FBBRUARY 13, 1996
A regular meeting of the Board of Aldermen of the City of Riverside,
Missouri waa held in the City Hall in Riverside, Missouri on February 13, 1996.
The following members were present: Aldermen Sam Aylett, Brenda Teters,
Kris Auat, John Marshall and Ray Beard. Alderman Owen was absent.
Also present were: Ann Daniels, City Administrator, Irene Paulhe,
secretary to the Board and Larry Reece, Zoning Enforcement Officer. Kenneth
Vaughn working for the City as 8ngineer; William Cunningham with Larkin
Associates and Steve Warger with Harrington Cortelyou 8ngineers were also
present.
It was decided to dispense with the reading of the minutes of February 6,
1996, for the present time.
Mayor's Mayor Burch announced that the first TIF meeting will be held
announce- February 14, 1996 at the office on NW Gateway. She had received a
manta call from Jim Wedua, member of TIF Commission asking to resign from
the Commission. Mayor Burch said she would like to recommend that
David Brenner be appointed to the TIF Commission .
Appoint- Alderman Auat moved to appoint David Brenner as a member of the TIF
ment of Commission to fill the unexpired term of Jim Wedua, seconded by
Brenner Alderman Marshall, the vote was:

Abstained: Alderman Teters
Absent: Alderman Owen
Motion carried.
Mayor Burch stated the purpose of this meeting was to review the
complaints from Robert Linzay concerning the number and height of
manholes located on the property he owns on Valley Lane. It was
felt by some that the problem rested with the City since the City had
requested the storm drain pipe size to be increased, even though the
manholes were part of the developer's storm sewer construction
for the property.
Mr. Linzay stated he had asked that the excessive number of manholes
be reduced and that the height be lowered so they were not so
noticeable on the lot. He said he had talked with John Marshall
about taking care of the problem and John had stated he would talk
with the City 8ngineer about it.
John Marshall reported that he had spoken with Kenneth Vaughn, City
8ngineer, about the problem and Vaughn had stated he would take care
of it. The project has been completed and nothing was done to
correct Mr. Linzay's concerns.
Previous discussion had led to questions as to who was really
responsible for the manhole project -- the City or the developer,
Garrey.
It was agreed that the project had slipped through the cracks and no
one had followed the procedures correctly. The developer and
contractor had supplied only "Preliminary Plana -- Not for
Construction" but no final plane. No building permits had been
obtained and the City had not inspected the work nor had City staff

stopped the work to require the permits and inspections to be
performed.
Mr. Linzay stated he was willing to have the City research the
problem with the developer and would appreciate the City's help in
getting it corrected.
Mayor Burch said she had contacted Garney, Havens Construction Co.,
William Cunningham with Larkin Associates, and Steve warger, design
engineer with Harrington-Cortelyou for information on the project.
Cunningham and warger were present at the meeting.
During the discussions it was noted that the problems being discussed
were as a result of the storm sewer lines constructed by the
developer on Mr. Linzay'a property and what the relationship was to
the storm drainage project the City had participated in.
Larry Larry Reece said the Planning Commission received a set of plans for
Reece Briarcliff Hills for storm drainage, which were marked "Preliminary
Comments Plans and not for Construction," for the project but did not receive
anything further until December 1995, when the contractor furnished
a copy of "As built" plane. At no time did the City receive an
application for a building permit or plans for application for
construction nor request for inspections. Mr. Reece gave a
Memorandum to the Mayor and Board of Aldermen for attachment to these
minutes.
Alderman Alderman Aylett asked Larry Reece if he happened to notice
Aylett when this construction was going on and was he ever aware of the
construction of the storm sewer. Larry Reece said he was involved
with the Argosy construction at that time.
Ken Ken Vaughn did review the plans and made comments to Harrington
Vaughn Cortelyou with regard to the pipe and what they were building. The
plans were given to Larkin Associates. Ken Vaughn remembers
mentioning the fact that the manholes were quite high ~ he ass told
that these were built to meet the street grade when the house was
built.
Alderman Alderman Beard recalls that the City approved the Plat for Briarcliff
Beard Hills. There were preliminary plane which were sent to Larkin
Associates. Larkin Associates requested the construction people to
increase the size the pipe so that the storm pipe coming from
Cherokee Street could be connected and the construction did so with
the understanding the City would share in the additional coat of the
pipe.
Steve Steve warger, Design Bngineer with Harrington Cortelyou, worked on
warger the project and worked to coordinate this storm sewer to make the
connection with City's storm sewer.
William William Cunningham of Larkin Associates said he did not review the
Cunningham plans at the preliminary stage. The City had commissioned them to
design Cherokee Storm drainage system and at that time he tried to
tie in the Cherokee system to the one of Briarcliff Hills. He asked
Garney Construction Company to increase its size from 27" to 30" and
this was done. He also said that the plane showed that the area was
to be surveyed and the construction of Briarcliff storm sewer would
be built at the height necessary and also if it was necessary to
fill, this would be done by Garney Construction Company after the
correct height was established.

sion permission to check wiCh the construction people regarding this
construction and perhaps to get more information and will report back
with what she can find out. She would like to have the construction
people at a meeting, if at all possible.
It was decided that the Mayor would check further into
this matter and report back.
Carl Carl Gustafson, 505 NOP Cherokee, who was present, asked if Garney had
Gustafson permit to do grading behind his property which is in Riverside.
Request Mayor Burch said that this would be checked out.
Alderman Aust moved meeting adjourn, seconded by Alderman
Aylett, meeting adjourned at 8:25 p.m.
