AN ORDINANCE AUTHORIZING AND ADOPTING THE REZONING OF PROPERTY
GENERALLY DESCRIBED AS NORTHEAST CORNER OF HIGH DRIVE AND
BRENCREST DRIVE FROM "R-3" MULTI-FAMILY RESIDENTIAL TO "C-I"
COMMERCIAL
WHEREAS, at its meeting on August 27, 2009, the Planning Commission of the City of
Riverside, Missouri (the "Commission") conducted a public hearing wherein it considered and
reviewed a rezoning for property generally described as property at the Northeast corner of High
Drive and Brencrest Drive (the "Property") from "R-3" Multi-Family Residential to "C-1"
Commercial; and
WHEREAS, the Commission recommended approval of the rezoning application on August
27, 2009; and
WHEREAS, the Board of Aldermen of the City of Riverside, Missouri at its regular
meeting of September 1, 2009 held a public hearing regazding the rezoning and the recommendation
of the Commission regarding the same; and
WHEREAS, at its September 1, 2009 meeting, the Board of Aldermen determined adoption
and approval of the subject rezoning to be in the City's best interest and to promote the public
health, safety and welfare.
NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside,
Missouri, as follows:
Section 1. The Board of Aldermen approves the rezoning for the property generally
described as property at the Northeast corner of High Drive and Brencrest Drive (the "Property"),
and which is legally described on Exhibit A attached hereto, and herby changes the rezoning of such
property from "R-3" Multi-Family Residential to "C-1" Commercial.
Section 2. The Mayor shall have authority to take such actions to execute such documents
as she shall deem reasonably necessazy to carry out the provisions and intent of this ordinance.
Section 3. This ordinance shall take effect immediately.

Legal Description
Parcel A: A tract of land in the West 112 of the Southeast Quartet of the Northwest Quarter of Section 4,
Township 50, Range 33, Riverside, Platte County, Missouri, described as follows: Commencing at the
Northeast corner of Brencrest Resurvey, a subdivision in said Riverside, Platte County, Missouri, said
corner being also the Northwest corner of the East 3110 of said West 112; thence South 00 degrees 09
minutes 17 seconds West along the East line of said Brencrest Resurvey, 285 feet; thence South 89
degrees 59 minutes 39 seconds East parallel with the North line of said SoutfieastQuarter, Northwest
Quarter, 40.00 feet to the point of beginning of the tract to be described herein; thence continuing South
89 degrees 59 minutes 39 seconds East, parallel with the North line of said Southeast Quarter, Northwest
Quartet, 70.0 feet; thence South 00 degrees 09 minutes 17 seconds West, parallel with the East fine of
said Brencrest Resurvey, 95.00 feet; thence South 89 degrees 59 minutes 39 seconds East, parallel with
the North line of said Southeast Quarter, Northwest Quarter, 87.54 feet (Dead 85.78 feet) to the East line
of said West 112; thence South 00 degrees 08 minutes 11 seconds West, along said East line, 213.33
feet (Deed = 212.08 feet) to the North right of way line of Hlgh Drive as established by the Southeasterly
prolongation of said Right of Way line from the plat of said Brencrest Resurvey; thence North 66 degrees
05 minutes 22 seconds West, along said line, 50.D0 feet from the centerline thereof, 172.13 feet (Deed =
170.20 feet); thence North 00 degrees 09 minutes 17 seconds East, 40.00 feet East of and parallel with

corner being also the Northwest corner of the Easl311D of said West 112; thence South 00 degrees 09
minutes 17 seconds West, along the East line pf said Brencrest Resurvey, 285.017 feet; thence South 89
degrees 59 minutes 39 seconds East, parallel with the North line of said Southeast Quarter, Northwest
Quarter, 110.OD feet to the Point of Beginning of the tract to be described herein; thence continuing South
69 degrees 59 minutes 39 seconds East, parallel with the North line of said Southeast Quarter, Northwest,

Beginning at a point on the West line of the above described Traci which is 190 feet South of the
Northwest corner thereof, said point being also on the East line of Brencrest Subdivision, according to the
recorded plat thereof; thence East parallel with the North line of said Quarter Quarter Section 195.89 feet
to a paint in the East Ilne of the West half of said Quarter Quarter Section; thence South along the East
Ilne of said Half Quarter Cluarter Section 95 feet; thence West parallel with the North line of said Quarter
Quarter Section 195.84 feet to a point in the West line of the East 3f10 of said Half Quarter Quarter
Section; thence North along said line 95 feet to the point of beginning, except the West 40 feet thereof fo
be used for road purposes.
