The+se present were Aldermen Aylett, Teters, Aust, Beard and Owen; Alderrnan Marshall was absent. Mayer Betty Burch called said meeting tc+ cn^der^. It was decided tr_. dispense with the reading of the minutes of Apr^i1 11 and April 18, iS95, for the present time. This had been approved by the Planning Commission. Alderman Bear^d moved that the Change of Use from Professional Office to Adrninistr^ative Office be approved for 4443 NW Gateway, seconded by Alderrnan Aus•t, the vc,te was Alderrnan Aylett, "later^s, Aust, Beard and Owen, yes; Rlder^mar~~ Marshall, absent. The Business License for Argosy Gaming Company was approved at 4443 NW Gateway, subject to the payment ...f the fee. Mike Pr'uss, Con•tr^oller for Argosy Darning Company presented a b~.isiness license for Argosy Darning Company for Arcade license at their employees' lounge and the Sports Barge at 35Q~3 Zeke Rc+ad. This was approved s~_ib~ect tc+ i:ha payment c+f the fee. Millie Stewart, 6712 NW East Side Drive, Parkville, MO 64152, presented a special ~_ise applicatic+r, in flood hazardous area 56 she could rernc+ve •the dirt at the Jc+cky Club and spoke to the Mayc+r^ and Board r^egarding the dirt and rack samer.;ne had dumped on their proper^ty north c+f the Jc+cky Club, 4.?,12 NW Gateway. Mrs. Stewart said she does not know whr_, d~_irnped the dirt. She alsc+ said that dust a small portion c+f the dirt will h+we to be removed. Mayor B~_~rch said to make this legal, the City has asked the Stewar^ts to Cc+rnply with all the City's ragulatic+ns. A representative from the City Hall will be present when this fill dirt i s spread c+ut and part c.f i t r'ernc+ved. Mrs. Stewart is to call the city when she is going tc+ have this done. Alderrnan Aylett moved that the handling of the dirt on the Stewarts proper^ty at 4312 NW Gateway be handled as stai:ed above, seccrr~ded by Alderrnan Aust, the vote was Alderman 4 I Page ~, Min. cif Reg. Gary Wahl, 22 Hull Dr^ive, Platte City, Missour^i, presented an application far an extension far grading permit at Red X. He is gair~g to get same finish dirt to smooth c~~_it the top and slopes cm NW Platte Raad. Alderman Aylett moved that the City approve the extension of grading permit far Red X beca~_ise the City wants this area irnpr^aved as soon as possible and the fill is r,r_,t t... exceed the present elevation and the highest point not to exceed 760 feet. This is to be tapped with tap soil and seeded, seconded by Alderman Heard, the vote was Alder^rnen Aylett, Owen, Heard, Aust and Teters, yes; Alder^rnan Marshall absent. Gary Wahl also presented a gr^ading permit for Line Creek Properties which is located on Tullison Raad. This will be filled with mostly tap sail dir^t. Alderman Teters, rnr_,ved that the gr^ading permit far Line Creek Properties be approved, seconded by Alderman Aylett, the vote was Alderman Teters, A~_~st, Aylett, Owen, and Hear^d, yes; Alderman Marshall, absent. Gary Wahl said at the last Planning Cc~rnrnissior~ meeting, he presented a Drawing along with a letter requesting that one the streets in Line Creek. Properties which is a Dead End Street and the width is 8Qi'. He would like to have it a 6Q~' width which is sufficient. He said the paved area would be 28' with curbs. This matter was discussed ar~d it appeared that in order^ to der_rease the width of the right of way, since this has already beer~r^ecar^ded, this would have to be advertised and a nearing held. It was decided tr_. dc. this as saor~ as passible. Phil Snowden, 4642 N. Holly Court, Kansas City, MO presented a Change of Use Application from the present agr^icultural to cornrnercial. Mayor Hutch said that she dust recently learned that this area whet^e Mr. Snr_~wden is planning to build a golf driving range is not zoned far this type of business. The zr_,ning will have to be changed in order to have a driving range and miniature golf. This will require a change of the ordinance and a public hearing. This will be done as quickly as possible. Mr. Snowden presented an application for grading at the above referred to location. The grading was not approved at the Planning Carnmission because it covered the building as well as the grading. It should be for grading only. The Mayer and Haar^d recommended that this go back. to the Planning 4 I F~age :s, Min. of reg. Meet. , May ~, 1990 Contrnission far grading only. The required letter fr^orn Mr. Snowden's attorney was presented wherein it was stated that Mr. Snowden would comply with all the City's Ordinances and r^eg~_~lat ions. Another^ matter to be resolved with Mr. Snowden is to reach an agreement with biro and the Gity and the O~_iindar^c:~ Levee District regarding