BOARD OF ALDERMEN OF CITY OF RIVERSIDE, MISSOURI
MARCH 7, 1995
A regular meeting of the Bonrd of Aldermen of the City
of Riverside, Missouri was held in the City Hall in
Riverside, Miaaouri on March 7, 1995. Those present were
Aldermen Wedue, Auat, Rule, Merahnll and Owen; Alderman
Tetera was absent. Mayor Betty Burch called said meeting to
order.
Mr. Thomas Samples, 3005 NW Florence, Riverside, MO '
64151, representing Miaaouri 31st Militia was hero to inquire
whether they could use the Court Room for their meetings. He
said they ~uat want to know if they can uaa th• Court Room
once in a while and would try to notify the Public Safety
Department at least a coupl• of weeks in advance. Chief
Bayless acid he would meet with Mr. Samples and discuss the
matter further.
Verlin Boea, 7811 NW Potomac, Weatherby, Miaaouri 64152
spoke to the Mayor and Board regarding his opening up an
office, ~uat north and west of Beat Batteries. H• said he is
interested in old automobiles and owns several. Ha would
lik• to place some of his old vehicles on th• lot and he
would like to get a dealer's license and perhaps sell aom• of
them. H• would also like to lend people money on their
vehicles. He would keep the title until they repay him. He
feels their is a good possibility that there will be people
who cannot financially get their cars back and h• would then
sell them. H• said he would clean up the place and make it
look like a 11200,000 house. It was brought out that this
type of business cannot be closer than 1/2 mile to gaming
facilities. Thies would have to be checked into. After a
lengthy discussion, it was suggested that Mr. Boea go to the
Planning Commission with his necessary pspera.
Mr. James Duke, 535 NE Newport, Leea Suwmit, MO 64064,
representing DiCarlo Construction Company, presented a
Special Uae Application, Change of Uae Application end
Building Application for four story garage and foundation for
the terminal building.
Alderman Marshall moved that the Change of Uae
application be approved, that is change from the present use
of agriculture to commercial vessel, seconded ay Alderman
Auat, the vote was Aldermen Wedue, Auat, Marshall and Owen,
yea; Rul• abstained because of conflict of~interest and
Tetera, absent.
Alderman Marshall moved that the Special Use Permit in
Flood Hazard Area b• approved, seconded by alderman
Auat, the vote was Aldermen Wedue, Auat, Marshall and Owen,

yea; Rule abatninad because of conflict of interest end
Tetera nbaent. A recess waa called. Heating reconvened and
those present were Aldermen Wedua, Aust, Marshall, Rule
and Owen; Tatars waa absent and Mayor Burch presided over the
remainder of the meeting.
Th• plans for the construction of the four level parking
garage were presented. Also presented was an application for
preliminary plat for Argosy.
Stan Eiler of Kaw Valley was present to answer any
questions raised.
Alderman Marshall moved that the preliminary plat be
approved, seconded by Alderman Owen, th• vote was Aldermen
Owen, Marshall, Aust and Wedua, yea= Rul• abstained bacauae
of conflict of interest and Tetera absent.
It is understood that notice has been published for the
Planning Commission to hav public hearing on March 23, 1996
on the Final Plat of Argosy Gaming Company, aub~ect to
relocation of the pipe line easements.
Alderman Marshall moved to approve th• building
applications for a four level garage and foundation for
terminal building for Argosy Gaming Company, aublect to
approval of the doasd of Zoning Ad~uatment and aub~ect to
approval by the City engineer, seconded by Alderman Aust,
the vot• was Aldermen Wedua, Auat, Marshall, and Owen, yea;
Rul• abstained bacauae of conflict of interest and Tetera
absent.
Mik• Purcell and Michael Gunn, hie attorney ware praaant
to discuss the annexation of hie property west of Northwood
Road. Ha said ha would bu11d a road through the property ha
has purehaaed from the Clarks, which would reduce the grade
when the City has annexed his property. H• will not curb and
put in storm drains until h• is finished hauling dirt, which
ha said could be seven to tan years.
Mr. Purcell acid that Northwood Road has to be relocated
and widened and ha could do this because ha owns both sides
of the road with th• exception of the 600 fast north of hie
property.
Mr. Purcell said the development on th• previously owned
Clarks property will be determined after annexation of Mr.
Puraell'a property west of Northwood Road.
City Attorney Don Witt said what has bean proposed is
lass than what should be there and more than we have now.
Mr. Witt said in what way do we hav assurance that the road

