HomeMy WebLinkAbout1994-02-15 MINUTES OF REGULAR MEETING OF BOARD OF ALDERMEN OF CITY OF RIVERSIDE, MISSOURI FEBRUARY 15, 1994 A regular meeting of the Beard r_~f Aldermen of the City r_,f Riverside, Missouri was held in the City Hall in Riverside, Missouri on Febr^uary 15, 1994, at 7:30 p. m. Those present were Aldermen Wedua, Teters, Karr, Marshall, R~_ile and Aust. Mayor Betty Bur^ch presided aver^ the meeting. City Attorney Dcm Witt was present and also Larry Reece. Gina Salisbur^y, 4535 NW High Drive, Greystone Apt D, Riverside, Missouri 64151 presented Business License application for Up'n At-Em Home Cleaning, located at the carne address. This is for cleaning residential houses. The application was approved s~_ibaect to the payment of the fee. Carolyn Wissinger, 3^c05 NE 68th Ter^., Gladstone, MO 64119, presented business License Application for Horizon Salon Service, Inc. at 446 NW Business Park lane. This is f~~r the selling of hair products. She has certificate of Warkrnen's Corn p. Insurance and has applied for a sales tax n ~_im ber^. Alderman Kar^r moved that the Business License application far Horizon Salon Services, Inc. be approved subaect to r^eceipt of sales tax number and payment of the fee, seconded by Alderman Teters, the vote was Aldermen Wed~.ia, Aust, "feters, Rule, Karr, and Mar^shall, yes. Martha Miller, 9700 NW Shaggy Park Lane, Parkville, MO 64158 presented Business License Application for Reflections, Inc. Restaurant & Catering at 5100 NW Gateway. She has applied for sales tax number and has riot received a certificate from the Platte County Health department nor does she have Wor^kmen' s Cornp. Incur^ance Cert i f icate. Alderman Rule moved that the business license application for- Reinfectians, Inc. Restaurant and Catering be approved subaect to a sales tax number, health department certificate, certificate of insurance and payment of the fee, seconded by Alderman Marshall, the vote was Aldermen Karr Marshall, Wedua, Aust, Teters and Rule, yes. Gary Brenner, 3009 NW Vivion representing the Park Board said that the Park Board received a grant for X175 for trees to be planted by Boy Sca~_~ts. The Northland Garden Glub will monitor and water these trees for one year, There is also a 200 foot sq~_iare of ground ar^ea for wild flowers. The Garden Club will furnish and plant the seeds and also monitor them. Gary Brenner presented the Mayor with the check for X175.00. The hearing on the Mr. and Mrs. William Clark's pr^operty i P. 2, ~-15-94, Min. Reg. Meeting at 5@th Street was cantinued. LeRoy Rhodes, 85$5 NW 5@th Street was present. City Attorney Dan Witt said that at the last meeting the Ca~_incil showed same pictures which depicted that there were violations of the nuisance ordinance. Mr. Rhodes also presented same pict~_~res, and said that he has cleaned up the place almost 9@X. He said a friend of his with a truck will be here in about two weeks and will move the two vehicles far him to a place where they can be repaired. Mrs. Clark said that she noticed that the area was cleaned up same. Mrs. Clark had previously spoke to the board regarding their putting this building an the public sewer system. City Attorney Witt said that the City could have this matter cantinued to allow the clean up to occur or pass a resolution to have the building demolished because of it not meeting the housing code. Mr. Rhodes said that he wo~.ild need two weeks to 3@ days to clean up the area. He said this depends an whether he can work ~~ut sarnething with Mrs. Clark that he can continue to live there, since he has received notice to vacate. He said since he is disabled he would probably not be out of the house far at least one and one-half month. This matter was discussed. Alderman Karr moved that the pass the resolution directing vacation, demolition and clean up of the William H. and Elva Jay Clark's property at 28@5 NW 5@th Street, Riverside, M].5sallrl, seconded by Alderman Rule, the vote was Aldermen Aust, Mar^shall, Wedua, Teters, Rule and Karr, yes. This concludes the hearing on the property at ~8@5 NW 5@th Street. Mrs. Clark said that she has a potential buyer far the proper^t y, or they may try to bring the building up to the b~_iilding Cade. Erin McGill, with Federal Sign, 44@@ Clary Blvd., Kansas City, MO Es413@ presented her plans with regard to outdoor sign far Argosy Gambling Boat, She said the main sign will be 47 feet high and it will have two message panels below far signs. Without the panels, there is under 4@@ sq. ft. of advertising space. With the cabinets and squaring off the main sign, it is 481 sq, ft. However^, the area with the design only has not been measured and this will be Bane before going to the Board of Zoning Adjust. This matter was discussed. i F~. 