M1NU'TES OF REGULAR MEETING OF
BUARD OF ALllERMEN OF CITY OF RIVERSIDE, MISSOURI
NOVEMBER 17, 1998
A regular meeting of the Board of Aldermen of the City of Riverside.
Missouri was held in the City Hall in Riverside. Missouri at 7:30 p.m. on November
17, 1998.
Those in attendance were: Mayor Ed Rule, Aldermen: Ron Super, Brenda
`Peters, Pamela Darata, Betty Burch, Ray Beard and George Flaws.
Also in attendance were Ann Daniels, City Administrator and irenc Yaulhc,
Secretary to the Board.
Minutes, 11-3-98 Alderman Beard moved to approve the Minutes of
November 3, 1998, as corrected, seconded by Alderman
Burch, the vote was:
Aye: Aldermen Super, Teters, Darata, Burch, Beard and
Flaws.
Motion carried.
Public Hearing on Mayor Rule announced that, since all the necessary
Chapter iV, Land notices were published, the Public Hearing on
Use, Revised Maps Proposed Revisions to Chapter 1V, Land Use, Revised Use,
!, and Planned District Maps and proposed Planned Use District was called to
order. A list of the public in attendance is attached
hereto and made a part hereof.
Ann Daniels, City Administrator summarized the revisions
made to Chapter IV, Land Use. a larger definition section
and more complete index, an up-to-date map showing the
different districts and a new separate section covering
the proposed Planned Usc District.
Comments of the Public:
LouAnn Layton LouAnn Layton, 4920 NW High Drive, inquired how a
Planned District is going to benefit the residents. She
recommended to leave the zoning the same, i.e. single
family district.
Kurt Eckard Kurt Eckard, 5116 NW Merrimac. thought the proposed
planned district was too broad, there should be
restrictions and the area should possibly be 15 acres
rather than five acres. He thought some changes
should be made and then maybe could get the planned
district subject moving.
Larry Reece Larry Reece, 4551 High Drive. said he served on the
Planning Commission. that initial vote on the Planned
District was a tie vote 5 to 5. The Chair Person asked
what to do. '1'hc Alderman changed his vote from "nay"

to "aye", making the 6 for the Planned District and 4
against. Larry Recce felt this was not done according
to Roberts Rules and it was simply because the Alderman
changed his vote that it passed. Larry Reece thought
the planned district is great, however. care should be
taken to where the planned district should be.
Mitchell Burch Mitchell Burch, 4930 NW High Drive. inquired who would
be responsible to take care of the Planned District. He
was not in favor of the Planned District in Ward III and
thought that Ward I was opposed to it. He preferred to
leave the R1 district as is, he was opposed to the
Planned District.
Janice Thom Janice Thom. 3620 NW 50th Street. thought this Planned
District has upset the neighborhood. If everyone cared
about the neighborhood, they would not allow the
Planned District.
Angus Thom Angus "Thom, 3620 NW 50th Street. asked who said this
would be another way to develop property in a
residential area.
Mayor Rule Mayor Rule said that people on the Planning Commission.
some engineers, thought this was a good idea.
Tim 'Trimble 7 Main Court, Parkville, MO spoke and thought that
there were some problems raised at this hearing and let
the people know there are several variations of a
Planned District. `i'hc most important thing about
Planned Districts is that unusable property (for
construction) can be incorporated in the district and
there could be more open space, and since the house can
be clustered, the same number of houses can be built on
the property, taking advantage of the terrain. Mr.
Trimble presented to the Mayor and Aldermen a
ested Ordinance for a Planned District wherein there

have been a number of changes from the presently
proposed Planned District.
Alderman Beard Alderman Beard felt that most everyone was opposed to
voting on the Planned District when they have not had
time to research the project and the new revisions
submitted by Mr. Trimble and will not make a snap
decision. He would want more time to study the matter
and the this would have to be brought back to the
Planning Commission.
Alderman Burch Alderman Burch thought it best to bring this project
back to the Planning Commission. She had very little

information on the Planned District. She has mixed
emotions and feels that there should be
only single family homes in the residential district. She
feels this should be taken back to the Planning
Commission and the Planned District should be shown as
Planned District, setting out a description of its
boundaries.
Alderman Flaws Alderman Flaws said that many of the residents werc
unhappy with the Planned District. He agreed it would
be best to bring it to the Planning Commission and go
from there.
Public Hearing Closed. Mayor Mule closed the Public Hcaring.
Bob 'Phill, Bob 1'hill, 13208 W. 76th Street, Lenexa. KS 66216,
Industrial Springs. Representing Industrial Springs. Inc., presented
Inc., Special Use Application for Special Use Permit in a Flood Hazard Area
Permit in Flood and Building Permit for an addition to Industrial
Hazard Area and Spring's, Building at 4205 NW Riverside Street. The
Building Permit. Planning Commission recommended approval of the
Applications.
Alderman Burch moved that the Special Use Permit in
Flood Hazard Area for Industrial Springs. Inc. be
approved. scconded by Alderman Flaws. the vote was:
Aye: Aldermen Flaws. Super, Beard. 'Peters, Darata and
Burch.
Motion Carried.
Alderman Burch moved that the Application for Building
Permit for Industrial Springs, Inc. be approved. seconded
by Alderman Darata, the vote was:
Aye: Aldermen Darata, Flaws, Burch, Super, Tetcrs and
Beard.
Motion carried.
Post Office Bldg. The Post Office properties' purchase has been closed and
the City has the lleeds. The Architects will havc
preliminary plans by the first of December, 1998.
Hoefer Wysocki Ar- Hoefcr Wysocki Architects delivered a signed Contract for
chitects, City Hall. the City to sign. however, they would like to have a
meeting with the Mayor and Board concerning the
Contract fees. The meeting wa set for Novemer 14, 1998
at 7:30 p.m.

High llrive Improve- Phase I on the High Drive Improvement is to be
mcnt. completed by November 25. 1998. It is planned that the
asphalt will be laid Friday, November 20, 1998. AYter the
asphalt is laid, Rose-Lan Construction will not do any
more work on the street until next spring.
Meeting re improve- Alderman Burch was present at the request of E. H.
went of Riverside St. Young at the meeting held regarding improvement of
Riverside Street and there weren't many comment.
Meeting re improve- Ann Daniels said that all but two owners of the property
went 50th Street. on 50th Street were against the improvement of the
Street and wanted it to be left as is. They did not want
the sidewalk.
Meeting re improve- The on-y comment regarding the improvement of St. Joe

Ceremony. Building at 7:00 p.m. on Saturday, November 21, 1998.
Meeting w/Hoefer There will be a meeting with Hoefer Wysocki Architects
Wysocki. on November 24, 1998. at 7:30 p.m. to discuss the
agreement for the new City Hall building.
Meeting w/residents 'There will be a meeting with the residents on 50th Street
on 50th Street. on November 30, at 7:30 p.m. regarding the improvement
of said street.

legal issues, seconded by Alderman Super, the vote was:

Motion carried.
Alderman Burch absent this portion of meeting.
Into Regular Session Alderman Beard moved that the meeting go into regular
session, seconded by Alderman Super, the vote was:
