BOARD OF ALDERMEN OF THE CITY
OF RIVERSIDE, Mo. Nov. 23, 1976
A regular meeting of the Board of Aldermen of the City
of Riverside, Missouri, was held in the City on November 23, 1976
at 7:30 p.m. The roll was called and Rodeberg, Brenner, Best,
Scudder, West and Swetnam were present. Mayor Young calling said
meeting to order.
The Mayor and'Board of Aldermen waived the reading of the
minutes of November 16, 1976.
Mayor Young advised the Board and people attending the
meeting that'the purpose of the meeting was to acquaint ourselves
and the person interested in flood insurance concerning the flood
plarri~t area. He said that is a very serious matter to a lot of the
property owners and that is the purpose of the meeting. We do not
feel that we understand it well enough~.to make a decision as the
counsel, we want people to understand it better. We have an outline
of what the flood insurance people expect of us. If we have a
complaint on what they have set up for us, we have to file the
complaint before December 15,1976. Mr. Young suggested that they
prepare for another meeting before that date. He also said that
Mr. Witt and Mr. Jack along with the Mayor and Board members have
spent much time on this, as well as the last Mayor and Board members.
It appeared to the Mayor that this area effects a lot of vacant
property that the pity had hoped would develop and the City would
receive revenues from and'help the growth of the City. What the
City ,hopes to determine is whether or not it would be better for all
parties concerned to accept this flood insurance of the Federal
Government or not to have the program.
Attorney Don Witt gave a history of the beginning of ~
the program for the flood insurance - that during the last floods,
the government (federal) helped the people with loans and other
funds an~fl the people in Washington wanted to e~minate this and
brought up the flood insurance plan. They are trying to put it on
the local city and town level and eliminate the federal aid. They
want the local political level to enact legislation to stopbuilding
in the flood pla4~ area unless the buildings are built in accordance
with the 100 year flood plan. These requirements were read by Mr. Witt.
What the Federal Government is trying to do is to eliminate any
subsidizing of people who have losses account of floods. This will
not effect the present buildings in the area, only the ones to be
built after this matter is accepted, if the City so accepts. Mr. Witt
brought out that if the City does not accept the Plan, then should
someone want to build in the area, they will not be able to get FDIC
approved mortgage financing which means that the banks and loan
companies cannot loan any money. It was thought that if the City
didn't go along with this program, the Federal Government may come
in and help once, but that is all. It was also thought that should
the City accept the program, it would cause the City to spend a
considerable amount of money in setting up the program. There ate s®me

Cities which are challenging the law, one in particular is Cape
Girardeau, Mis souri.
Don Jack brought up the matter that after the effective die of the
insurance, no residence can be built in the flood plaln~p area unless they
are built to the height of the flood area required. industries and business e;
that will be allowed to build will have to make them flood proof.
It was thought that the total increase in the construction for the flood
proofing would run from 38% to 50% more. If the levee were built, then
this would be no problem, it would take care of the flood proofing.
Some legal options - l.) We_:have a primary map of the flood area, we
can disagree with it and send in our differences to the legislative
agency, which in turn sends it to the Secretary of HUD and then it is
determined whether or not the present map is adequate or should be changed.
2.) We as a City do~ not have to accept the flood insurance program. In
this case there will be no federal grants, loans or federal help of any
kind for this area in the flood planes
3.) If we accept, then the zoning is amended to the map they have
given us.
(If we do not belong to the program, there is simply no federal help
or monies in the flood area. The revenue sharing can be used outside
the area andthere will be no SBA loans available.)
Mr. Azorsky inquired whether the insurance would expire for those people.
who now have it should the City decide to get out of the program.
West brought up that the Corps of Engineers were doing som~~~
and thought that there is still a possibility of the leve~ Per a

It was brought up as to whether ornot they have taken into the
consideration of the dams built up stream, and Don Jack thought that
they had done this when they had maped out the flood area.
The question was asked what would become of the people who have
a mortgage and in order to dbltaina mortgage they have to have flood
insurance.
Mayor Young asked whether or not the City could get out of the
program, once itwas accepted. Attorney Witt advised that the City could
get out of the program whenever it wanted to.
Brenner inqured whether there would be a bureau type of rate
adjustment for everything in the flood plane area, i.e, two buildings
side by side would the cost be the same ~ thousand or will it depend
on the pre~~at::..tax~.~-~ ,

Attorney Witt said that the cost of setting up the program cost
more money than the government would pay for flood loss through the
year 2000. .
Mayor Young advised that any individual has the right to disagree
with the flood pla~~ area as set out.
Mayor Young suggested that a committee be set up get information
regarding this insurance, perhaps a copy of the policy the rates, etc.
and Mayor Young stated as far as his personal thoughts are is that
he is nei~hte_ for or against it, he would be for the best.
It was brought out that the reason the government is setting up this
is they feel that the insurance carrier would be able to provide
insurance at a reasonable rate.
It was brought out that with regard to the levee, the main part
is for the people to provide the land.
Young advised that the people would be advised of the next
meeting and would try to have more answers, and more information.
Upon motion made, seconded and passed, meeting adjourned.
