HomeMy WebLinkAbout2009-101 - Synergy ServicesBILL NO. 2009-101 ORDINANCE N0.2009-101 AN ORDINANCE AUTHORIZING THE CITY OF RIVERSH)E TO ENTER INTO A SERVICES AGREEMENT WITH AND PAY CERTAIN FUNDS TO SYNERGY SERVICES WHEREAS, Synergy Services ("Service Provider") is anot-for-profit corporation providing services, including certain health, emergency and safety services ("Services"), to residents of the Kansas City region, including the City of Riverside (the "City"). WHEREAS, Service Provider desires to continue to provide such Services and requires funding to continue to provide the Services within the City. WHEREAS, the City Ends that the provision of the Services is a public purpose and the City has the capability and desire to assist Service Provider in continuing to provide Services to the public within the City. WHEREAS, the City's Board of Aldermen believes that the City's best interests are promoted and aided by entering into an agreement with the Service Provider for the provision of the Services. WHEREAS, The City and the Service Provider have negotiated and agreed upon an agreement for the Service and payment for the same. NOW, THEREFORE, BE IT ORDAINED, by the Board of Aldermen of Riverside, Missouri, as follows: Section 1. The City finds that the provision of the Services contributes to the welfare of the City as well as the economic and social potential of the City and its residents, that the Services are important to the welfaze of the City and that the provision of funds to assist in providing such Services are For a public purpose. Section 2. The City of Riverside shall pay to the Service Provider the sum of Five Thousand and 00/100 Dollazs ($5,000.00) to assist it in continuing to provide services to the residents of the City and the City, pursuant to a Services Agreement, in substantially the form attached as Exhibit A, which is hereby approved. Section 3. The Mayor is authorized and directed to execute the Services Agreement with such changes as such officer shall approve, execution of such document being conclusive proof of such approval. The Mayor is authorized and directed to perform all acts and execute any other documents necessary or desirable to effectuate the intent of this Ordinance. Section 4. The sections, paragraphs, clauses, and phrases of [he Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, pazagraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declazed to be unlawful shall remain in full force and effect. Rose rty Clerk SERVICES AGREEMENT THIS SERVICES AGREEMENT entered into on this0~aa of 2009, b and between the CITY OF RNERSIDE, MISSOURI ("City"), and SYNERGY SERVICES ("Servi Pro er"). y WHEREAS, Service Provider is a Missouri not-for-profit corporation providing counseling and educational services ("Services") for citizens in the region, including the City. WHEREAS, the City desires that such Services be available to its residents, desires Service Provider to provide the necessary Services, and required funding to assist Service Provider in providing for the Services for the City's residents. WHEREAS, the City has found that the provisions of the Services contributes to the welfare of the City as well as the economic and social potential of the City and its residents, that the Services are important to the welfare of the City and that the provision of funds to assist in providing such Services are for a public purpose. IN CONSIDERATION of the mutual covenants and agreements set forth herein, the parties agree to the following: 1. That Service Provider shall provide the Services for the City pursuant to the terms of this Service Agreement for a term of one year commencing on the date of this Agreement. 2. That the City shall pay to Service Provider the Sum of $5,000. 3. That the Services provided by the Service Provider shall include, but not be limited to, counseling, education and emergency services to victims of violence, runaway, homeless and at risk teens and abused children and families in the City. 4. Service Provider will provide the City with a copy of Service Provider's annual budget with a brief summary of the accounting controls used. Further, expenditure reports are required on a monthly or quarterly basis and a final expenditure report is required within 90 days after the monies are spent.