3, :?-15-54, Min. of Reg. Meeting Alderman Karr rnaved to approve the special use far the tempor^ar^y sign, for a per^iod of thr^ee years, as applied far by Erin McGill far Argosy Gambling Eiaat, the Zoning Enforcement Officer is to determining whether or not this is to be sent to the PZA, seconded by Alderman Marshall, the va~te was Aldermen Wedua, Aust, Teters, Karr, Marshall, yes; Alderman Rule abstained. Alderman Rule said that the property that Argosy is using an a ternparary basis until their permanent buidlings ar^e b~_iilt far Riverboat Gambling (far not more than three years from the date of the agreement) was given to the City for a City Park and after' the three years the City should apply itself to see that it is a City Park. Ron James, with Kaw Valley Engineering Ca.. at 1~2 NW Parkway, presented application far Special Use Permit far Missouri Gaming company far Temporary Mooring Facility in a carnnrercial vessel zone. Mr. Janes explained haw this is the last phase of the ternparary pra,7ect. This mooring facility will 6e an the area south of the par'king lat. They want to be able to rnave in and out of the channel as needed. They will dredge the channel and place the sand and silt in a drying area and use the mater^ial as needed. They will control the bank frarn additional eroding with rock rip-rap. Mr. Jones said this is in the hands of the Carp of Engineers far appr'oval and the City Engineer has not sent the City a letter of appr'oval. Mr. Janes said there will be repeated dr'edging far at least six to eight months. The bank will have a 2-1/~ to 1 slope. This matter was discussed and Ran Jones, as well as the Argosy people said they would put the area in the same condition as it was prior to the rnaaring when they are through. However, all this work on the river has to be dine by the approval of the Car^p of Engineers. Alderman Karr moved that the Special Use Permit far Argosy be approved contingent upon an agreement provided by Argosy that they will remove the rnaaring at any time after they are an their permanent place, that the r^ip-rap is adequate to hold the river ~_~nder normal conditions and a certificate showing same and subject to the Corp of Engineer^s' approval as well as the approval of the City Engineer^, seconded by Marshall, the vote was: Alderman Rule, abstained; Aldermen Marshall, Rust, Wedua, Teter^s, and Karr, yes. The Argosy people are going to meet with FEMA and the Mayor requested to be invited tr_. the meeting. City Attorney Witt introduced Tad Graves who is a i P. 4, 2-15-94, Min. of Reg. Meeting candidate far prosecuting attar^ney far Platte County. A recess was called. Meeting r^ecanvened. The roil was called and Alder^mer~ Wedua, Teters, Karr, Marshall, Rule and Aust were present. Mayor Burch presided aver the rernainder^ of the meet ing. Larry Reece spoke to the Mayor and Berard regarding the City getting approval on a grant for a woad chipper frarn Platte Caunty Solid Waste Management. This is in the Burn of ~40Q~@. ~D@ and the City has to match this amount. Lar-ry Reece said he would like to get approval to secure same bids an purchasing a woad chipper. The Mayor^ and Board cif Alderman were in agreement that bids should be obtained on a wand chipper for the City. Larry Reece explained to the City that he has a crew of people cleaning Line Creek of the debris that was placed there during the fi~~od. The empir_~yees are people who have been out of work, mostly as result of the flood. The City does not have to pay their salaries. Larry Reece said that he has to talk to Narthmaor Mayor^ and explain that when they get up in the area where Narthmaar is an erne side of Line Creek that they will clean bath sides of the Greek. Larry Reece said the David Theatre removal has dust been completed at a cast of ~12,Q~90. He has talked to SEMA and should be receiving a check on the dumpsters and emergency service very shortly. Larry Reece said that the Back Hae has been repaired by Dean Machinery and returned to the City. The cast of repairing and returning machine was ~4,2~1.49. The minutes of January 18, 1994 were read and approved as