SPECIAL MEETING SESSION FEBRUARY 1, 1996 CITY HALL 4500 HIGH DRIVE, RIVERSIDE, MO. 64150 7:30 p.m. The meeting was called to order by Mayor Burch at 7:30 p.m. with the following present: Aldermen Aylett, Auat, Beard, Marshall, Owen, and Teters. Attorneys Robert Nuanerich, Evans and Dixon; and James McKown, Spencer, Fain, Britt & Browne. Former Aldermen James Karr and Ed Rule. City Administrator, Acting Secretary to the Board, Ann Daniels. A motion was made by Alderman Aust, seconded by Alderman Teters, to enter into Closed Session pursuant to RSMo 610.021(c) Legal issues. The vote was: Aye, Aldermen Aylett, Aust, Beard, Marshall, Owen, and Teters. The meeting entered Closed Session at 7:35 p.m. with Ann Daniels leaving the meeting but all others remaining. A motion was made by Alderman Aust, seconded by Alderman Teters, to enter into Open Session at 8:50 p.m. The vote was as follows: Aye: Aldermen Aylett, Aust, Beard, Marshall, Owen, and Teters. All previously listed were present, as well as Ann Daniels. Mayor Burch stated, for the record, that she was opposed to the action which was about to be taken. James McKown, Attorney, Spencer, Fain, Britt, & Browne, read the proposed ordinance in its entirety. A motion was made by Alderman Aust, seconded by Alderman Beard, that an Bill 96-12, being an Ordinance authorizing the Mayor or Chairman of the Board of Aldermen to Execute a Joint Motion to vacate judgment in the case of Wilkin V. City of Riverside and further authorizing settlement pursuant to the terms of a settlement agreement, be placed on its first reading. The vote was as follows: Aye: Aldermen Aylett, Aust, Beard, Marshall, Owen, and Teters Mayor Burch was excused from the meeting. Mayor Pro Tem Marshall presided for the remainder of the meeting. A motion was made by Alderman Aust, seconded by Alderman Seard, that Bill No. 96-12 be read for the second reading and adopted as Ordinance No. 96-12. The vote was as follows: Aye: Aldermen Aylett, Aust, Beard, Marshall, Owen, and Teters Y Signatures of each Alderman and the Mayor were notarized on Release forms by Notary Candace Gram. Attorneys Numerich and McRown explained the process might be completed by February 2, 5, or 6, 1996 and cautioned all parties that no statements should be released prior to notice from the Court that the Judgment had been vacated. A press release will be prepared for the City's release. A motion was made by Alderman Aust, seconded by Alderman Aylett, that the meeting be adjourned.
