HomeMy WebLinkAbout2009-089 - incompleteBILL N0.2009-89 ORDINANCE N0.2009-89 AN ORDINANCE DETERMINING THE ADVISABILITY OF THE BRIARCLIFF HILLS - EAST OF VALLEY PUBLIC IMPROVEMENT PROJECT AND ORDERING THE ESTABLISHMENT OF THE BRIARCLIFF HILLS -EAST OF VALLEY NEIGHBORHOOD IMPROVEMENT DISTRICT AND THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE PROJECT WHEREAS, a proper petition was filed with the City Clerk of Riverside, Missouri, on June 25, 2009 (the "Petition"), pursuant to the Neighborhood Improvement District Act (the "Acf~, Sections 67.453 through 67.475, inclusive, RSMo, as amended, proposing the creation of a neighborhood improvement district (the "Districf~, legally described on the attached Exhibit A, and was signed by the owners of at least two-thirds by area of all real property located within the District; and WHEREAS, the Boazd of Aldermen of Riverside, Missouri, has reviewed the Petition proposing the creation of the District for the purpose of completing the Briazcliff Hills -East of Valley Public Improvement Project ("Project"); NOW, THEREFORE, BE TT ORDAINED BY THE BOARD OF ALDERMEN OF RIVERSIDE, MISSOURI, AS FOLLOWS: Section 1. The Boazd of Aldermen finds and determines that the Petition was signed by the owners of at least two-thirds by azea of all real property located within the District. Section 2. The Board of Aldermen finds that the Petition was filed in the office of the City Clerk on June 25, 2009. Section 3. The Boazd of Aldermen further orders and finds as follows: a. The project name for the improvements described in the Petition shall be `"The Briazcliff Hills - East of Valley Public Improvement Project " b. The nature of the improvements (the "Improvements") is to acquire, construct and improve certain public street, sidewalk, sanitary and storm improvements and the management and supervision of construction of such improvements. a The current estimated construction cost of the Improvements is $520,000.00, with only $318,130 of such cost plus organizational and administrative costs being assessment as neighborhood improvement district assessments. This portion of the final cost of the Project is to be assessed against the property within the District and the amount of neighborhood improvement district obligations with. respect thereto shall not exceed such estimated costs by more than 25%. d. The District is generally bounded on the north by NW Cherokee Drive, on the east by Riverside city limits, on the south by NW Platte Road and on the west by NW ~ ~ ~~~~ ~~ X09 ~~% ~ S A PETITION TO THE CITY OF RIVERSIDE, MISSOURI BY THE OWNERS OF RECORD OF AT LEAST TWO-THIRDS BY AREA OF THE REAL ESTATE LOCATED WITHIN THE PROPOSED BRIARCLIFF HILLS -EAST OF VALLEY NEIGHBORHOOD IMPROVEMENT DISTRICT REQUESTING ESTABLISHMENT OF A NEIGHBORHOOD IMPROVEMENT DISTRICT FOR THE BRIARCLIFF HILLS - EAST OF VALLEY PUBLIC IMPROVEMENT PROJECT. RECITALS A. Pursuant to The Neighborhood Improvement District Act, Sections 67.453 to 67.475 of the Revised Statutes of Missouri (the "Act"), the City of Riverside, Missouri (the "City") is authorized to establish a neighborhood improvement district in the City upon a proper petition presented for that purpose signed by two-thirds of the owners of record by area of all real property located in the proposed district. B. The Act provides a method by which the City may make, or cause to be made, and fsnance public improvements and reimburse itself with special assessments against the property benefitted by such improvements. C. The Act requires that the petition contain: (1) the project name for the proposed improvement, (2} the general nature of the proposed improvement, (3} the estimated costs of the proposed improvement, (4) the boundaries of the proposed neighborhood improvement district to be assessed, {5) the proposed method or methods of assessment, (6) a notice that the names of the signers of the petition may not be withdrawn later than seven days after the petition is filed with the City Clerk, (7) a notice that the final cost of the proposed improvement assessed against property within the district and the amount of obligations issued therefor shall not exceed the estimated cost of the proposed improvement as stated in the petition by more than twenty-five percent (25%); and (g) provisions for maintenance of the project during the term of the payment of the notes or bonds. D. The undersigned is the sole owner of real property located within the boundaries of the proposed Briarcliff Hills -East of Valley Neighborhood Improvement District (the "District") and hereby files this Petition to request establishment of the District to assist in the construction of certain street, sidewalk, sanitary and stone improvements and the management and supervisian of construction of such improvements (the "Improvements") within the District. + ~ a EXHIBIT C ESTIMATED COSTS OF THE NID IMPROVEMENTS Description Total Project* Public Streets and Sidewalks $300,000.00 Public Sanitary Sewer $120,000.00 Public Storm Sewer $100,000.00 Total Project Costs $520,000.00 Portion to be Paid by NID $318,130.00** *Any one or more of the above Improvements may be selected to be funded from the District. t4This is the maximum amount of project construction costs that will be payable from the NID, All costs in excess of this amount will be paid by the developer of the property.