corrected. The Minutes of February 1, 1994 were read and approved as corrected. Mayor Burch said that everyone has had a change to read the Annual Report presented at the last meeting by Chief Bayless. This was very informative and a very goad report. Alderman Karr moved that the City accept the Annual Report as presented by Chief Bayless, seconded by Alderman Marshall, the vote was Aldermen Wedua, Teters, Karr, Marshall, Rule and Aust, yes. Chief Bob Bayless said that he has two letters of i P. 5, 2-1v-94, Min. of Reg. Meet irig resignation by Tabb Reese and Sean Ripper, which he read. Alderrnan Karr moved to place Pill No. 94-13 on its first reading, seconded by Alderman Wedua, the vote was Alderman Wedua, aye; Alderman Teters, aye; Alderrnan Karr, aye; Alderman Marshall, Rlderman Rule, aye; Alderman Aust, aye. This Pill provides for the acceptance of the resignation of Tabb Reese as part time dispatcher, effective January :?~, 1994. - Alderrnan Karr moved to place Pill No. 94-13 on its second reading, seconded by Alderman Wedua, the vote was Alderrnan Wedua, aye; Alderman Teters, aye; alderman Karr, aye; Alderman Marshall, Aye; Alderman Rule, aye; Alderrnan Aust, aye. Upon the Pill having been read two times and copies of the bill having been made available for public inspection prior to consideration of the Paard of aldermen, Pill No. 94-13 was passed. Alderrnan Karr moved to place Pill No. 94-14 or. its first reading, seconded by Alderman Marshall, the vote was: Alderrnan Wedua, aye; Alderman Teters, aye; Alderman Karr, aye; Alderman Mar^shall, aye; Alderman Rule, aye; Alderrnan Aust, aye. This Pill provides for the acceptance of Sean Ripper's resignation as Dispatcher for the City of Riverside, Missouri, effective Febr^uary 26, 1994. Alderman Karr moved to place bill No. 94-14 on its second reading, seconded by Alderman Marshall, the vote was: Alderman Wedua, aye; Alderman Teters, aye; Alderman Karr, aye; Alderman Marshall, aye; Alderman Rule, aye; Alderrnan Aust, aye. Upon the Pill having been read two times and copies of the bill having been made available for public inspection prior to consideration of the board of Aldermen, Pill Na. 94-14 was passed. Chief Pob Payless said he would like the City to enter into a Fire Mutual Agreement with Grandview, Missouri. He said one of the main things far this agreement is far the use of their^ dog which can detect the cause of the fire. Alder^man Karr moved that the City of Riverside inter into a Fire Mutual Agreement with Grandview, seconded by Alderrnan Marshall, the vote was Aldermen Aust, Rule, Marshall, N.arr, Teters and Wedua, yes. Chief Pob Bayless said that he has compiled all the tr^aining records of all the Public Safety Department Ernplayees. He said this comes very handy - to be pertinent information for prerequisite training selection, fairness and liability. r- I P. 6, 2-15-94, Mir,. of Reg. Meeting Mayor Burch said that Municipal Court Clerk Kathy Rr_,se has presented the January 1994 Co~_rr^t Report. A letter fr^orn Mary Wickman was r^ead, r^eq~.resting that the City praclairn May 5 as a day of pr^ayer. Aldermar, Karr rnaved that the City Pr^aclaim May 5, 1994 as a Day of Prayer, seconded by Aldermar, Wedua, the vote was: Aldermen Aust, Rule, Marshall, Karr, Teter^s and Wed~_ra, yes. The minutes of February 3, 1994 were read and approved as corrected. The minutes of February 7, 1994 were read ar,d appr^aved as corrected. Several of the Aldermen said that ther^e err^e quite a few street lights out. Alderman Teters said that Kenny°s station an NW Viviar, still has not been cleaned up. Alderman Karr moved to place bill Na. 94-15 an its first reading, seconded by Alderman Aust, the vote was: Alderman A~_ist, aye; Alderman Wedua, aye; Alder^rnar Teter^s, aye; Alderman Rule, aye; Alderman Karr, aye; Alderman Marshall, aye. This bill provides for the apprc~pr^iation of mar,ey out of the general fund of the City of Riverside, Missa~_rri for the payment of certain indebtedness as listed ther^ein. Alderman Karr moved to place Bill Na. 94-15 an its second reading, seconded by Alderman Wedua, the vote was Alderman Aust, aye; Alderman Wed~.ia, aye; Alder^rnar, Teters, aye; Alder^mar, rule, aye; Aldermar, Kar^r, aye; Alder^rnar, Mar^shal 1, aye. Upon the Bi 11 having beer, read two times and copies of the bill having been made available for^ public inspection prior to consideration of the Berard of Alder^rnen, Bill Na. 94-15 was passed.
