MEETING NOTICE
The Board of Aldermen for the City of Riverside, Missouri will meet at 7:00 p.m. on
Tuesday, March 30, 2004 in the Board of Aldermen's Chamber at the Riverside City
Hall, 2950 NW Vivion Road, Riverside, Mo for the following purpose:
1. Roll Call
2. Bill No. 2004-28 An Ordinance approving a development agreement
between the City of Riverside, Missouri and
Kessinger/Hunter & Company relating to the L-385
Levee Redevelopment Plan
3. Bill No. 2004-29 An Ordinance authorizing the Mayor to execute an
agreement by and between the City of Riverside, Missouri
and Mad Mike's Fireworks, LLC, regarding the acquisition
of certain property through eminent domain and settlement
of matters related thereto
4. Discussion of Business Licenses including Fireworks
5. Motion to enter into Closed Session pursuant to RSMo 610.021(1) for discussion
of Legal issues and RSMo 610.021 (2) Real Estate and 610.021(3) Personnel
issues.

BILL NO. 2004-28 ORDINANCE NO. 2004-28
AN ORDINANCE APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE
CITY OF RIVERSIDE, MISSOURI AND KESSINGER/HUNTER & COMPANY RELATING
TO THE L-385 LEVEE REDEVELOPMENT PLAN.
WHEREAS, the City of Riverside, Missouri ("City"), after recommendation by the Tax
Increment Financing Commission of Riverside, Missouri ("TIF Commission"), approved the L-
385 Levee Redevelopment Plan, as amended, classified the Redevelopment Area as a "blighted
area" and designated it as a redevelopment area under the Act; and
WHEREAS, the City is the owner of certain real property consisting of approximately
525 acres of land located in the Redevelopment Area, as more particularly described in the
Development Agreement (defined below) (the "Redevelopment Property"); and
WHEREAS, the City desires to provide for the efficient and orderly development,
operation and management of a mixed used development on the Redevelopment Property; and
WHEREAS, the City went through a detailed request for qualifications process and
selected the Kessinger/Hunter & Company ("Developer") as developer subject to the execution
of a mutually agreeable development agreement; and
WHEREAS, the City and the Developer desire to enter into a Development Agreement to
provide for the implementation of the Redevelopment Plan subject to the terms and conditions of
such Agreement.
NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside,
Missouri as follows::
1. The Development Agreement is hereby approved in substantially the form
presented with this Ordinance (a copy of which document is on file with the City Clerk), and the
City is hereby authorized to enter into, execute and deliver such document with such changes
therein as shall be approved by the officials of the City executing such documents, such officials'
signatures thereon being conclusive evidence of their approval and the City's approval thereof:
2. The Mayor, the City Administrator, the Finance Officer and other appropriate
officers, agents and employees of the City are hereby authorized to take such further actions and
execute such other documents as maybe necessary or desirable to carry out and comply with the
intent of this Ordinance, and to carry out, comply with and perform the duties of the City with
respect to the Development Agreement.

BILL NO. 2004-29 ORDINANCE NO.2004-29
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT BY AND
BETWEEN THE CITY OF RIVERSIDE, MISSOURI AND MAD MIKE'S FIREWORKS,
LLC, REGARDING THE ACQUISITION OF CERTAIN PROPERTY THROUGH
EMINENT DOMAIN AND SETTLEMENT OF MATTERS RELATED THERETO
WHEREAS, the City of Riverside, Missouri (the "City") is currently planning the construction
of certain roadway improvements and expansions to and of West Platte Road in the City (the
"Project"); and
WHEREAS, as part of the Project the City desired to acquire the property located at 2300 West
Platte Road (the "Property") from the owner, Mad Mike's Fireworks, LLC ("Mad Mike's"); and
WHEREAS, the acquisition of the Property was the subject of an eminent domain suit before
the Platte County Circuit Court, Case No. 03CV84242, and remains the subject of exceptions filed
with regard to the commissioners' award filed in such suit; and
WHEREAS, the City and Mad Mike's have reached an agreement regarding acquisition of the
Property and the exceptions related thereto.
NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside,
Missouri, as follows:
Section 1. The City of Riverside shall enter into a settlement agreement with Mad Mike's Fireworks,
LLC, regarding the acquisition of the Property located at 2300 West Platte Road and resolving all
actions, including exceptions to a related commissioners' report, related thereto (the "Agreement").
Section 2. The execution and delivery of the Agreement is approved, and the Mayor is authorized to
execute the Agreement and to take such other actions reasonably necessary to carry out the intent of
this Ordinance on behalf of the City, the execution of the Agreement being conclusive evidence of
such approval.
Section 3. This Ordinance shall be in full force and effect from and after its passage and approval
