MINUTES OF REGULAR MEETING OF
BOARD OF ALDERMEN OF CITY OF RIVERSIDE, MISSOURI
MAY 10, 1994
A regular meeting of the Board of Aldsrm®n of the City
of Riverside, Missouri was held in the City Hall in
Riverside, Missouri on Mey 10, 1994 et 7:30 p.m. Those
present were Aldermen Wedua, Teters, Auat, Marshall, Rule and
Owen. Mayor Betty Burch called said meeting to order.
It was decided to dispense with the reeding of the
Minutes of May 3, 1994 for the present time.
Mayor Burch announced that this is the night for the
hearing on complaints received regarding large trailers
parked in the residential areas.
Leeann 2lmmerman (Ward I) 904 Valley Lane said that
prior to this she had addressed the Board with regard to not
allowing over-sized vehicles, semi's, tow trucks parked in
Indian Hills Residential area.
Bill Bright CWard I) inquired what type of Ordinance the
C1ty now hea with regard to these type of vehicles. City
Attorney Dan Witt said as of now the ordinance allows these
types of vehicles to be perked in the owner's driveway.
John Weat (Ward I> spoke and thought this could have an
effect on property values.
Dick Grogan CWard III> spoke r®garding a diesel dump
truck which he can see out his front window and said it
usually comae in after dark and leaves early in the morning
and he says it dose make quite a bit of noise.
Mr. Wilson (Ward III) said that th• trailers and
tractors are parked on private property and could see no
problem.
Frank Martin CWard I) asked if this ruling would be City
Wide or dust in Indian Hills. He saw no problem with the
clean trucks being parked in the driveways.
Mark Johnson, 5007 NW Merrimac, said he dust purchased a
dump truck and he started to work for a construction company
and sometimes the person driving for him takes it home.
Dwayne Hurlburt CWard III) was against enacting another
ordinance other than what we have. He said that the people
who drive these trucks nr® making a living with their trucks
and as long as they park in their driveways, ha ease no
problem.
Eugene Kemerling CWard I) said that the tractors coat

anywhere from td100,000 to X150,000 or more and they are very
susceptible to theft and can understand why people want to
park them at their house.
Phyllis Williams CWard III) said that they have people
in their neighborhood with these trucks and they are making a
living with them end she sees no problem with their parking
the trucks in their driveways.
Harold Well CWard III> inquired as to what other cities
are doing with this problem.
Brian Roberta and Sharon Roberta (Ward III) said that
the dump trucks are dangerous. There era children playing in
the streets. He also said that the people who have the trucks
are always working on them and it is very noisy. They work
on the trucks late at night and early in the morning.
Mayor Burch said she had Larry Reece call some of the
surrounding cities regarding their ordinance in this regard
and he hna the following:
Platte City, for one and two family residential, may
have passenger care lase than 20' in length and campers, etc.
can be perked in driveway in accordance with Section 7.
Pleasant Valley, semi's may be parked in the residential
area only in the driveways and not in the streets. Trailers
have to be parked in other restricted areas.
Parkv111e has no ordinance and they have not been
tested.
NKC, oversized can be parked on the street with
p®rmisaion from the police department.
Liberty, permits tractors only in private driveweya.
It was suggested for some of the people to check the
restrictions in their additions to see if trucks are
permissible.
Amos Cox CWard III> said he would not like for large
trucks to park in hie neighborhood. He also inquired to
abandoned care.
Mayor Burch said that they have been working on nuisance
in the City.
Chief Bob Bayleaa said the nuisance ordinance is quite
time consuming, it takes some 30-60-90 days to get any
action.