is going to be built. Mr. Witt said there are three ways to
gat thin road built according to apeca: 1> it will coat ao
many dollars to build, put up th• dollars and Mr. Puraall cnn
tak• it out of hie treasury; 2) do it with the performance
bond and 3> do it by promise. If not don• by promise, we
will get it done with a law suit.
Mike Puraall said they hav Waaau and USF&G insurance.
Mik• Puraall acid he wants to gat annexed into the City
because the County will shut him down. H• first wants to be
annexed and then he wants to build the road.
Mr. Puraall said when he they comes in with final plat,
h• will build road with curb and storm sewers in accordance
with City's apeca. Mr. Purnell said in approximately S to 10
years he will put in a new road, - curb, gutter and resurface
when Mr. Purnell builds it.
Alderman Rul• presented Kanaaa City, Missouri's
Mayor Street Plan. In this plan it refers to
Northwood Road. Alderman Rule thought whatever Kanaaa City
is going to do on their portion of Northwood Road, than
Riverside's should concur with that plan.
Kanaaa City considers this as a secondary arterial road
- not a collector road.
Mr. Puraall said when he develops hie property, ha needs
the sewers which Riwraide heat second item h• discussed
was the law suit he has with Platte County as to whether or
not he is legal to haul the dirt.
Alderman Rul• said if the road is built in the right
place and in the right way than it would be a good deal. It
would be to Puraell'a advantage to build th• road right end
put it where it should be.
Mayor Burch said she feels th• development of the
property is going to happen.
Mr. Witt acid it is more practical for these people to
build this road than the City to.
Mr. Witt said he could not recommend th• Council do this
on a promise, or a performanc• bond. Either way we will be
inviting a law suit. Th• performance bond should b• put up
on the entire coat of th• road.
Mr. Puraall acid no to 30x cash and 50K performance
bond. He said they will not put up cash.

Mr. Witt suggested thnt the City require a performance
bond for the full coat of the construction of the road.
Mr. Puraall naked to be excused for a few minutes.
Alderman Marshall moved to place Bill No. 95-11 on its
first reading, said Bill provides for requiring th• use of
concrete papa for all storm sewers and culverts within the
City of riverside, Construction of which requires the issuing
of a permit by the City of Riverside, seconded by Aldermen
Wadua, the vote was Alderman Wadua, aye; Alderman Owen,
aye; Alderman Auat, aye; Alderman Rule, nay, Alderman
Marshall, aye; Alderman Tetera, absent.
Alderman Wadua moved to place B111 No. 95-11 on its
second reading, seconded by Alderman Auat, th• vot• was
Alderman Wadua, aye; Alderman Owen, aye; Alderman Auat, aya;
Alderman Rule, nay; Alderaan Marshall, aya; and Alderman
Tetera, absent. Upon the Bill having bean mad• for public
inspection prior to consideration of th• Board of Aldermen,
bill No. 93-1i was passed.
Meaara. Purull and Gunn returned to th• meeting and
said that they would ba\willing to put up a parformanc• bond
for th• entire coat of the construction of th• road. Th•
cost will be worked out by th• City &ngineer and Mr. Witt.
Alderman Rul• moved to place Bill No. 93-12 on its first
reading, seconded by Alderman Auat, this Bill providaa for
the acceptanee of donation of land in connection with City
Park, the vote was Alderman Wadua, ayeT Alderman Aust, aya;
Alderman Marshall, aya; Alderman Rule, aya; Alderman Owen,
aye; Alderman Tetera, absent.
Alderman Auat moved to place B111 No. 93-12 on its
aacond reading, seconded by Alderman Wadua, th• roll was
called and vote was Alderman Wadua, aye; Alderman Auat, aye;
Alderman Marshall, aye; Alderman Rule, eye; Alderman Owen,
aye; and Alderman Tetera, absent. Upon th• Bill having been
made for public inspection prior to consideration of th•
Board of Aldermen, Bill No. 95-12 was passed.
Alderman Marshall moved to place Bill No. 93-13 on its
first reading, a~onded by Alderman Wadua, this Bill providaa
for the authorization of taking bids on B1,d00,000.00 and
authorising th• creation of an additional City depositor for
the highest and best bide; the vote was Alderman Owen, aye;
Alderman Rule, aya; Alderman Marshall, aya; Alderman Auat,
aya; Alderman Wadua, eye; And Alderman _Tetera, abaant.

