Also present were: Ana Daniels, City Admiaiatrator, Irene Pauhle, Secretary to the Board, and Don Mitt, City Attorney. Mayor Batty Burch called the meeting to order sad welcomed the large crowd in atteadaace. Minutes The Minutes of December 19, 1995, were read and apprrnred as 1a-19-95 corrected. Mayoral Mayor Burch read her veto of Ordiaaaca No. 95-114, Veto of regarding the approval of the deaignatioa of the Ord. redevelopment area, the Riverside-Quiadaro Levee 95-114 Redavelopmeat Plaa sad Radavelopmeat Project I, and selecting the developer to implement the Plaa, passed by the Soard of Aldermen at the December 19, 1995, meeting, which she had vetoed oa December a6, 1995. Motion to Motion was made by Alderman Teters, seconded by include Alderman Aust, to include a copy of Ordinance 95-114 Ord. and the Mayor's veto of same, is the official record of 95-114 and this meeting. Veto in record The vote was as follows: Aye - Tetera, Auat, Marshall, Beard, and Ovea May - Aylett The motion carried. w Public Mayor Burch recognised peraoae wl.shiag to speak concerning Caameats the Veto of Ordinance 95-114. Betty 1Caight, Preaidiag Cammiaeioner of Platte County; Glands Corwin, President of Park Hill School Board; sad Dr. Gaydea Carruth stated appreciation for the work of the TIF Commission members and to Mayor Burch for the veto which they each believed was is the beat interests of the taxing entities of the toasty sad the schools. The following individuals were introduced: Batty ~Caight, Disa Bakridge, Michael Short, John Ferguson, Dick Mildig, Daa Luehart, Janice Tillman, Sue Dance, Gene Shilbert, James Scott, Charles Hesvelow, Bob Mhite, Tim Meeks, Louie Burgess, Eric Sorensen, Dr. Gaydea Carruth, Glenda Corwin, Larry Gardner, Brian Davis, Al Tunis, Ruby Paperfuha, Ray Smithey, Gina Smithey, Jeaaaette Hoy, Michelle Jones, Donna Melah, Mary Burgs, Leland Finley, Betty Bennett, and Carol Smith. Beard Alde~~~ Ray Beard spoke oa the issue of the veto atatiag Comments he believed the adoption of Ordinance 95-114 nee the last chance for the City to prevent what had happened during the flood of 1993 sad that he had gives a press release stating his position oa the issue. Mfg. 1--1x96 ~~ f Aylett Alderman Aylett addressed the 1[ayor's reasons for vetoing Ccamteats the Ordinance outlining the following poiata: Item 8, concerning the schools, he felt the Board had done everything they could to provide a guarantee that the achoola would be protected and the veto led him to believe the 1[ayor had no trust is future Aldermen. Item C, input from the TIF Co~tasioa, he believed the TIF Cammisaion had turned the project down as it was presented to them but ha felt the 1[ayor did not appreciate the fact that the Aldermen had spent a great deal of time looking into this matter and that the Soard had been told frog the beginning that they would make the final decision. Item D, concerning proper legal notice of the meeting not having been given, he felt that none of the attorneys present made a protest regarding the notice. Item 8, dealing with whether the Argosy property would be ^aubstantially^ beaefitted, he stated he believed it would be beaefittad by the levee niece ao one could get to the gaming facilities if the road was flooded. Item F, concerning the significant changes to the original plan, he stated the chaagea had involved guaranteeing the school's money would continue, the time frame fora development agreement, sad removal of infrastructure and he believed these were good. Item G, concerning taking millions of dollars of City tea money sad transferring it to the control of the developer, he felt if the $a.3 million dollars proposed is the plea was unsatisfactory, why had thelfayor suggested increasing that is her proposal for possible funding. 8e commented that the 1[ayor went to llaehington to ask for more money sad they denied the request. 