The aub~ect of trucks hauling dirt on High drive was
brought up end Mitchel Burch wa8 present and said that they
have a hauling permit for this.
It waa suggested to check into ways that people can park
their RVs, trucks, boats, etc. at their house. Some
suggestions were to perk behind the 35' building line, some
suggested only one oversized vehicle per resident, etc.
It appeared that the audience was even on the pros and
cone of oversized vehicles, RVs, dump trucks, Tractors, etc.
Mayor Burch said that the Board will study this
ordinance and all the input from this meeting. If there is e
decision to change the ordinance, it will have to be
advertised and a hearing before the Planning Commission will
be held end then will be before the Board of Aldermen.
It was also brought up that other equipment would hove
to be considered in the ordinance, such as tractors, back
hoes, etc.
Soros of the people in th• audience inquired about the
violations of the ordinances, are they being taken cars of.
Ths answer waa that if their is a nuisance someone will hove
to file n complaint and it is taken up from there.
Mra. Williams asked if businesses are allowed in
residential houses and she was told there are certain ones
allowed according to the ordinances.
Mra. Williams also inquired whether single family homes
are allowed to have separate rental apartments. She was told
this waa not allowed.
Mayor Burch suggested this matter of parking trucks,
tractors, etc. in residential areas be taken under
advisement. She will have Larry Reece to get copies of
surrounding Cities' ordinances end the Board will study them
and come up with an answer.
Mayor Burch said City Clerk Grace Kemerling received a
fax from the attorneys for Trillium inquiring whether
anything waa going to be discussed at this meeting regarding
Argosy. Grace Kemerling had mode notice on the fax that she
answered the attorneys telling there waa nothing on the
agenda with regard to Argosy.
Mayor Burch said she had a resolution opposing the
Handcock II amendment end urging voters to not sign the
Handcock II petitions or vote until they have become fully

informed as to the impact of the proposed Amendment on local
and state government including municipal services and
education.
Alderman Merahall moved that the city accept the above
Resolution, seconded by Alderman Auat, the vote wee:
Aldermen Wedua, Auat and Merahall, yea; Aldermen Ruls, Tetsra
and Owen, No. Mayor broke the tie by voting "yea".
Mayor Burch avid ahs received a letter form Kanaaa City,
Missouri Water Pollution Department regarding changes in
sewer rates.
Aldermen Marshall moved to place Bill No. 94-28 on its
first reeding, seconded by Aldermen Aust, the vote was:
Alderman marahall, aye; Alderman Auat, aye, Aldermen Rule,
aye; Alderman Wedua, aye; Alderman Owen, Aye; and Alderman
Tstera, aye. This Bill repeals section 16.7 of the Code of
ordinances of the city of Riverside, Missouri and enacting a
new section 16.7 regarding public sewers, and the rates to be
charged for the use and services thereof.
Alderman Marshall moved to place Bill No. 94-28 on its
second reading, seconded by Alderman Auat, the vote was;
Aldermen Marshall, aye; Alderman Auat, aye; Aldermen Rule,
aye; Alderman Wedua, aye; Alderman Owen, eye; and Aldermen
Tetsrs, aye. Upon the Bill heving been made available for
public inspection prior to consideration of the Board of
Aldermen, bill No. 94-28 waa passed.
Mayor Burch said she received a call from White Buffalo
people wenting to rent the former Coach Light Rink.
Mayor Burch said there is now legislation that the City
can shut off the Water for people who are delinquent on the
sewer bills.
Mayor Burch said she hea request from the Municipal
Judge and Municipal Clerk to go to the Annual Court
Conference at the Lodge of the Four Ssasona for the sum of
5650.00 to cover the Ease.
Alderman Merahall moved that th• City authorize the
Municipal Judge and Municipal Clerk to go to the Annual Court
Conference to the Lodge of the Four Seasons for the sum of
5650.00, seconded by Alderman Aust, the vote waa Aldermen
Auat, Tetera, Owen, Rule, Marshall and Wedua, yea.
Mayor Burch said she was going to a meeting on the David
Theatre mutter. She said she would tell Mr. Robertson that

the City will put up a fence to screen the property and she
will have the key.
Wedua said the state is willing to give the property
along Gower Street back to the property owners. There are
three people. He said the people era willing to pay for the
survey. The Mayor and Board were willing to approve this
project.
The aub~ect of the nursery at Red-X was brought up
concerning their not hewing a business license. This will be
checked into.
There being no further business to corns before the
Board, upon motion duly made, seconded and passe meeting
adjourned at 11:30 p.m.