Mayor Burch said that there was a change order on
VnnDePopulier Street and BN Railroad Tracks in th• amount of
~i1036.73.
Alderaan Rul• coved that the City approve the Change
Order on VanDePopulier Street and BN Railroad tracks in th•
sum of 81036.75, seconded Dy Alderman Aust, the vote was
Aldermen Wedua, Owen, Aust, Rul• and Marshall, yes; Alderman
Teters, absent.
Mayor Burch reported that negotiations have been started
with Kanaaa City, Miaaouri on th• Sewer Reciprocal Agreement.
Sha has mat with Kanaaa City and a survey wiil be sent to
businesses, asking what they are discharging into the sewers,
whether it be chemicals or other contaminants, harmful or
non-harmful, •tc. Ther• will b• several meetings with Ksnaas
City, Missouri and will keep the Board of Alderman up to

city will want Kanaaa City, Miaaouri to do th• inspections.

A letter of thanks was received from the Myrt Wathen
Family.
Mayor Burch said there is going to be a seminar on
Organization of files and records on the 17th and 18th of
April, 1993 at the Holiday Inn Crown Cantor and would like to
send Louisa Rusick. This would coat ~M293.00.
Alderman Auat moved that Louise Rusick attend the
seminar on Organization of Files and Records on the 17th end
18th of April, 1993, at the cost of B293.00, seconded by
Alderman Wedua, the vote was Aldermen Owen, Wedua, Rule,
Marshall and Aust, yea; Alderman Tatars, absent.

Aldermen Auat moved that the City approve four Public
Safety Officers to attend the Death Investigative Seminnr on
Mny 3, 4 and 5, 1995, at a total coat of #220.00, seconded by
Alderman Wedue, the vote was Alderman Wedua, Aust, Marshall
and Owen, yea; Alderman Rule, No; and Aldermnn Tetera,
absent.
Chief Bayless said ha received a latter request from
Fires Commander Mik• Shelton for th• repair of the hydraulic
hack on the 1976 fire truck at a coat of 8197.24 plus
shipment= the puap on the storage tank needs repair at the
coat of A183.00 and the Muffler also needs repair at the coat
of 8130.00, all total 8332.00.
Alderman Aust moved that th• City approve th• repair of
the Hydraulic Jack= the pump and muffler on th• fir• truck,
at a cost of 8332.00, seconded by Alderman Wedue, th• vot•
was Aldermen Owen, Marshall, Rules, Auat and Wedua, yes;
Aldermen Tetera, absent.
Chief Bayleaa said he would like to go to a Law
Enforceaent Seminar at Tan Tar• May 21 thru 24, 1995 at th•
cost of 8417.00 per person. H• would also lik• to hav
either Sgt. Jonas or Simpson attend.
Alderman Aust moved that the City approve that two
people from the Public Safety Department attend the Law
Enforcement Seminar on May 21 thru 24. 1993 at 8417.00 par
person, seconded by Alderman Wedua, the vote was Aldermen
Owen, Wedua, Aust and Marahsll, yea; Alderman Rule, no; and
Alderman Tetera, absent.
It was reported that there are four people who are not
connected to the sewers.
It was the conaensua of the Board to proceed to process
claims aQainat them.
Bids will be received o sweeping the City streets.
Th• Park Department would like to extend the size of the
amphitheater, the cost would be approximately 84030.00 end
SOK could be funded if the application for a grant is
approved from the Platte County Commiaaionera.
Nine trees were purchased from Eaay Enterprise.
Alderman Wedue inquired about the lights from Beverly
Lumber Company to Argosy.
Alderaan Wedua inquired whether or not plena for the
maintensnce building has be made.

Alderman Aust inquired with regard to City Manager.
Mayor Burch said she has received to dote about six
responses.
Alderman Owen inquired regarding the last meeting on the
Animal Control wherein a sheet on the increns• in fans was to
b• reviewed. Also it asked about putting th• matter on the
ballot regarding increase in fans, also wanted to know if e
survey of th• people in Rlveraide could be made to see how
many animals they have and also the question as to whether to
have a full time or part time animal control person. 3h•
also wanted to know if the people had any other questions
which they are concerned about.
It was thought to put some of this information in the
News Letter.
It was brought up whether or not the City of Riverside
wanted to hire a staff for animal control and if they are
going to build an animal shelter.

Alderman Owen wants to know how the Board felt about
The minutes of February 21, 1995 were read and approved
as corrected.
It was brought out that the City has hoard nothing from
Terry Hannah regarding his property which ha is leasing to
the Vernaci.

Board, upon motion duly made, seconded and passed, the
meeting adjourned et 11:30 p.m.