8e questioned why it was ok for the 1[ayor to auggeat uaiag more money but not for the Board to do ao. Public Tom Samples, resident of Riverside, stated he appreciated all Comments the effort put into the project but he feels the City aeeda a levee to keep the Maters from coming back. Mary Clancy, Riverside resident, stated aha felt the Aldermen is her yard had sot represented her beat iatereate. Motion for A motion was made by Alderman Marshall, eacoaded by Alderman Receaa Aust for a brief recess. The vote vas unanimous. Reconvened The meeting vas reconvened with all elected officials sad staff preaeat. Solid 1laste Ann Daniels preaeatad guidelines for diacussioa prior to Specification disc d requesting bide for solid waste collection for residents in usse Riverside. Following discusaioa, she vas iaatructed to obtain possible coats for single family residences, apartments, and buaiaesa sad industries and present those whoa received. Request for Ann Daniels presented a request from the Public 1POrka storage department to rent storage space for the Christmas decorations space . It was suggested that the areas is City Hall be consolidated sad that other locations be researched prior to renting a storage unit. Muehlberger Retainage The request of Bob Mhehlbarger to have the retainage reduced th Request on e contract for Hillside and South Streets to the amount remaining to ba completed oa the Ros d C e sa one properties, or approximately $14,000, was discussed. Attorney Nitt stated the contractor would aaed to provide signed lies releases from his subcontractors prior to such action being takes. Motion to Reduce A motion was made by Alderman Beard, seconded by Alderman A lett t ll y , o a oy the reduction of the retainage on the Hillside Retainage sad South Street project to $14,000 after receiving signed lies on contract releases from Mhehlberger Coastructioa Company. The vote was as follows: Aye - Aust, Aylett, Seard, Oven, Tetera May - Marshall The motion carried. Ordiaaace By general consent, the ordinance repealing penalties is Poatpoaed Chapter 19 through TS of the Municipal Codas, will be postponed pending further information from the City Attorney. Sewer Rate reductio Alderman Aylett requested Bruce Gulley, CPA, research sewer n rate reductiaas to enable total retirement of the sewer bonds study , for apartment residents, as well as that being reviewed by the ' Mayor s research. The Mayor stated this would be done sad would, hopefully, be available at the next meeting. 8111 Ho. Motion to A motion vas made by Alderman Marshall, seconded by Alderman approve Beard, to approve the overtime for the Public Safety Department Overtime for December, 1995. Mr. Tunis stated it had not been made. Request to Alderman Aylett asked that as ordinance be prepared to amend Amend Sec. 2 5 Section 2.5 of the Mhnicipal Code which would alloy three . Alderman to call a Special meeting. Request to Alderman Aylett asked that as ordinance be prepared to amend Amend Code the appropriate sections of the City Code to alloy for the to pay bills payment of bills twice each month. Request for donati Alderman Marshall asked about the statue of the request from on the Missouri Gaming Commission for the $50,000 for use in to Mo. Gaming treatment of gambling addicts. Commission Mayor Burch stated a mistake had been made sad the check had been mailed following the last meeting. Ann Daniels stated she would take full responsibility for the error. The check had been prepared sad placed on the disbursement list for review at the last meeting. 1Phea the bills were prepared for mailing the morning following the meeting, she placed it is as envelope sad mailed it along with all the other statements. Ma. Daniels apologised for the error stating the fact that the office is shorthanded with the absence of the City Clerk sad that she and Louisa Ruaick ware trying to handle all the accounts payable sad payroll and had not dose all these transactions before. She offered to make contact with the Gaming Commiaaioa sad request the return of the check. Mayor to Mayor Burch stated she would continue to research the issue 6end memo with the Gaming Commission to answer the questions she had about the issue and she would forward a memo to the Board when she had received the iaformatioa. Request from Alderman Marshall iaquirad about the materials stored outside Alderman the fence of the roofing company's operations at the end of Marshall Vivion Street. Ma.
