BILL N0.2005-41 ORDINANCE N0.2005-41 AN ORDINANCE PLACING A TEMPORARY MORATORIUM ON OFF-STREET PARKING SPACES UNDER CHAPTER 605, SALE OF FIREWORKS AND FIREWORKS OCCUPATIONAL LICENSE SECTION 605.320-R OFF-STREET PARKING WHEREAS, the City of Riverside, Missouri (the "City") is constructing certain roadway improvements and expansions to NW Gateway and NW Platte Road henceforth referred to as "the Project", and WHEREAS, construction easements acquired for the Project reduces usable numbers of parking spaces available otherwise and the terms and conditions applicable to this situation are unique and temporary for this fireworks sales License Term, NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The City of Riverside hereby imposes a moratorium on the fifteen (15) off-street parking spaces required in Section 605.320-R for Off-Street Parking to be effective during the 2005, June 20"' through July 5`h License Term for fireworks stands fronting on the NW Gateway and NW Platte Road Project. During this period, up to five (5) required parking spaces may be subtracted from the number otherwise required when usable spaces are located within construction easements. Section 2. Usable parking spaces designated for use on adjoining property, located outside of construction easements may apply to the sum of spaces required, provided they conform to Section 420.020 of the Zoning Ordinance. In all cases, useable parking spaces refer to paved parking spaces. This Section shall not be construed to imply use of adjoining property without consent of all property owners. Section 3. This Ordinance shall be in full force and effect from and after its passage and approval. This Ordinance shall be in full force and effect from and after its passage and approval.
