HomeMy WebLinkAbout2009-137 - Northland SymphonyBill No. 2009-137 Ordinance No. 2009-137 AN ORDINANCE AUTHORIZING AND APPROVING THE CITY OF RIVERSIDE, MISSOURI, TO ENTER INTO AN AGREEMENT FOR SERVICES WITH AND PAY CERTAIN FUNDS TO THE NORTHLAND SYMPHONY ORCHESTRA ASSOCIATION, INC. WHEREAS, the Northland Symphony Orchestra Associafion, Inc. ("Service Provider") is anot-for-profit corporation that offers professional, community and student musicians an opportunity to perform fine orchestral music and free public concerts ("Services"), to residents of the Kansas City region, including the City of Riverside (the "City"); and WHEREAS, Service Provider desires to continue to provide such Services and requires funding to continue to provide the Services within the City; and WHEREAS, the CiTy desires that the Service Provider provide such Services to the City and finds that the provision of the Services is a public purpose and contributes to the welfare of the City as well as the economic and social potential of the City and its Residents, and the City has the capability and desire to assist the Service Provider in continuing to provide Services to the public within the City; and WHEREAS, the City's Board of Aldermen believes that the City's best interest are promoted and aided by providing funds to the Service Provider for the provision of Services; and WHEREAS, the City and the Service Provider have negotiated and agreed upon an Agreement for Service and payment for the same; and WHEREAS, the City finds that the provision of Services is for a public purpose and is in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RNERSIDE, MISSOURI, AS FOLLOWS: Section 1. This Ordinance is intended and is hereby determined and declazed to be necessary to accomplish and serve the public purpose of contributing to the general welfaze of the City and its residents; Section 2. The City of Riverside shall pay to the Service Provider the sum of Two Thousand Five Hundred Sixty Eight Dollars No Cents ($2,568.00), which funds shall be provided from the City's Tourism Tax Fund, to assist it in continuing to provide Services to the residents of the City and the City, pursuant to a Service Agreement, in substantially the form attached as Exhibit A, which is hereby approved. The Mayor and City Clerk are authorized and directed to execute the Service Agreement, execution of such document being conclusive proof of such approval. Section 3. The Mayor, the City Administrator, the City Attorney and other appropriate City officials are hereby authorized to take any and al] actions as may be deemed necessary or convenient to carry out and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City all certificates, instruments, agreements and other documents, as maybe necessary or convenient to perform all matters herein authorized. Rose soon ~ ~ i~a I~ SERVICES AGREEMENT I II I ~ i1 ~ ~ [~1 5~ THIS SERVICES AGREEMENT entered into on this ~ day of ~ 2009, by and between the CITY OF RIVERSIDE, MISSOURI ("City"), and NORTHLAND SYMPHONY ORCHESTRA ASSOCIATION, INC. ("Service Provider"). WHEREAS, Service Provider is a Missouri non-profit corporation that offers professional, community and student musicians an opportunity to perform fine orchestral music and free public concerts ("Services"), to residents of the Kansas City region, including the City of Riverside (the "City"). WHEREAS, Service Provider desires to provide such Services and requires funding to continue to provide the Services within the City. WHEREAS, the City desires that Service Provider provide such Services to the City, has found that the provision of the Services contributes to the welfaze of the City as well as the economic and social potential of the City and its residents, that the Services are important to the welfaze of the City and that the provision of funds to assist in providing such services aze for a public purpose. IN CONSIDERATION of the mutual covenants and agreements set forth herein, the parties agree to the following: 1. That Service Provider shall provide the Services for the City pursuant to the terms of this Services Agreement, at a time and place to be mutually agreed upon by the City and Service Provider. 2. That the City shall pay to Service Provider the sum of $2,568.00. 3. That the Services provided by Service Provider shall include, but not be limited to, offering professional, community and student musicians an opportunity to perform fine orchestral music and free public concerts in the City and surrounding community.