Mr. Snowden being able tc~ r^etr^ieve golfi balls frr_,rn the levee property; this being extended to his heirs or assigns, that he will not interfere with the building cif the levee and that the City is not liable fr_,r^ any loss of business Mr. Snowden may lose can account of the building of the levee. These subjects will all have tr_, be included in an agreement. Mike pur^se 1 1 and Mike Gunn, his at t or^ney, were present to discuss the annexation of Mr^. P~_~rsell's property west of Nor^thwood Road. Mr, pursell also presented a grading application for the property he purchased fr^om the Clarks. Mr. Witt brought up the subject that an agreement with Mr. F'~_irsell will have tc~ be consummated before any grading permits can be issued. Mr. Witt has written the Mayor and Board of Aldermen a letter concerning this matter and this has to be reviewed by the Mayor and Boar^d befar^e any action can be taken, therefore, the matter will be tabled. Mr. James Tr^imble was pr^eser•~t to talk about his appliration to the County to change the coning on his proper^ty from agricultural to R10 or residential. He said the County will req~_~ire Mr. Trimble to, basically, follow th~~+ same requirements of the City of Riverside, M1550Ur1. He said there are approximately 5~ acres and plans to have 8S building lots. He also said that he would irnpr^ove Northwr_~c~d Road in the same manner that Riverside improves its partit:~n. Dick. Grogan, a rnernber of the Baar^d of Zoning Ad,lustrnent talked to the Mayor and Board r^egarding liability of the members of the Board of Zoning Ad~ustrnent, as well as that of other rnernbers of the other Carnrnittees in the City who ar^e nr_,t on the payroll. This matter was discussed and Mayor^ Burch said she would r_heck into this matter ber_a~_~se the city's insurance is going tc~ be renewed and she will be talking to the insurance people. A recess was called. Meeting reconvened. Those present were Aldermen Aylett, Teter^s, Aust, Beard and Owen; Alderman Marshal]. was absent. Mayor Burch said there is a problem with the asphalt which was used on Merrimac. It appears to be of inferior q~_~ality and seems to have foreign material in it. It is felt p Page 4, Min. of reg. Meet. , May c, 1995 that this will have to be replaced in the ar^eas where it is inferior^. Alder^man Rylett said he will be present when it is being wor^ked an. Alderman Aust rnc~ved that the meeting go into closed session, Alderman Teters seconded the motion, the vote was Alder^men Rylett, Teters, Rust, Hear^d and Owen, yes; Alderman Marshall absent. Alderman Aust moved that the meeting go into regular session, seconded by Alderman Hear^d, the vote was Aldermen Aylett, Teters, Rust, Heard and Owen, yes; Alderman Marshall absent. Alderman Heard said he gave Chief Rayless a letter requiring certain infcmmatian on finances, regarding salaries cif other City's Public Safety Officers and other inforrnatic~n. He also gave the Mayor and Roard a cr_~py of that letter. He said he would like to have the information prior to starting on the 1995-9E budget. Mayor Hurch said she has talked to Chief Rayless regarding this letter and he said it will take a couple weeks before he can s~_~pply the infarrnatir_~n requested. Alderman Teters moved that the overtime far the Public Safety Department as presented by Chief Rayless be approved for the month of April, 1995, seconded by Alderman Rust, the vote was Aldermen Rust, Owen, Teters, Heard and Aylett, yes; Alderman Marshall, absent. Upon the Bill having beer, made fc,r public inspection, prior to consider^atir_~r, of the Paard r_~f Alderrner,, Bill No. 95-c3 was passed. Mayor Burch said she received letter^ frarn Kansas City, Missouri whey^eir, they are going to increase the sewer rates. Mayor Bur^ch received a letter from Argosy Darning Company wherein they would like to have an outside boxing match, some t irne in June. With regard to Dor, Meyers property, ,9407 NW Platte where he has rnobi le homes far sale, ar,d he is repairing or,e or, the premises, (where this is not ir, carnpliance with the City Ordinance) this was brought to his attention and it has beer, ignored. This matter was discussed and it was the consensus of the Board to bring hirn ir, court. A letter frarn Arner^icar, Missouri Water Company requesting p page 6, Min.. of Reg. Meet., May ~, 1995 the City proclaim the week May 7 thr^u 13, 1995 as Water^ Week.. Alderrnan Aust moved that the Week May 7 thr~.~ 13, be Water^ Week, seconded by Alderrnan Beard the vote was Aldermen Owen, Beard, Aust, Teters and Aylett, yesg Aldermar~ Marshall absent. The applications received fc~r the City Manager position wer^e discussed.
