is in other areas; that he spends con- siderable money with other merchants in Riverside, that he does not handle other than class "C" fire works; he feels that the people should have the freedom of choice in shooting the fireworks and that if care is used in lighting them, there should be danger; he also brought up the fact that he has reals of movies to show should someone be interested in seeing them. Dan Czamansky presented two sheets of petition on the pro bottle rockets and wanted to bring out that there are 86 business on the petition. Mayor Holmes brought up the remark Mr. Young made " we do not ~~ need the money and explained that the Board was well aware that the businesses are the economy of the City by which we benefit the services to both the business community and citizens. Bill Woodside, Riverside, MO said personally he has not purchased fireworks for the past five years and would resent the fact not to be able to purchase them in Riverside. , Marilyn Brenner, 4909 Merrimac, said they were not trying to push out the selling of fire works, just ban the use of bottle rockets. Loyd Thrapp, Indian Hills said he is not personally against fire works, he feels that bottle rockets should be eliminated as they are hazardous. Reg. Meeting Page 3, 9-28-82 Al Manning, 11310 W. 74, Johnson County, Ks said he has sold fire works for many years and would like to continue to do so. John Blogin and Ileen Blogin, 9721 N.W. Overhill, K. C., Mo. spoke in favor of continuing to sell fire works in Riverside. A list of the people present is attached hereto and mde a part hereof. West moved that the discussion on fire works be discontinued for the present, seconded by Rodeberg, the roll was called and West, Scudder, Rodeberg, Peeler, Karr and Gordy voted in favor. Meeting Adjourned. Mayor Holmes thanked everyone for being present and discussing the matter, the meeting reconvened. West, Scudder, Rodeberg, Peeler, Karr and Gord; were present, Mayor Holmes preciding over meeting. E. H. Young, Riverside RED X presented application for remodeling the exterior of the accessory building of Red X (Post Office). Scudder moved that the Special Use Permit for the facade of Red X and accessory building be approved, seconded by West, the roll was called and votes were as follows: West, Scudder, Rodeberg, Peeler, Karr and Gordy voted aye. The application for the changing of the facade to Red X accessory building, namely the Post Office, was approved subject to the payment of the fee. Peeler brought up the fact that in back of the City Haul the drive way and parking area needed repairing. The Board agreed to have the people who was making the other repairs to the City Streets go ahead and repair this portion. Tom Stahl advised the Mayor that the project of repairing Fairfax Airport was the same plans as they wanted to do some time back. He felt that writing the Senators of the two states, Kansas and Missouri and MARC and the FAA telling them the situation that this would be about the best way to handle the matter. He would report to the City later. Bill Hall, Chairman of the Planning Commission spoke to the Mayor and Board that the Commission is planning to go over the Zoning Ordinance and perhaps make some changes. He suggested that the Board also make any suggestions they had concerning this Ordinance. The Board also brought up that the sign ordinance and perhaps some of the other ordinances could be reviewed. There being no further business, upon motion made, seconded and passed, meeting adjourned at 10:45 p.m. ~.~ .r~~~.
